THIS INDENTURE Made on the 10th day of December A.D.One Thousand Nine Hundred and One by and between James W. Fry of the county of St. Francis and State of Missouri party of the first part, and SOUTHERN MISSOURI RAILWAY COMPANY , a corporation, duly authorized under the laws of Missouri, party of the second part,

WITNESSETH, That the said party of the first part, in consideration of the sum of Ten Dollars, to him in hand paid by the said party of the second part, the receipt of which is hereby acknowledged, do by these presents, Remise, Release, and Forever Quit-claim unto the said party of the second part the following described land, lying, being and situate in the County of Ste Genevieve and State of Missouri to wit:

A strip of land: A Triangular peace of Land in the North West quarter of the South West quarter Section 8 Township 36 North Range 6 East St. Genevieve County Missouri described as follows, to wit: Beginning at the South East corner of said Northwest quarter of South West quarter, thence North 101.1 feet; thence South 58 degrees 22 minutes West 200.8 feet; thence East 170.7 feet to the beginning and containing 2/10 acres. More fully shown on plat hereto attached which is made a part of this conveyance.



TO HAVE AND TO HOLD THE SAME, with all the rights, immunities, privileges and appurtenances thereto belonging, unto the said party of the second part, for the purpose of constructing and maintaining a railroad on said land herein conveyed, forever.



PROVIDED, HOWEVER, That this DEED is made upon the express condition that the said railroad shall be commenced within 6 months and completed within 2 years from date hereof.

On this 10th Day of December A.D.1901 before to me personally appeared James W. Fry to me known to be same persons described in and who executed the foregoing instrument and acknowledged that they executed the same as their free act and deed.
