Will of Daniel Mann, Recorded 23 October 1828, Amelia Co., Virginia, Will Book 11, pp. 298-300
- In the name of God amen I Daniel Mann of the county of
Amelia State of Virginia being of sound mind and memory do make and ordain this
my last will and testament revoking all others before by me made. My will is
that my just debt be paid.
- Item 1st. I give to my son George T. Mann the following
negroes to wit: Peter and Philles together with all the rest of the property
heretofore given him to him and his heirs forever, and that he come in for no
other part of my Estate after my death.
- Item 2nd. I give to my daughter Martha O. Rowlett the
following negroes to wit: Judith Fanny and Dinah with their further increase
together with all the rest of the property heretofore given her to her and her
heirs forever and that she come in for no other part of my Estate after my
death.
- Item 3rd I lend to my daughter Mary A. Southall the
following negroes to wit Milley Nancy and Hartwell together with all the rest
of the property heretofore lent her and at her death I give it to my grandson
Henry D. Southall to him and his heirs forever and that she come in for no
other part of my Estate after my death.
- Item 4th I give to my daughter Elizabeth C. Allen two
negroes Hanner and Salley with their increase together with all the rest of the
property heretofore given her to her and her heirs forever, and that she come
in for no other part of my Estate after my death.
- Item 5th I give to my daughter Lucy A Green my mill and
mill seat on Winterpomoke Creeke known by the name of Woodward’s Mill and fifty
acres of land attached thereto whereon the dwelling house sets to her and her
heirs forever. I lend to my daughter Lucy A Green my miller Lewis and all the
rest of the property heretofore lent her during her natural life and at her
death I give it to the lawfull heirs of her body forever and that she come in
for no other part of my Estate after my death.
- Item 6th I lend to my wife Phebe Mann all the rest of my
Estate both real and personal to be kept together to raise and school my
children until my son Robert W. Mann becomes of age and then I give to him all
my land being on the West Side of the road bounded by William
[p.299] Worsham land and then Containing by Estimation two hundred
and twenty acres be the same more or less and two negroes Lucky and Tina and
their increase One hundred dollars or a horse saddle and bridle of that value,
one cow and calf, one feather bed and furniture to him and his heirs forever.
- Item 7th the balance of my Estate to be kept together as
heretofore - I give to my next Oldest daughter Judith N. Mann when she becomes
of age or marries two negroes such as my Executors hereafter named may think
can be best spared out of my Estate and their increase, One cow and calf, one
feather bed and furniture to her and her heirs forever.
- Item 8th the balance of my Estate to be kept together as
before I give to my next oldest daughter Rebecca L. Mann when she become of age
or marries two negroes to be selected by my Executor as before One feather bed
and furniture, one cow and calf to her and her heirs forever.
- Item 9th The balance of my Estate to be kept together as
before -- I give to my next oldest daughter Catherine J. Mann when she becomes
of age or marries two negroes to be selected as before one feather bed and
furniture one cow and calf to her and her heirs forever.
- Item 10th the balance of my Estate to be kept together as
before -- I give to my next oldest Son Alfred W. T. Mann all my lands lying on
the east side of the road being the old tract whereon I now live bounded by the
lands of Abraham Powel, Joel Mann and other and two negroes to be Selected by
my Executors as before, One feather bed and furniture, One cow and calf, One
hundred dollars or a horse saddle and bridle of that value, one desk and the
crop of corn and fodder which may be on the plantation at such time as he may
come in possession of it when he becomes of age to him and his heirs forever.
- Item 11th my will is at the death of my wife Phebe Mann
that all the remainder of my Estate not wild away be equally divided between
five of my children to wit: Robert W. Mann, Judith A. Mann, Rebeker L. Mann,
Catherine J. Mann, Alfred W. T. Mann, to them and their heirs forever.
- Item 12th my will is that my five children to wit: George
T. Mann, Martha O. Rowlett, Mary A. Southall, Elizabeth C. Allen and Lucy A.
Green come in for no other part of my Estate after my death.
- Lastly I appoint David Mann, James Chappel and Robert W.
Mann Executors to this my last will and

The last will and testament of Daniel Mann dec’d was
exhibited into Court and proven by the oaths of two witnesses thereto
subscribed and ordered to be recorded and David Mann and Robert W. Mann
appeared in Court and refused to qualify as Executors to said will and James
Chappell by a note addressed to the court also refused to qualify as an
Executor to said Will which was proved by the witness thereto subscribed. Phebe
Mann widow of Daniel Mann dec’d by a note addressed to the court refused to
take upon herself the administration of the Estate of said Daniel Mann, which
was proved by the oath of one witness thereto subscribed and Ordered to be recorded.

| And on the motion of George Rowlett who made oath and
together with David Mann, Matthew Allen and Robert W. Mann his securities
entered into and acknowledged a bond in the penalty of $20,000 conditioned
according to law Certificate is granted the said Rowlett for obtaining letters
of administration on the Estate of Daniel Mann dec’d with the will annexed in
due form.

| This may certify the court of Amelia County (after understanding that neither of the persons named as Exors in my Dec’d husband Daniel Mann's will intend to act in that capacity) that I decline the right and
privilege of administering and wish the Estate to be given up into the hands of
my son-in-law George Rowlett to administer
