A paper writing purporting to be the last Will and Testament of John W. Lamm, deceased is exhibited before me, the undersigned Clerk of the Superior Court for said county, by John Hoover Lamm, the executor therein mentioned, and the due execution thereof by the said John W. Lamm is proved by the oath and examination of R. I. Boykin and Mabel T. Renn, the subscribing witnesses thereto who being duly sworn, doth depose and say, and each for himself deposeth and saith, that he is a subscribing witness to the paper writing now shown him, purporting to be the last Will and Testament of John W. Lamm; that the said John W. Lamm, in the presence of this deponent, subscribed his name at the end of said paper writing, which is now shown as aforesaid, and which bears date of the 18 day of April, 1924.

And This Deponent Further Saith, that the said John W. Lamm the testator aforesaid, did, at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited to be his last will and testament, and this deponent fid thereupon subscribe bis name at the end of said will, as an attesting witness thereto, and at the request and in the presence of said testator. And this deponent further saith that at the same time when the said testator subscribed his name to the said last will as aforesaid, and at the time of the deponent's subscribing his name as attesting witness thereto, as aforesaid, the said John W. Lamm was of sound mind and memory of full age to execute a Will, and was not under any restraint, to the knowledge, information or belief of this deponent: And further these deponents say not.

I, Jno. W. Lamm, of Wilson County, North Carolina, being of sound mind but mindful of the uncertainty of life and the certainty of death, do make and declare this my last Will and Testament, in words, manner and form as follows, to-wit:

ITEM ONE: My executor hereinafter named shall give my body a burial suitable to the wishes of my family, and shall, at all times, retain in his hands a sufficient amount of money belonging to my estate to give my wife a suitable burial and erect at our graves suitable stone or granite markers, and he, my executor, shall pay for the same, together with all my just debts, from the first moneys coming into his hands belonging to my estate.

ITEM TWO: I give, devise and bequeath, for the term of her life, all of my estate, both real and personal, unto my beloved wife, Treacy Lamm, and each bequest and devise hereinafter contained is made subject to the life estate of my said wife, and shall not become effective until the death of my said wife.

ITEM THREE: I give, devise and bequeath to my son, Sanford Lamm, the house in which he now lives and twenty (20) acres of the land bought from Tempie Worrell, situate and located next to the said house in which he now lives. The said Sanford Lamm however, shall pay unto Ola Pearson Five Hundred ($500.00) Dollars, and the said $500.00 until it shall have been paid to her, shall bear interest from the date of the death of my wife, if she shall survive me, or from my death if I shall live the longest, and the said $500.00 and interest shall be and constitute a lien on the lands herein devised unto Sanford Lamm until its payment, and the payment thereof may be enforced by a sale of the said lands, or a sufficient amount thereof, to pay the same in the event that Sanford Lamm should fail, within twelve months from the time this devise becomes effective to pay the same.

ITEM FOUR: I give, devise and bequeath to my son, Aby Lamm, the balance of the Worrell Tract of land in Old Fields Township not devised in the preceding item to Sanford Lamm. The said Aby Lamm, however, shall pay to Ola Pearson Five Hundred ($500.00) Dollars with interest thereon from the date of the death of my wife, if she shall survive me, or from my death, if I shall live the longest, the said $500.00 and interest to be a lien on the lands devised to Aby Lamm, and shall be paid within twelve months from the time that this devise becomes effective. The said lands, or a sufficient part thereof to pay the said sum and interest, may be sold in the event that the said Aby Lamm shall refuse to pay the said $500.00 and interest, and from the proceeds of such sale, which shall be made by my executor, under a decree of the Superior Court of Wilson County, the said $500.00 and interest shall be paid to Ola Pearson, the balance, if any, to Aby Lamm.

ITEM FIVE: I give, devise and bequeath to Lula Wells twenty (20) acres of land, more or less, in Old Fields Township, Wilson County, North Carolina, being part of the land inherited by me from my father, Tommie Lamm, and described as follows: It is that 20 acres, more or less, west of a ditch which runs from Grover T Lamm's line towards Bloomery Swamp to the fork of the ditch and thence North to the run of Bloomery Swamp. The estate herein devised unto Lula Wells is a life estate, however, but full power and authority, is given unto the said Lula Wells to dispose of the said property in fee simple, or upon such conditions as she may see fit, by either will or deed, and such conveyance made by her shall be effective to pass the fee simple estate therein. If, however, she should die without having disposed of the said property, either by will or deed, then the remainder thereof I give, devise and bequeath to her children. There is expressly excepted from this devise on-half acre of land in the above described tract pn which is situate the family grave yard and as to that, it is my will and desire that the said Lula Wells and her assigns, shall keep the said grave yard perpetually for the use of my family as a burying ground.

ITEM SIX: I give, devise and bequeath unto my daughter, Beulah Finch, the balance of the tract of land from which the land given Lula Wells was taken, the lands herein devised unto Beulah Finch being all of the lands owned by me of that tract of land which lies east of the ditch and a line from the fork of the ditch north to Bloomery Swamp.

The estate herein devised unto Beulah Finch is a life estate, however, but full power and authority is given unto tge said Beulah Finch to dispose of the said property in fee simple, or upon such conditions as she may see fit, by either will or deed, and such conveyance made by her shall be effective to pass the fee simple estate therein. If, however, she should die without having disposed of the said property, either by will or deed, then the remainder thereof I give, devise and bequeath unto her children.

ITEM SEVEN: I give, devise and bequeath unto Claud Lamm the house in which he now lives and twenty acres of land nearest the house in which he now lives.

ITEM EIGHT: I give, devise and bequeath unto Addie Page twenty two (22) acres of land, more or less, from my home tract of land, described as follows: Beginning at G. T. Lamm and Chas. Lamm's line where Sid Page lives, and runs thence with G. T. Lamm's line nearly north to within forty yards of the larger of two persimmon trees, thence nearly west in a straight line to a wire fence, thence nearly north with the wire fence to a point seventy-five yards north of an elm tree, thence nearly west in a straight line to the line of the land heretofore deeded by me to Hoover Lamm, thence with that line south to Chas. Lamm's line, thence with Chas. Lamm's line to the beginning.

The estate herein devised unto Addie Page is a life estate, however, but full power and authority is given unto the said Addie Page to dispose of the said property in fee simple, or upon such condition as she may see fit, by either will or deed, and such conveyance made by her shall be effective to pass a fee simple estate therein. If, however, she should die without having disposed of the said property, either by will or deed, then the remainder thereof I give, devise and bequeath unto her children.

ITEM NINE: I give, devise and bequeath to my daughter Pearl Joyner, the balance of my home tract of land, including my home place for the term of her natural life, with the remainder to the children of Pearl Joyner.

My daughter, Pearl Joyner, however, shall be required to pay to my daughter Beulah Finch, Two Hundred ($200.00) Dollars, and unto Lula Wells Two Hundred ($200.00) Dollars, which said sums shall be and constitute liens on the lands herein devised to Pearl Joyner, and shall bear interest from the date that this devise becomes effective. The said lien may be enforced by a decree of the Superior Court of Wilson County if the said sums shall not be paid within twelve months after thie devise becomes effective.

ITEM TEN: I give, devise and bequeath to my daughter, Ola Pearson, Six Hundred ($600.00) Dollars in addition to the Five Hundred ($500.00) Dollars to be paid to her by Sanford Lamm and the Five Hundred ($500.00) Dollars to be paid to her by Aby Lamm. This Six Hundred Dollars shall be paid by my executor from the personal estate coming into his hands, if sufficient, and if insufficient, such deficit shall be paid in pro rata amounts by Pearl Joyner, Lula Wells, Beulah Finch, Addie Page, and Claud Lamm, which amounts shall be and constitute liens on the lands herein devised unto them until the payment thereof, and the payment thereof may be enforced by a sale of the said properties under an order of the Superior Court of Wilson County upon application made to said Court in a proper proceedings therefor, if not paid within twelve months from the time that this bequest becomes effective.

I have during my life conveyed to Hoover Lamm a part of my land, of about equal value to the shares of land herein given and devised to my other children, and for that reason I only bequeath unto the said Hoover Lamm two shares of stock owned by me in the Farmers Union Warehouse Company, of Wilson, North Carolina.

That there may be no uncertainty as to my true meaning and intent, I reiterate that all of the bequests, legacies and devises herein given and granted unto my children shall not become effective until the death of my wife, who shall have the said property for and during the term of her life, as herein before provided.

I hereby name, constitute and appoint my son, Hoover Lamm, my lawful executor to all intents and purposes, to execute this my last will and testament, according to the true intent and meaning of the same, and every part and clause thereof, hereby revoking and declaring utterly void all other wills and testaments by me heretofore made. I direct that my executor shall give a bond, for the faithful performance of his duties, in an amount equal to double the estimated value of my personal estate at the time of my death.

IN WITNESS WHEREOF, I, the said John W. Lamm, do hereunto set my hand and seal this 18th day of April, 1924.

Lamm, Lula Mae (b. JUN 1879, d. 29 MAR 1952)

Mrs. Lula Lamm Wells age 73, of Sims, died at the home of her daughter, Mrs. J. V. Peele, this morning at 10 o'clock after an illness of nine years.

Surviving besides Mrs. Peele are three daughters, Mrs. Sanford Lucas (Effie) of Wilson, Mrs. Curtis Lucas (Nora), of Wilson, and Mrs. Laudis Tant (Esther) of Sims; four sons, Hallie and Claudie Wells of Wilson, Bruce Wells of Wilson and Herbert Wells of South Carolina; her mother, Mrs. Treacy Lamm of Wilson and four brothers: Sanford, Claudie, Alvie and Hoover Lamm all of Wilson; three sisters, Mrs. Bartley Pearson of Sims, Mrs. Bud Joyner of Wilson, and Mrs. W. T. Finch of Wilson; 28 grandchildren and 19 great grandchildren.

Funeral arrangements are incomplete.






Mrs. Lula Lamm Wells

Funeral services for Mrs. Lula Lamm Wells were held Sunday afternoon at 3 o'clock at Milbourney Free Will Baptist Church, conducted by the Rev. Willie Renfrow. Burial was in the Rock Hill cemetery at Lamm's Crossroads.

A quintet composed of Miss Lillie Boykin, Mrs. Retha Davis, Mrs. Carnell Peele, Mrs. Gertrude McKeel and Harold Williamson sang "The Old Rugged Cross". Miss Maynell Nichols and Miss Constance Williamson sang a duet, "Beyond the Sunset".

Pall bearers were William Peele, Foster Lucas, Thomas Tant, Caris Lucas, Brutus Wells and Leslie Wells.

Flower bearers were Mrs. Madelene McKeel, Mrs. Esther Pearson, Mrs. Ernestine Ham, Mrs. Etheleen Barnes, Mrs. Gladys Winborne, Mrs. Ruby Williams, Mrs. Mildred Smith, Mrs. Gretchen Williamson, Mrs. Beulah Baker, Miss Pearl Lucas, Miss Rose Lucas, Miss Sylvia Lucas, Miss Carolyn Tant, Miss Jean Winborne, Miss Doris Williams and Miss Dawn Williams.
