Testimony of James Partch
State of Iowa
Clayton County
I James Partch on Oath do depose and swear that I am age 80 years that I am a resident of Elkader Clayton County Iowa and have been for 49 years-- and my Post Office is Elkader Iowa.
I further state that I became acquainted with Daniel M. Fay late of Co. "I" 27 Reg I Ia Inft. who was the husband of Amanda C. Fay who is now an applicant for pension No. 642,271 when said Daniel M. Fay was a small boy, he was my nephew a son of my sister and knew him from a boy personally up to the time of his marriage to said Amanda C. Fay and I know that Daniel M. Fay had never been married until he was married to said Amanda C. Fay-- We all lived in the same neighborhood about 3 miles apart. I lived in Pennsylvania and Fay in Ohio. I moved to Iowa in 1848 in the spring and Daniel M Fay and Amanda C. Fay got married in September 1848 and were [=was?] so informed by my brother living in Pennsylvania besides Daniel M Fay and Amanda C. Fay informed me before I left Pennsylvania that they were going to get married. In the year 1850 Daniel M. Fay and his wife Amanda C. Fay came to Iowa to my house and settled in this County of Clayton Iowa and lived in this County of Clayton up to the time he enlisted in the Army. After his discharge from the Army he came back to this county and lived with his family. I am confident that he was married to said Amanda C. Fay and that she was his lawful and legal wife and so regarded and recognized by everybody. That said Daniel M. Fay lived with this Amanda C Fay his wife until about 1870. That he left his wife and that he never came back. I do not know where he went to. I do not know that he is living. I heard that he died some 8 years ago or more, but didn't learn where he died. I know that Amanda C. Fay was never divorced from said Daniel M. Fay. That no divorce has ever been granted to either party for I should have known it or heard of it; had either party applied for or obtained a divorce. I am certain that no divorce has ever been had by either party for my relations to them and our associations were such and our connections were such that it would have been impossible for either party to have got a divorce without its coming to my knowledge.
I know that Amanda C. Fay has no property of any kind; and no income or resorse [sic] whatever--that she has no means of support so far and I know that I have no intereest direct or indirect in the claim made by her for pention, that my P.O. is Elkader, Iowa.
