Notes
General:
[James Richard Daniel] was born in Dec 1837 in Baldwin County, Georgia331 and died in 1914 in Worth County, Georgia at age 77. Another name for James was James H. DANIEL.

General Notes: James R. DANIELL, born 1842, is the son of Jesse and Mary A. DANIELL of Baldwin County, Georgia, named in the 1850 census, "James H. 12 M W GA". He is named in the 1870 census as James DANIELL, but is also found as DANIEL. Censuses indicate he was born between 1838 and 1842, the 1900 census says born Dec 1837. He is the second son to be named James R. (Robert?), seemingly named after Jesse and Mary's first child, born and died in 1817.

The Widow's Pension Application by "S. F. DANIEL", dated 8/12/1916, shows James R. DANIEL as her husband, documents their marriage on 4 Oct 1863, clearly shows she is Frances PUGH and that she was deserted by James, leaving her with three small children. She indicates that James died in 1914 in Worth County, Georgia, and also documents James' 1861 enlistment in the Confederate Army in Company A, Phillip's Legion, Cavalry, Milledgeville, Georgia. Testified to by John W. ROBERTS who served in the same unit with James until its surrender at Appomattox Court House. A biography by Angie Collier, August 13, 2003: James DANIEL (1842-????)
James DANIEL was born in 1842 to Jessie and Mary A. Daniel. They lived in Baldwin County, Georgia. James first married Fannie PUGH and had three children. The children included: Jessie born in 1867, Charlie Newton born Jan. 1, 1869, and Hattie born in 1873.

Oral history is that the first wife of James was wealthy and her family did not like James because he was not well off. After having 3 children with Fannie, James went out to cut wood and kept walking never to return (this would be either 1873 or 1874). On the 1880 census Fannie is alone with the 3 children and listed as widowed, however, James did have another wife and more children.

James moved to Alabama and married again. He had three more children including Johnnie Benjamin born July 23, 1882, Stella who later married George Adam BISHOP and Etta who later married a CULPEPPER.

According to Julia BISHOP, James told people that Charlie Newton was his nephew but on his death bed he admitted that Charlie Newton was a son from his first marriage. It is believed James died in South Georgia, possibly Moultrie, Colquitt County, Georgia. Fernando POSEY, 22, is James' nephew, the son of his sister, Louisa DANIELL, and HENRY W. POSEY. Mary N. DANIELL, age 16, born abt 1854, may be Mary M. DANIELL, daughter of William H., another son of Jesse and Mary A. DANIELL. Family associations certainly indicate it. If so, Mary is a niece to James and first cousin to Henry A. POSEY.

James' second wife was Julia Lilly PONDER, confirmed by information on the 1918 death certificate of their son, Johnny Benjamin DANIEL who died in 807

James married Sarah Frances PUGH 807,808 on 4 Oct 1863 in Baldwin County, Georgia, daughter of Thomas PUGH and Martha A. Sarah was born on 22 Oct 1845 in Baldwin County, Georgia,243 died on 3 Jun 1931 in Baldwin County, Georgia243 at age 85, and was buried in Memory Hill Cemetery.

Marriage Notes: Baldwin County, Georgia Marriage license Number 973, dated 2 October 1863 with marriage date of 4 October 1863 certifying James DANIEL and Frances PUGH. This is a certified copy of the original attested to by W. H. STEINBRIDGE, Ordinary, as recorded on page 208 of Book C, Marriage Licenses. John W. ROBERTS, in witnessing Frances' widow's pension application, stated he was present at the wedding. General Notes: Sarah Frances PUGH was born 22 Oct 1845 in Baldwin County, Georgia, daughter of Thomas and Martha A. PUGH. She was called "Fanny".

Fanny PUGH married James R. DANIELL, son of Jesse and Mary A. DANIELL, a neighbor several farms away in the 1860 census.

James was not accepted as an equal by the PUGH family, mostly to do with his not being as prosperous as they were. James deserted Fannie and his children before 1880 when Fannie was head of household in the census. She and her children lived next door to her parents, Thomas PUGH, 70, wife Martha 66, and their God Son, Thomas PUGH, Jr., 20, all born GA.

After 1900 and before the 1910 census, Fanny Daniel moved into the household of Linton S. HITCHCOCK and his wife, her daughter, Jessie, in Hancock County, Georgia. She lived with them through the 1920 census and may have lived out here life in Jessie's home.

Fanny died 3 June 1931 and is buried in Memory Hill Cemetery, Baldwin County, Georgia, just across the river from Hancock County. "FANNY PUGH DANIEL Oct 22, 1845 Jun 3, 1931", West side, Section B, Lot 39, Person 3. (Indexed at: http://www.friendsofcems.org/MemoryHill/Search.htm)

On June 8, 1931, Joseph A, MOORE, Funeral Director, submitted a bill for $250.00 for the expenses of burying S. F. DANIEL, deceased pensioner "who died without owning sufficient property to pay this bill." The bill was notorized by Samuel L. TERRY of Baldwin County. Mr MOORE acknowleged payment on August 28, 1931. (Electronic image of this bill at: http://content.sos.state.ga.us/cdm4/item_viewer.php?CISOROOT=/pension&CISO PTR=10666&REC=15)

Notes
General:
was born circa 1778 and died before 1797.

General Notes: SPECULATION: James DANIELL and Nancy HARDWICK had a daughter Betty.

Betty DANIELL is named in the 1797 Last Will & Testament of James DANIELL of Hancock County, Georgia in a bequeath to "my grandson Jesse Daniell AUSTON, son of Betty AUSTON." Betty is not named in transcriptions of James' Bible, but there are no Bible entries after 1765. Her mother and her date of birth are not known. No other record concerning Betty or her AUSTON husband has been found.

Betty and her husband are thought to have died before 1797 because James did not make a bequeath to either in his Will, and, after 1800, Jesse AUSTON is supported by payments from the estate of his uncle Levi DANIELL.

In 1807 in Hancock County, Georgia Jesse, age 13, legally changed his name from AUSTON to Jesse DANIELL.

DISCUSSION: ASSIGNMENTS AND RATIONALE, 10 Dec 2005:

There are several possibilities for who Betty Daniell AUSTON was. Two are: (1) She may be an unrecorded daughter, Elizabeth?, possibly issue of James' second wife, Nancy HARDWICK, married between 1779 and 1787; (2) She may be Martha Elizabeth, ergo "Betty", since Martha is named in James' Bible and no additional information about her has been found. As of 10 Dec 2005, this compiler has chosen to assign Betty as the first possibility. IF this is correct, her birth would be after 1775.

Changes in the assignment of Betty AUSTON now separately listed as a possible daughter of James DANIELL and his second wife, Nancy HARDWICK, and her family were made after considering the below.

(1) Martha Elizabeth DANIELL - There is no proof that Martha DANIELL was "Martha Elizabeth", the middle name Elizabeth is deleted. Other than speculation, there is no way to support the assignment of "Betty AUSTON" as Martha Elizabeth. In reconsidering "Martha Elizabeth", I believe it necessary for both Martha and Betty to be individually named in the family file by other than a previous comment in Martha's General Notes.

(2) Betty Daniell AUSTON - Because Betty is not named in James' Bible, she may be a daughter by Nancy HARDWICK, James' second wife, and is so assigned as of this date.

(3) James Daniell and Caty Daniell AUSTIN/AUSTON are no longer assigned as children of Betty AUSTON for three reasons: "James Daniell AUSTIN" was born before James DANIELL wrote his will and was not mentioned as a grandson; the names and birth dates of James and Caty match the names and birth dates of Levi DANIELL's two oldest children, James Levi and Catherine B., highly unlikely; lastly, Jesse is the only child with the AUSTIN surname in one transcript of Levi's Bible. The AUSTIN surname may have been inadvertantly brought down in others as the surname for Levi DANIELL's children; ergo, there were no children named James Daniell AUSTIN and Caty Daniell AUSTIN.

(4) Unknown AUSTON - No evidence proves that Martha married AUSTON. He is now assigned as husband of Betty DANIELL and father of "my grandson Jesse Daniell AUSTON, son of Betty AUSTON."

Betty married AUSTON/AUSTIN 25 before 1794. AUSTON/AUSTIN was born circa 1770 and died before 1797.

General Notes: An Unknown AUSTON or AUSTIN is the husband of the "Betty AUSTON" named in James DANIELL's Bible as mother of "my grandson Jesse Daniell AUSTON". No other information on Betty or her husband has yet been found. They are thought to have died before May 1797 when Betty's father wrote his LW&T. Unlike James' other children or their spouses, neither received a bequeath, only their son, Jesse. Jesse, born 9 September 1794, is named as an AUSTIN per his Uncle Levi's Bible and in the 1807 record of his official name change to Jesse DANIELL. In Levi's estate records, Jesse is once named as OSTEN. The 1850 census shows Jesse was born in Georgia.

There are no AUSTON families indexed in South Carolina in the 1790 or 1800 censuses.

Notes
General:
Jesse Daniell was born on 9 Sep 1794 in Georgia17, 90 and died on 22 May 1860 in Milledgeville, Baldwin County, Georgia90 at age 65. Other names for Jesse were Jesse Daniell AUSTIN,17 Jesse Daniell AUSTON, and25 Jesse DANIEL.319

General Notes: Jesse DANIELL, born Jesse Daniell AUSTON (or AUSTIN) on 9 September 1794 in Georgia, is named as "my grandson Jesse Daniell AUSTON, son of Betty AUSTON" in the 1797 LW&T of his grandfather, James DANIELL. No other record concerning Jesse's parents has been found. His birth, 9 September 1794, was recorded in the Bible of his Uncle Levi DANIELL where he is named as Jesse Daniell AUSTIN. At age 13, on 27 November 1807, Jesse legally changed his surname to DANIELL. The Georgia Black Book", Rev. Silas Emmett Lucas, Jr. (1807 entry) records, "Jesse Daniell AUSTIN changes name to Jesse DANIELL No father named 11-27-1807".

Jesse was most likely orphaned before 1797. His parents were not given a bequeath in his grandfather's LW&T. In 1801 his Uncle Levi's estate is paying for his schooling. He was raised in the home of his Aunt Martha, Levi's widow, and her second husband, John DANIEL from Edgefield County, South Carolina, a cousin of Levi and Jesse. John and Martha's home in Hancock County, Georgia included Levi's three young children, James, Catherine, and Juliet DANIELL, as well as another eight children from Martha's marriage to John. Records reflect a particular effort to maintain Levi's children's DANIELL surname while John's family line used the DANIEL spelling of the surname. Jesse likely chose the double L spelling in lieu of the single L to reflect his direct family line. There is no record of Jesse having been adopted by John and Martha DANIEL.

In his grandfather's will, Jesse was given "when he comes of age, the land lying on the Oconey that I lent to my son Levi DANIELL. I also give him one half of the negroes I have Lent my wife after the death of my wife Nancy DANIELL." (The land is described in the Will as "one half of the tract of land I now live on the whole of which contains three bounties. Also I lend him [Levi] the use of half of a tract of land lying on the Ocony River in Washington County during the time of eighteen years - - -") A provision of the Will would revert Jesse's estate to his cousin, Patsy HENDRICK, if Jesse died without a lawful heir of his body. [James' widow, Nancy Hardwick DANIELL, remarried to James BARROW in 1802 and died 18 January 1814 in Baldwin County, Georgia.]

Levi died in Dec 1800, the lands were administered for Jesse by Levi's estate. Nancy died in 1814. On 12 March 1814, James BARROW filed "a schedule of all the Negroes with their increase now in life (except one Negro man, Sanco, sold by James BARROW) that were lent by the last Will and Testament of James DANIELL dec'd. to his widow and relict Nancy DANIEL, afterwards Nancy BARROW, wife of James BARROW, during her natural life: Old Tom, Zouer(?), Old Rachel, Charlotte, Hester, Flander, Acre, Daphney, George, Moriah, Hictor, Biner, Dover, Caty, Peter, Pompy, Peggy, Ned, Ellinney, Billy, Moriah, Levin, Becky, Bob, Rachel, Hector, Sam, Sally, Sucky, Driver, Jupiter, Bob, Ellick, Pompy, Flander." The schedule, recorded in Hancock County, was witnessed by Jacob COBB and Garland HARDWICK.

In Levi DANIEL's estate records, an 1802 entry shows payment to Lewis PARKER for boarding and schooling of Jesse OSTEN (sic) for 1801 and 1802.
Hancock County, Georgia Will Book E, page 151, Abstracts from the Account of cash paid for the estate of Levi DANIELL, John HERBERT, one of the executors of the said estate, lists:

31 Dec 1804 - to John DANIELL for clothing, lodging of Jesse D. AUSTON for the year 1802, 1803, 1804 @ 12/year 36.00
31 Dec 1804 - same for goods taken up in Aug. for said estate 91.23
30 Dec 1807 - same for articles furnished Jesse D. AUSTON in 1805,1806,1807 8.62
31 Dec 1807 - same for boarding, clothing James L. DANIELL in 1805, 1806, 1807 187.00
31 Dec 1807 - same for Jesse D. AUSTON 195.00
11 May 1809 - paid John DANIELLY Ordin in favor of Nath Lee STEWART teacher, for the tuition of Jesse DANIELL, Catherine DANIELL, each 4.93 3/4 in the year 1807 19.75

The 1809 entry above reflects Jesse's surname change. His War of 1812 service record is as DANIELL, and the 1820 census so names him. Jesse's widow, Mary Ann (Tucker) DANIELL, included a Family Record, copied from a Bible, in her 1878 application for a War of 1812 widow's pension. Without variance, the names of her husband and thirteen children are clearly spelled DANIELL. These Bible records were certified to the court as correct by her brother, Judge Daniel Reese TUCKER of Baldwin County, Georgia. Still, various records for this family are found as DANIEL, including Jesse and Mary in the 1850 census of Baldwin County as well as their death records. Jesse's children are found with the DANIELL, DANIEL, and DANIELS surnames. From contacts with living descendants, none use the double L spelling today. Jesse and Mary's son, Arthur, who seems to have used the double L all his life, had no children. RLD)

Jesse first volunteered for military service at age 17 years, nine months. During the War of 1812, he enlisted as a Private, serving in Capt. Tomlinson FORT's Company, Georgia Militia from 24 June 1812 to 28 September 1812. On 16 March 1852, Jesse testified before William H. SCOTT, Justice of the Inferior Court of Baldwin County, for the purpose of obtaining the County Land to which he may be entitled under the "Act granting bounty land to certain officers and soldiers who have been engaged in the military service of the United States" of September 28th 1850. He declared that he "was a Private in the Company commanded by Captain Tomlinson FORT, in the Regiment of Georgia Militia commanded by Col. SMITH of the United States Army, in the war with the Seminole Indians; that he volunteered at Milledgeville on or about 1st day of July A. D. 1812, for the term of three months, and was honorably discharged at St. Mary's on or about the 10th day of September A. D. 1812; that he received a certificate of discharge, which has since been lost; but as will appear by the muster rolls of said Company...." In further testimony, Jesse stated that he "was a Private in the Company commanded by Captain Seaborn JONES in the Regiment of Georgia Militia commanded by Colonel WILLIAMSON, in the war with the Creek Indians; that he volunteered at Sandersville, Washington County, on or about the first day if June A. D. 1836, and continued in actual service in said war for the term of two months and was honorably discharged at Columbus on or about the 11th day of August A. D. 1836; that he received no certificate of discharge, - but as will appear on the muster rolls of said Company." These records from the National Archives include Jesse's receiving bounty land warrants #62325-40-50, 40 acres, and #39075-120-55, 120 acres; his marriage to Mary A. TUCKER on 17 January 1816; his residence in Baldwin County in 1852, and 1855; and his death on 22 May 1860.

Jesse's widow, in her War of 1812 Widow's Pension Application, 13800, dated 1878, cited an additional service period from 10 July 1814 to 10 January 1815 "in Captain HORTON's Company, of Col. Thomas' Regiment" of Georgia Militia, and described Jesse at the time of this enlistment as "of medium size complection fair, read hare (sic), blue eyes, and weighed about one hundred + thirty pounds." Mary, at age 79, signed this page with a shaky hand. Her brother, Daniel R. TUCKER, and John R. SMITH attested it. (National Archives, War of 1812, record series M313, roll #24) No record supporting this service period was found.

Too good not to share: Jesse's physical description evoked this comment from Shannon Daniel Dukes, a fourth great-granddaughter: "I had to laugh out loud at the description given of him during his enlistment as red headed and blue eyed with fair skin. We have a running joke about the "Daniel" gene in my family because all the kids come out with fair skin, reddish/blonde hair and the bluest eyes you have ever seen."

In January 1815, "William HARDWICK, Executor of the last will and testament of James DANIELL, dec'd, returned an account of Negroes which were lent by said will to Nancy DANIELL, wife of the said James, afterward Nancy BARROW during her natural life, together with their mansion which was ordered to be recorded." as recorded in the minutes of the Hancock County, Court of Ordinary. Half of these Negroes, lent to Nancy by James DANIELL, were bequeathed to his grandson, now Jesse DANIELL, nee Jesse Daniell AUSTON, and half to granddaughter "Patsy HANDRICK" upon Nancy's death.

"Patsy HANDRICK," apparently died before 17 September 1805, the date of her father's Will in which he named but one child, Louisa Maria HENDRICK, Patsy's half-sister.

Jesse DANIELL and Mary A. TUCKER were married on 17 January 1816 in Washington County, Georgia by John WILLIAMS, a Justice of the Peace. Mary, born 31 August 1799 in Richland County, South Carolina, was the daughter of John Robert TUCKER and Ann REESE, then residents of Washington County. In her Widow's Pension Application, Mary related that neither she nor Jesse had been previously married and that she and Jesse made their home in Washington County for several years before moving to Baldwin County. Also in 1816, William HARDWICK, executor of the will of James DANIELL, returned to the Hancock County Court of Ordinary an account against Jesse DANIELL, a minor and legatee of James in the amount of eighteen hundred & ninety dollars, fifty one & one half cents, along with an account of money received for Jesse amounting to fifteen hundred & ninety three dollars and eighty nine cents.

Between 1817 and 1844, Jesse and Mary had 14 children: James Robert, born 24 May 1817, died 10 Jul 1817; Joseph Levi, born 9 Jan 1819, died 12 Sep 1821; John Thomas, born 6 Jul 1820, died 21 Apr 1905; Arthur Reese, born 20 Jan 1822, died aft 1880; Robert Tucker, born 17 Dec 1823, died aft 1880; Martha Ann, born 15 May 1825, died after 1880; William Harper, 23 May 1827, died aft 1880; Richard Marion, born 19 Dec 1828, died 18 Jan 1834; Louiza Costanza, born 25 Sep 1831, died aft 1880; Annabella Elizabeth, born 15 Dec 1833; Daniel Harrison, born 30 Nov 1835, died 20 Sep 1840; Mackerness Goode, born circa 1840, died 27 Aug 1842; James R., born abt 1842, died 1914; and Augustus S., born abt 1844, died 17 Apr 1865. Mary named 13 of her 14 children in her 1878 widow's pension application, providing dates of birth and death on most. James R., her fourteenth, is known from the 1850 census.

On Dec. 10, 1807 , the Georgia legislature divided Baldwin County into four new counties -- Morgan, Jones, Putnam, and Randolph (renamed Jasper). In the same act, Baldwin County was given land east of the Oconee River taken from Hancock and Washington counties. The land Jesse inherited from his grandfather was on the Oconee in that part of Washington that was given to Baldwin.

The 1818 Tax Digest Buchanans District (115th) included Jesse DANIEL - 180 - - 195 Baldwin - Goode Oconee - and Jesse DANIEL - - - - 100 Baldwin Tennel Goode Oconee -, showing Jesse, now 21, and Mary were in Baldwin County before 1818 and in possession of his land.

The 1820 U.S. Census, Georgia, Baldwin County, No Twp Listed, 29 December 1820; Series: M33 Roll: 6 Page: 31, shows Jesse DANIELL, 16-26, with 2 sons under 10, a wife between 16-26, and 29 slaves. The two sons noted were Joseph Levi, and John Thomas. Names of interest around Jesse in 1820 are: Joseph TUCKER, 16-26, his next door neighbor and brother-in-law; John L. THOMAS and David THOMAS, both 26-45, two households from Jesse; James BOYKIN, 26-45, and Jesse PROSSER, 26-45, are nearby. Jesse's son Arthur R. married Caroline R. PORTER, according to a family Bible, her name is sometimes found as PROTHER or PROSSER. The BOYKIN family was associated with the DANIELL cousins in South Carolina.

Milledgeville Newspaper Clippings Vol 11 records Jesse DANIEL Washington County Georgia involved in five Sheriff's Sales:

Another, Milledgeville Newspaper Clippings Vol 111 Baldwin Co 1833-35 page 209 shows Mary A. DANIEL Sheriff's sale. (Mary Morris)

Jesse has not been found in the 1830 census, but from available records, his family should be listed as males "2 2 1 0 0 1" and females as "0 1 0 0 0 1". Their six children here being Richard Marion, 2, William Harper, 3, Robert Tucker, 6, Arthur Reese, 8, John Thomas, 10, and Martha Ann, 5.

This record from 1832 is NOT PROVEN to be our Jesse DANIELL: 1832 Cherokee County Georgia Land Lottery, 16th District 2nd Section, Cherokee, Released 05 December 2002: 100 Jesse DANIEL, s. 1. w., 600th, Richmond. He may be the Jesse DANIEL who was killed in Baldwin County, on 25 December 1854. There is a marriage record of a Jesse DANIEL to Rebecca TINSLEY in 1813, Richmond County, Georgia. This was once thought to be a possible first marriage for our Jesse DANIELL, dispelled by Mary's statement that neither she nor Jesse had been previously married.

The 1840 U.S. Census, Georgia, Washington County, 98th District; Series: M704 Roll: 53 Page 209: shows Jesse DANIEL, 40-50, who has with him 2 males under 5 (Mackerness Goode, 2, and Daniel Harrison, 4/5), 2 males 10-15 (William Harper, 13, and Robert Tucker, 14/15), 1 male 15-20 (Arthur Reese), 1 male 20-30 (John Thomas), 2 females, 5-10 (Annabella Elizabeth, 7, and Louisa Constanza, 9), 1 female, 30-40 (Mary), and 17 slaves. Not indicated though is Martha Ann, 15. Where is Martha? John R. TUCKER, Mary's brother, on the same page as Jesse, as is a William DAVIS with son 15-20, and Henry POSEY with a son, 20-30, on the next page. Jesse's daughter, Martha Ann, married William A. DAVIS, born about 1820, on 7 February 1847. His daughter, Louisa, married Henry W. POSEY, born about 1820, on 24 January 1847; their son, Henry A. POSEY, age 20, lived with her brother, Arthur DANIELL, in 1870.

Jesse DANIELL died on 22 May 1860. The 1860 Mortality Schedule Salem District, Baldwin County, GA, Page 8 lists "23. Jessee DANIEL 65 M - - Married GA May Planter Liver complaint 18 mons." Another provides: "1860 Mortality Schedule Baldwin County DARNEL JESSE 65 M MAY GA LIVER DISEASE PLANTER MRT197_77172." Both match Jesse DANIELL's date of death in his military record. In the 1860 census, 1 June 1860, Mary A. is named as Mary E. DANIEL, a fairly wealthy widow, and head of household in Salem, Baldwin County, Georgia, "Mary E. DANIEL 60 F W 10,000 27,500 SC."
