James Woodward
of Wake Co, NC, Logan Co, KY,
Caldwell Co, KY, Hickman Co, KY, and Calloway Co, KY

In order to understand the relationships involved in James Woodward's records, it will be necessary to understand some of the relationships involving the Utley and Jones families of Wake Co, NC as well.

James Woodward born ca 1767-1770, place not proven, but probably Johnston Co, NC.

James Woodward was named as a son in the Wake Co, NC will of Christopher Woodward written Aug. 27, 1784:

Item     I give unto my Son James Woodward all my land that lieth on the Dreans of Crabtree Creek also three hundred Acres of woodling Land which I purchised of William Harvil which Land lying and being on both sides of lick Branch also my Still and Twenty five pounds specie to him and his heirs for Ever

Dec 6, 1785 Etheldred Jones appointed guardian of James Woodward, orphan of Christopher Woodward; signed by Etheldred Jones and Silas Green.   From Christopher Woodward estate file at NC Archives

James Woodward did not appear as a buyer at the estate sale of his father, Christopher Woodward.

Jacob Utley will, Wake Co, written Aug 19, 1796, recorded July 21, 1797 WB D p 261:
Daughter Winnifred Woodward: Negro Lettice now in her possession.
Daughter Elizabeth Utley: Negro Abram; furniture, livestock, saddle
Son William Utley: 300 acres on both sides of Middle Creek joining James Woodward  on Lick Branch & Etheldred Jones; Negro Daniel; furniture
Son Little John Utley: 300 acres purchased of Matthew Macklin except about 9 acres adjoining Augustus Turner; 75 A purchased of John Macklin joining Capt Farrar's lines; Negro Nancy; 20 L; furniture; livestock
Son Merrel Utley: 200 acres on S side of Middle Creek; 100 L; furniture; livestock
Son Jacob Utley: land above large Branch on N side of Middle Creek to Augustus Turner's line; 100 acres above Turner to be in his possession when he becomes 21, wife to have it until then; 110 L; furniture; colt
Daughter Phebe: Negro Phillis; 25 L.
Daughter Cynthia: Negro Milley; 25 L.
Son Gabriel Utley: rest of land not heretofore mentioned; Negro Lawson; 25 L.
Wife Phebe Utley: Negroes Hercules, Dinah; rest of property.
Extr: Son William Utley, Brittain Sanders, Augustus Turner, Isham Utley
Wit: John Farrer, Hardy Sanders (Jurat), Jonathan Smith (Jurat)

Daughter Winifred Utley Woodward was the wife of James Woodward's brother, Pleasants Woodward. Their Wake Co marriage bond was dated March 6, 1786.

The Wake Co, NC marriage bond for James Woodward and Betsey Utley was dated Dec 6, 1799, Merrel Utley bondsman, Lewis Greene witness. Betsey was the same as daughter Elizabeth named in Jacob Utley's will.

James Woodward's 1800 census in Wake Co listed 1M 26-45, 1F 0-10, 1F 26-45. It would appear that a daughter had been born in 1800 shortly before the census was taken.

Wake Co, NC marriage bond dated June 25, 1804 for Powell Farrar and Phoebe Utley, Jacob Utley [Jr] bondsman.

The Wake Co will of Pheby [Phoebe] Utley, written Nov 2, 1804, proven February, 1805, left items to some of the individual children including daughter Pheby [Phoebe] Farrar, but not including Winifred Woodward or Elizabeth Woodward or some of the living sons. Her will also stated that any remaining money from the estate was to be "equally divided between all my Sons and Daughters and sons in law namely William Utley, Little John Utley, Meril Utley, Jacob Utley, Gabriel Utley, Cintha Utley, Pleasant Woodward, James Woodward, and Powel Farrar". Because daughters Winifred Woodward and Elizabeth Woodward were not mentioned in the will - only their husbands Pleasants Woodward and James Woodward - it has interpreted that both Winifred and Elizabeth had died prior to the will. The youngest child of Pleasants Woodward and Winifred Utley was Winifred Woodward b ca 1798/99. The oldest female listed on Pleasants' 1800 census was age 16-25. This female would have been born 1775-1784, so she could not have been Winifred Utley who married in 1786. Therefore, Winifred Utley must have died between 1798 and 1800 which agrees with the belief that Phebe Utley's will indicates daughters Winifred and Elizabeth were not named because they had died. Powell Farrar was also named as a son-in-law rather than his wife Phoebe, but Phoebe Utley Farrar was still living and was mentioned in the earlier part of the will.

However, there could be another explanation for this wording in Phoebe Utley's will. The only daughters who had married by the time that the will was written were Winifred, Elizabeth, and Phoebe. The daughter Cynthia later married Jefferson Farrar, Powell Farrar's brother, but she was not married when the will was written. In the case of each married daughter, their husbands (Phoebe's sons-in-law) were named rather than the daughters. We know that Phoebe Utley Farrar was still living because she was named in the earlier part of the will. The fact that Winifred Utley Woodward and Elizabeth Utley Woodward were not named in the earlier part of the will is not necessarily an indication that they had died. Some of the living sons also were not named to receive some specific part of the estate, but were living and were named in the last part of the will to share in the remainder. It does appear from the 1800 census and the birth of her last known child that Winifred Utley Woodward had in fact died by 1800, but I don't know that we can be sure that Elizabeth Utley Woodward had also died. James Woodward and Merrill Utley were closely associated with each other for the remainder of their lives. Wherever one of them moved, the other did too. You would not expect this to be the case if Merrill's sister Elizabeth Utley Woodward had died prior to 1804 and James had remarried. The later Wake Co, Logan Co, Caldwell Co, and Calloway Co records need to be searched carefully to see if they reveal the name of James's wife after 1804.

The Wake Co, NC marriage bond  for Jacob Utley [Jr] and Scythia Jones, bondsman Merrel Utley, was dated March 29, 1805. Scythia had been named as daughter Sytha Jones in the Wake Co will of William Jones (wife Mary Matthews) written March 7, 1800. Sytha/Scythia's older sister Winifred Matthews/Jones was the wife of Jacob's brother Merrill Utley. So there were three sets of double-sibling marriages in the children of Jacob Utley Sr and Phoebe - two Utley daughters married Woodward brothers, two Utley daughters married Farrar brothers, and two Utley sons married Jones sisters.

This marriage bond proves that Merrill Utley was still in Wake Co in late March, 1805, but slightly less than three months later, he was granted land in Logan Co, KY.

We know from the records of James's brother Richard Woodward that Richard had moved to land on the Red River in Robertson Co, TN in 1808 or 1809. It would appear that James Woodward and Merrill Utley arrived in this area first, and Richard Woodward and his family arrived not long after.

This deed should have been signed by James Woodward, not James Hughlett - no doubt a copying error by the clerk. This was obviously the same land from the grant above. It's curious that the deed selling the land to Hughlett was signed 10 Oct 1811, but the grant for the same land wasn't recorded until 11 Feb 1819. The land wasn't even surveyed until 16 April 1811, 6 months before the sale to Hughlett. It's also interesting that this land was in Robertson Co, TN, not Logan Co, KY.

Logan Co. Ky Deed Bk G  pg 112   Deed Abstracts 1813-1819
Indenture 18 Aug 1818. John Neely Jr and Charles Neely, latter of Crawford Co Ill Territory. $448.28, 194 acres patented 29 Jul. 1815 being on Red River, beginning on Stateline and adj. to lands of William Leaten & James Woodward.

We do not yet have a record that proves when or how James Woodward acquired this adjoining land.

The location of this land on the Red River is important. The Red River meanders back and forth along the state line separating Logan Co, KY from Robertson Co, TN. Merrill Utley and James Woodward lived on the north side of the river in Logan Co. James Woodward's brother, Richard Woodward, also settled on the Red River on land lying on the TN/KY line, but on the south side of the river in Robertson Co, TN. So although they lived in different counties and even different states, Merrill Utley, James Woodward, and Richard Woodward could not have lived more than a few miles from each other.

1810 Logan Co, KY census:
James Woodward  2 1 0 1 1 - 2 1 0 1 0 - 0 0 (p 175)
(2M 0-9, 1M 10-15, 1M 26-44, 1M 45+, 2F 0-9, 1F 10-15, 1F 26-44)
Murrel Utley  1 1 0 1 1 - 2 1 1 1 1 - 0 4 (p 166)
(1M 0-9, 1M 10-15, 1M 26-44, 1M 45+, 2F 0-9, 1F 10-15, 1F 16-25, 1F 26-44, 1F 45+)

James Woodward was age 26-44, so born 1766-1784.

We know from James's 1800 census that his first child, a daughter, had been born in 1800. The female 10-15 on the 1810 census could be that daughter, or she also could have been recorded as one of the females age 0-9. The male age 10-15 cannot be explained. This census indicates four children age 0-9 in addition to two children age 10-15. Elizabeth Utley could not have been the mother of any children born before 1800 unless their ages as given on this census were incorrect. The male 45+ also can't be identified. This male could not have been James's father or Elizabeth's father as both had died years before. Could he have been the father of these older children? There is also the possibility that Elizabeth Utley had died and James had remarried - perhaps to a widow with children. At this point, we can't be sure if Phoebe Utley's will was an indication of Elizabeth Utley's death or not.

Utley research states that Merrill Utley was b Aug 5, 1777. I don't know the source or reliability of this date. If this date is correct, it would indicate Merrill was 33 or 34 when this census was taken. He and Winifred Matthews/Jones were married Dec 8, 1800 (the record gave her name as Winifred Jones), so his 1810 census should not reflect any children over age 10. Merrill and his wife were certainly in the 26-44 group and the three children under 10 were probably his. There are children and older adults on this census who can't be explained.

Merrill's children are given by Utley research as:
Ditty Utley b 1802 Wake Co, NC
Tolly Utley b 1803 Wake Co, NC
Sally Utley b 1806 Logan Co, KY
Gabriel Utley b 1809 Logan Co, KY
Elizabeth Utley b 1811 Logan Co, KY
Jacob Utley b 1813 Logan Co, KY
Winnifred Utley b 1816 Logan Co, KY
William Washington Utley b 1818 Simpson Co, KY
Phoebe Sanders Utley b 1822 Logan Co, KY

Again, I don't know the reliability of the names/dates/places for the children of Merrill Utley above, but I do question the birthplaces of the last two children. Simpson Co was formed from Logan, Warren, and Allen Counties in 1819, and Merrill Utley's land is said to have been in the part of Logan that became Simpson Co. (So James Woodward's land might have fallen into Simpson Co too.) Simpson Co lies to the east of Logan Co on the TN/KY line. Probably William Washington Utley was actually born in Logan Co since Simpson Co had not been created at the time of his birth. Shortly after 1818, Merrill Utley acquired a grant in the Jackson Purchase in what is now Marshall Co - but at that time was Caldwell Co. This would probably explain why Merrill Utley and James Woodward appeared on the Caldwell Co census in 1820. According to a deed above, James Woodward still held land in Logan Co in 1818, so this agrees with the Woodward and Utley families moving to Caldwell Co after 1818 but before 1820. But the Jackson Purchase land didn't remain in Caldwell Co for long. Hickman Co was formed from Caldwell and Livingston Counties in 1821. Then Calloway Co was formed from Hickman Co in 1822. This is important because any of those counties might have Woodward or Utley records. Merrill Utley apparently moved his family to the new land shortly after William Washington Woodward's birth as his family was listed on the Caldwell Co census in 1820. By 1823, his family's records reflected Calloway Co. Merrill didn't leave his Jackson Purchase land - the land just lay in the part of Caldwell Co that evolved through all those changes and eventually became part of Calloway Co. So Merrill Utley's daughter Phoebe Sanders Utley must have been born in either Hickman or Calloway - but surely not Logan. Petty points in some ways, but important when you need to know which county might provide the records you need for any particular period of time.

A wonderful find posted by Martha Murphy:

..... To help you a small bit, in the "Franklin Favorite" newspaper, 175th anniversary 'Historical Review of Simpson County Kentucky' 1819-1994, an article excerpt states:
'In the years before 1819 there was activity and family life in the hamlet or crossroads that later became Franklin. Mr. Merrill Utley placed an ad in the August 14, 1819, "Russellville Weekly Messenger" that he had for sale 200 acres of good land on the Gallatin Road in Simpson county. He stated there was a good house and other necessary improvements with a 250 apple tree and 250 peach tree orchard.'

This again reflects the move from Simpson Co (previously part of Logan Co) to the Jackson Purchase land in Caldwell Co after 1818 but before 1820.

The name of Merrill's daughter Phoebe Sanders Utley is also an important detail to note. There is quite a bit of circumstantial evidence - but no absolute proof - that Merrill Utley's mother Phoebe was Phoebe Sanders, a daughter of James Sanders Sr and Ann Holmes and a sister to James Sanders Jr, John Sanders, Britain Sanders, and Hardy Sanders (wife Lucy Utley, Jacob Utley Sr's sister). Hardy Sanders was a witness to Jacob Utley Sr's will, and Britain Sanders was one of the executors. James Sanders Sr's grandmother was Phoebe --?--, wife of John Sanders Sr, whose land lay in both Nansemond Co and Isle of Wight Co, VA. The name Sanders also appeared in the descendants of Pleasants Woodward and Winifred Utley. A Calloway Co, KY marriage record for Phoebe Woodward probably reflects a daughter of James Woodward and Elizabeth Utley, named for Elizabeth's mother Phoebe. Phoebe Woodward of this marriage record was certainly not a daughter of Richard Woodward, as his will did not mention a daughter named Phoebe.

If Merrill's DOB as given by Utley research is correct, he would have been 43, so he should be the male 26-44. Although he is supposed to have had 8 children by this time, only 4 seem to be reflected by this census. Who was the F 45+?

Since James Woodward was listed as age 45+, this indicates he was born before 1775. Using his age from the 1810 census, we can narrow this down to 1766-1775.

By combining the census ages, James Woodward would have been born between 1766 and 1770. Since James was named in his father's will after Richard Woodward who seems to have been born about 1766, James was probably born between 1767 and 1770. This agrees with the 1786 guardian record that proves he was not of age at that time.

The children of James Woodward have not yet been proven. The Calloway Co, KY records need to be thoroughly searched. However, some possible children appear in the marriage records of Calloway Co.

Thomas Grubbs married Nancy Woodward, 17 June 1823 Consent for bride: Proof of age
James Ingram married Phebe Woodward, 11 Sept. 1823 Consent for bride: Proof of age
Ephraim Owens [Owings] married Lucinda Woodward, 1 July 1824
William Woodward married Sarah Campbell, 2 July 1833
Jackson Justice married Rebecca Woodward, 8 Dec 1839

Rebecca Woodward can be identified as a daughter of Edward Woodward, son of Richard Woodward.

Richard Woodward did have a son named William Coffy Woodward, but his wife can be proven as Tabitha Ann Metcalf who married William C. Woodard on 24 Jul 1834 in Henry County, TN. It's not impossible that William Coffy Woodward could have married previously and his first wife died soon after the marriage. So this William Woodward who married Sarah Campbell could be a son of James Woodward or Richard Woodward - or neither.

Richard Woodward's will also named a daughter Lucinda, but she appears to have been the wife of Isaiah Kirby. But it's also possible that James Woodward could have also had a daughter named Lucinda. Ephraim Owings held land in the Jackson Purchase very near Thomas Grubbs and James Ingram - whose wives were probably daughters of James Woodward. There are several sources that list this Lucinda Woodward Owings as a daughter of James Woodward, but none cite any records to prove the connection. This may have been only an assumption based on the fact that James Woodward lived nearby and was of the right age to have been Lucinda's father.

Richard Woodward's will did not name a daughter Phoebe, and this name was used several times in the descendants of Jacob Utley Sr and Phoebe. It's very possible that Phoebe Woodward who married James Ingram was a daughter of James Woodward and Elizabeth Utley - Elizabeth Utley's parents were Jacob Utley Sr and Phoebe - but even this needs to be solidly proven.

Richard Woodward's will also did not name a daughter Nancy Woodward. Nancy Grubbs, white female age 47 born NC and T. H. Grubbs, white male age 5 born KY were listed on the 1850 census in Calloway Co, KY.  If Nancy Woodward Grubbs was b ca 1803 in NC, she could have been a daughter of James Woodward. James Woodward's 1810 and 1820 censuses could support her, and James was still living in Wake Co in 1803.

Thomas H Grubbs, son of Benjamin M Grubbs, was previously married to Caty Roach in Caldewell Co, KY on 7 Dec 1815. He and Caty and later Nancy Woodward can be followed through the censuses for quite a few years.

In addition to the Woodward marriages, there were also Utley marriages in Calloway Co.

Vincent A Wade married Phebe Utley 28 Jan 1823 Consent for bride: Father Jacob Utley
Bedford D Wade married Sarah Utley 28 Jan 1823 Consent for bride: Of age, consent of father (not named)

Other Calloway Co marriages that might help place these families:

Obadiah Smelser married Nancy Owings 25 March 1823 Consent for bride: Proof of age by brot. Ephraim Owings
John Ingram married Mary Owens 13 Nov 1823 Consent for bride: Proof of age

Sarah Utley was the daughter of Merrill Utley - named in the list of Merrill's children by Utley research as Sally Utley b 1806. (John Grubbs believes her DOB was more likely 1805.) Since Merrill Utley and Jacob Utley were brothers, Phebe Utley and Sarah/Sally Utley were first cousins. Again we see the name Phoebe in another grandchild of Jacob Utley Sr and wife Phoebe.

In addition to the Calloway Co marriages, we have these Logan Co marriages that have not been placed:

William Wood married Macy Woodward, June 2, 1810, Logan County, Kentucky
Jeremiah Woodward married Mary Manksfield, August 24, 1818, Logan County, Kentucky

Macy Woodward was certainly born too early to have been James Woodward's daughter. Richard Woodward's will did not mention a son Jeremiah or a daughter Macy, although Richard did have a daughter named Mary "Polly" who has not been traced in later records. These two Woodwards could also be totally unrelated to Richard Woodward and James Woodward. A Jeremiah Woodard was listed on the 1820 census in Robertson Co, TN.

1830 Census – Calloway Co., Ky
James Ingram – 2 males under 5 – 1 male five to 10 – 1 male 30 to 40 – 1 female 15 to 20 – 1 female 20 to 30

1840 Census – Calloway Co., Ky
(the only Ingram in Calloway Co – near Ephraim Owens)
James Ingram – 1 male under 5 – 1 male 5 to 10 – 1 male 10 to 15 – 1 male 15 to 20 – 1 male 40 to 50 – 1 female under 5 – 1 female 5 to 10 – 1 female 30 to 40

According to these censuses, Phoebe Woodward was born 1800-1810. We know that James Woodward's first child, a daughter, was born in 1800. His other children must have been born after 1800. In 1810, James's household included 1F age 10-15 and 2F under age 10. In 1820, James's household included 3F 16-25. Phoebe Woodward Ingram b 1800-1810 (from 1830, 1840 censuses), Lucinda Woodward Owings b ca 1802 (from tombstone although her censuses indicate she might have been born earlier), and Nancy Woodward Grubbs b ca 1803 (from 1850 census) would all work with these censuses.

Thomas Grubbs, James Ingram, and Ephraim Owings can be found on a map of original landhold grantees in Township 3, Range 4 East of the Jackson Purchase - this area identified as "North Central Calloway County, including the Wadesboro area". Their grants adjoined each other. There is no date provided with the description of this map. But the Jackson Purchase land was added to the state in 1818 when it was purchased from the Chickasaw Indians by Andrew Jackson, so any grants were certainly made after that date.

James Ingram held land in in the SE quadrant of section 9, Ephraim Owings' land was adjoining to the west in the SW quarter of section 9. Wades Creek began in Ephraim Owings' land and flowed eastward through James Ingram's land. Thomas H Grubbs' land was in the NE quarter of section 17 which adjoined the SW corner of Ephraim Owings' land. James Ingram held additional land farther south in the NW quarter of section 33.

No Woodwards or Utleys appear on this map. But the Owings, Grubbs, and Ingram land was located just south of the present Marshall Co line. Merrill Utley's land was located just north of that in what was then Calloway Co but now is southern Marshall Co.

James Ingram and Phoebe Woodward moved to Monroe Co, AR where James died in 1847. Phoebe died after 1870. According to Wanda Ridge, a descendant of this family, their children were:

We have the following undated grant records for Merrill Utley. The land involved came from the Jackson Purchase - which was purchased by Andrew Jackson in 1818. Therefore, the dates of the grants had to be after 1818.

A map of this land shows Section 30 to be West of Jonathan's Creek just South of Olive PO. From the Loughridge map, it can be seen that these two tracts adjoined each other with this tract lying to the East of the previous tract.

A Gabriel Utley was granted land nearby. Merrill Utley had a son named Gabriel Utley b 1809. He also had a brother named Gabriel Utley. We need the exact date of this grant to determine which Gabriel this was.

No grants to James Woodward have been found, but we know he must have lived nearby. The 1830 Calloway Co census is the last record we have found for him.
