Will of Jonathan Stephen Spanswick of Eastbury Berks (1880)
This is the last Will and Testament of me Jonathan Stephen Spanswick of Eastbury in the County of Berks , Yeoman. I
give and bequeath all the personal Estate (except leasehold estates for years which are included in the devise hereinafter
contained of real estate) to which I shall be entitled at my decease unto my Wife and my sons William and Thomas in equal
share. I give and bequeath to my wife a legacy of three hundred pounds to be paid out of the monies to arise from the sale
of my real estate . I give and devide all the real estate which I shall be entitled at my decease unto my said Son William
and Edward Ormond of Wantage in the said County Gentleman their heirs executors administrators and asigns respectively
on trust to sell the same and hold the monies to arise from such sale upon trust to pay thereout my debts funeral and
testamentary expenses and the said Legacy of Three Hundred pounds hereinbefore given to my Wife and to pay and divide
the residue of such monies unto and and between my said sons William and Thomas and my Daughters Ellen the Wife of
William Ferrebee and Louisa the Wife of Jehu Thomas Kent in equal shares . But as to the share of my said daughter Ellen
I direct that my Trustees shall hold the same upon the trusts following that is to say upon trust to invest the same in the
public funds or on government or real securites in England with power to vary such investmants at their discretion for any
others of the kinds prescribed and to pay the annual income arising from such investments to my said Daughter Ellen during
her present coverture as the same shall become due and not by way of anticipation into her proper hands and for her sole
use free from the control of her Husband for which payments her receipts shall be discharges to my Trustees . And if my
said Daughter Ellen shall survive her Husband I direct that her said share and all such securites upon which the same shall
be invested shall immediately after the death of her said Husband belong to her absolutely . But if my said Daughter Ellen
should die in the lifetime of her said Husband . Then as to her share and the securites upon which the same shall be
invested In trust for all or for any such ine or more of her children or other issue (such other issue to be born in her lifetime)
and in such manner and form in every respect as my said Daughter Ellen notwithstanding her coverture shall by deed or will
appoint And in default of any such appointment and for as no such appointment shall extend In trust for the child if only one
or all of the children if more than one of my said Daughter Ellen who either before or after her decease shall attain the age of
twenty one years marry and if more than one equally But if there should be no such child of my said Daughter Ellen who
either before or after her decease shall attain the age of twenty one years or marry then In trust for my said sons William and
Thomas and my said Daughter Louisa in equal shares I devise all the real estate which at my decease my be vested in me
as Mortgagee or Trustee to my said Trustees subject to equities effecting the same respectively I appoint my said son
William and the said Edward Ormond Executors of my Will . In witness whereof I have set my hand this Twenty first day of
January One Thousand Eight Hundred and Sixty Three

This is a Codicil to the last Will and Testament of me Jonathan Stephen Spanswick which will bears the date 21st January
1863 . Whereas since the date of my said Will I have purchased a Freehold Cottage and Garden situate in Eastbury in the
County of Berks of mu Cousin Stephen Spanswick . Now it is my will and I do hereby devise such Cottage and Garden to my
Son Thomas Spanswick for the term of his life And from and after his decease I give and devise the same to my Grandson
Jonathan Stephen Spanswick the third son of the same Thomas Spanswick . To have and to hold to him and his heirs and
assigns for ever And in case my said Grandson Jonathan Stephen Spanswick should not survive his father the said Thomas
Spanswick Than I give and devise the same to Henry Spanswick the eldest son of the said Thomas Spanswick to hold to
him and his heirs and asigns for ever . And if Henry Spanswick should not live to take the said Cottage and Garden under the
last mentioned devise Then I give and devise the same to his next brother Enos William Spanswick his heirs and asigns for
ever . In all other respects I ratify and confirm my said Will and declare this to be a Codicil thereto and to be taken as part
thereof .
