John Dunlap Estate by Executors - 1807

To all persons to whom these present shall come we William Herbert and Samuel Craig of the Town and County of Alexandria in the District of Columbia acting Executors of the last will and Testament of John Dunlap late of the said Town County & District deceased send Greeting - Whereas the said John Dunlap did in & by his said last will and Testament make Sundry devises and bequests and to the same did besides us the above named Executors appoint Robert T. Hove another Executor who previous to the probate of the said Will renounced his Executorship which appear by the Documents certified from the orphans Court of the County aforesaid with a copy of the said Will And whereas there were many debts due and owing to the said John Dunlap & to considerable amount in different parts of the United States - Now know ye that we the said William Herbert and Samuel Craig for divers good causes & considerations us hereunto moving have made ordained authorized constituted and appointed and by these present do make ordain authorize constitute and appoint Samuel Dunlap one of the Brothers and heirs of the said John Dunlap our true and lawful attorney for us and in our names as Executors of the Said John Dunlap or otherwise as he may be advised to ask demand Sue for recover & receive of and from any person or person whatsoever within the United States of America all and every Sum & Sums of money which were due and owing to the said Deceased at the time of his Death, and hath grown due since or may grow due whether the same be by bond bill judgment note of hand, open Account bargain Sale contract agreement or otherwise, and to have use and take all lawful ways & means in our names or otherwise as aforesaid for the recovery thereof by Attachment arrest distress or otherwise and to prosecute the same to the fullest effect by judgment and execution or otherwise an to compound and agree for the same and an acquittance & acquittances and other sufficient discharges in our names or otherwise as aforesaid to make seal & deliver and to do all the lawful acts whatsoever concerning the premises as fully in every respect as we ourselves or either of us could do were we present at the time of so doing - And an attorney or Attorneys for the purposes aforesaid or any of them to make and substitute and again at his pleasure revoke ratifying and confirming and these present allowing whatsoever our said attorney shall in our names or otherwise as aforesaid lawfully do in and about the premises by virtue of these present or cause to be done.

Deed - 1809. James Dunlap to Executor of John Dunlap

This Indenture Made this seventh day of April 1809. James Dunlap of Wateree, South Carolina to William Herbert Executor of John Dunlap. John Sevier & George W. Sevier by indenture of 28 April 1807 conveyed to said James Dunlap hereinafter described premises in part payment of a debt due from said John Sevier to Estate of John Dunlap deceased, whereas it is the intention of the said James Dunlap to reconvey the same to William Herbert Executor of said John Dunlap who as such is entitled thereto. Said James Dunlap for $5.00 to said William Herbert Executor of John Dunlap two acres more or less lying in Town of Knoxville, Knox Co., being four Town Lots in said Town, numbers fifty four, fifty three, sixty and fifty nine and bounded as follows. Beginning at a Stake corner to number fifty-three, thence South Sixty West nineteen poles & eighty four one hundred parts to a stake corner to number sixty three North thirty West seventeen poles and eighty four one hundred parts to a stake corner to number fifty nine thence north Sixty East nineteen poles and eighty four one hundred parts corner to number fifty four thence south thirty east seventeen poles and eighty four one hundred parts to the beginning with all appurts. etc.

Commonwealth of Virginia to wit: I William Moss Clerk of the County Court of Fairfax in the Commonwealth aforesaid do hereby certify that at a court held for the said county the 17th day of April 1809 this Deed from James Dunlap to William Herbert Executor of John Dunlap deceased was proved to be the Act and Deed of the said James Dunlap by the oaths of William Herbert Jr. A witness hereto and ordered to be Certified and at a court continued and held for the said county he 18th day of April 1809 the same was further proved by the oath of Noblet Herbert another witness hereto & ordered to be certified to the proper court or office of record in the State of Tennessee In testimony whereof I have hereunto set my hand and affixed the seal of the said county this nineteenth day of April 1809 and in the thirty third year of the Commonwealth.
