

We the undersigned, W. H. Patton and J. T. Willis, being called on by W. L. Mallard shortly before his death, which occurred July 25, as verbal witnesses of his last will and testament to be reduced to writing by us who certify that he made the following statements to us, to wit:
1st I want my wife, Catherine, to be made whole at the end of the law suit now pending against the land I sold to be paid out of our joint effects.
2nd I want Dr. G. W. Floyd to have seventy-five dollars provided he looses the land I sold him in the suit now pending to be paid out of our joint effects.
3rd I want Susan Taylor to have fifty dollars out of my individual effects.
4th I want Josephine E. Bratton to have fifty dollars to be paid out of my individual effects.
5th I want my wife, Catherine, to have the use of the fifty acre tract including all buildings on same during her life and at her death the same to be sold and one half to go to my heirs as herein after provided.
6th I want the nine acre tract of land lying near John Ramsey's and the 120 acre tract on Clear Creek to be sold. I want the eighty acres lying east of Elias Johnson's sold except ten acres on north side of North 40.
7th I want three hundred dollars paid Kirt Gray out of my effects.
8th I want Sarah J. Adams, Elizabeth Burton, Daniel L. Mallard, Alex T. Wiley, Rebeca E. Moore, Malindy E. Cripe, James W. Mallard, Henry E. Mallard, and Riley J. Mallard, Leander T. Adams to each share equally the remaining part of my estate except that Leander T. Adams to have one half as much acre of as the rest.
