General Notes: Ezekiel Desern of Surry County, North Carolina, is listed on the 1812 - 1814 Muster Rolls for the Surry County Regiment, First Company. He may have died during War of 1812.

The War of 1812 Service Records state that he served in 3rd Regiment (Johnson's) East Tennessee Militia. It also states he was inducted as a Private and was discharged as a Private.

The Index to War of 1812 Pensioners list on page 561 - Duzern, Hezekaih or Dazarne, Hezehiah, Widow Nancy Dazarne, Widow's Original 11211, served as Private in Benjamin Powell's Company, Tennessee Militia.

In official records, Ephraim was sometimes shown with the surname Moore, never as a Marion, and most often as Dezern.

His second wife, Elizabeth Shoemaker, may have been married to a Skaggs at one time. Research by Mayme Ellen Fisher Harris states that Elizabeth "Betsy" was connected to the Skaggs family. As of July 2000, this cannot be proven.

Elijah Dezarn and Matthew Skaggs appear on marriage bond to Elizabeth Shoemaker.

Elijah married Elizabeth Shoemaker on 24 February 1835 in Green County, Kentucky.37 Elizabeth was born about 1810 in Green County, Kentucky18 and died about 1866 in Green County, Kentucky29 about age 56.

General Notes: Elizabeth was reportedly related to the Skaggs family. She may have been married to a Skaggs before marrying a Shoemaker. None of this is confirmed.

There is a record of Elizabeth Shoemaker being married to Zachariah Elmore, 13 August 1816. They had 7 children, the last being born in 1834. Elizabeth apparently then married Elijah Dezarn 25 February 1835.

David T. and his father were postmasters for the post office in Dezarn, Kentucky. The town's name was actually Creal, Kentucky. The post office, in operation from 1883 to 1919, was called Dezarn for the family of its first postmaster, Elisha Dezarn.

Elisha purchased land from Willis Skaggs on 1 Febuary 1862 in Green County, Kentucky. Apparently, he had purchased the land from Willis and Ottawa's father, John Skaggs, and the court directed the transfer take place.

DeZern, Elisha Desarn left a Last Will and Testament dated 5 February 1904, which was executed at The Home for Disabled Volunteer Soldiers, near Johnson City, Tennessee. The will gave everything to his niece, Hattie Desarn, except $1.00 to sister, Rachel Darthula Hackney of Knoxville, Tennessee, and $1.00 to his sister, Betsy Ann Adney, who lived at Bank, Blount County, Tennessee.

According to a record from National Homes for Disabled Volunteer Soldiers, 1866 - 1938, Johnson City, Tennessee (image available on www.familysearch.org), Elisha died on 18 March 1906. This record also mentions Hattie Desern, who was notified by telegram on 18 March 1906 of Elisha's death, and James J. Harvey, who took Elisha's body to Knoxville for burial on 19 Mary 1906. Hattie Desern later married James J. Harvey on 23 April 1906 in Washington County, Tennessee.

Question: Who are the parents of Hattie Desarn? According to the 1900 census, Elisha's niece, Hattie was born in March 1868. Hattie is mostly the daughter of Elisha's sister, Sarah, who is recorded as an unmarried prostitute in the 1880 Knox County, Tennessee census.

According to U.S. General Land Office Records, 1796 - 1907, Elisha Desarn was awarded 80 acres homestead land at Boonville, Missouri on 16 May 1878. Boonville was located in Phelps County, Missouri. According the the Missouri State Census Collection, 1844 - 1881, Elisha was living in Phelphs County in 1876.

Elisha served as a Private, Company C, 2nd Tennessee Cavalary. He died on 18 March 1906 and was buried on 18 March 1906 in the Knoxville National Cemetery, Section B, Site 3369, Knoxville, Knox County, Tennessee.

Tradition indicates that the father was Bowling Baker, Jr., who killed Morgan DeZarn. Family tradition also indicates that Martha's daughter, Mary Dezarn, was also fathered by one of the Bakers.

He enlisted on 24 April 1847 and was honorably discharged from the U. S. Army on 5 August 1848 at Newport, Kentucky. The papers further state that John A. Ragle was born in Buncombe County, North Carolina, is 24 years of age, 5 feet, 9 inches high, fair complexion, blue eyes, chestnut hair. His age of 24 indicates he was born about 1824, which I believe is incorrect.

2. During the Civil War, John Ragle served as a Union soldier in Co. E, 7th Kentucky Infantry, having enrolled on 19 August 1861 in Clay County, Kentucky. He was honorably discharged in Louisana on 30 January 1864.

3. Various affidavit documents related to Lucy (Metcalf) Ragle's pension application said that John A. Ragle died during the winter of 1913 in Clay County, Kentucky. Another affidavit states that he died on 16 January 1913.

General Notes: At the time of his death in 1830, Morgan DeZarn (also known as William Morgan) owed a debt of $60.00. According to research by Thomas J. Dezern, Morgan DeZarn was shot and killed during an altercation with Bowling Baker, Jr. Morgan's sister, Martha "Patsy" DeZarn was living with Bowling Baker at the time. Following the shooting, Bowling Baker is said to have jumped on his horse and fled to Missouri. This story is also described in Jess Wilson's book, "When They Hanged The Fiddler."

The 1850 census records a Bolin Baker, age 32, born about 1818 in Kentucky, living in Pulaski County, Missouri as a farm laborer. By 1860, Bolin Baker, age 44, is married with two children, living in Cedar County, Missouri. In 1870, Bolin Baker, age 52, and family are living in Barton County, Missouri. Unable to find him after the 1870 census.

In addition, the Clay County, Kentucky Probate Deed Index 1830 - 1854 on page 108 lists an application for property appraisal and sale bill in the name of Mordecai Dezarn. This is most likely a reference to William Morgan aka Morgan. A similar entry is found in the Clay County, Kentucky Will Book 1 Index (Dec. 10,1830 - Mar. 8,1854).

Gen. Hugh White, when drinking, fell into a salt kettle and came near losing his life from the burn. He sent for Dr. William Reed, father of Dr. Stephen Reed. He refused to come. "Let him die and go to hell," said he. He had refused him his daughter, Susan, in marriage. Old Alex White, himself a great drinker, a brother-in-law of Dr. Reed (married sisters Brauners), persuaded him to go. After he had dressed the burn, General White handed him $100, expecting him to give him change. He held out his hand, "Another," said Reed. "No, by the heavens, do you mean to break me up?" said Reed, and he did so.

When Garrard was perhaps 75 years old, he went to Beattyville and proposed marriage to Priscilla McGuire, a daughter of James McGuire, sister of John G. McGuire's wife, and half-sister of Mrs. Harvey Lucas, deponent. She was an old maid, 50 years old. She declined his offer. General White was a noble specimen of manhood, one of the handsomest of men. He could primp his mouth and give to his face a peculiar charm. He was a heavy drinker, but quit later in life.

General Garrard was in the Legislature when his sister married James White, son of General Hugh White. So bitter was the feelings between the families that he wrote to her that he would soon see her go to her grave.

Old Alex White drank heavily. He was the father of Mrs. Captain Byron. Mrs. James White is still living. She lives in Richmond, Kentucky. She visits Clay every summer. I was overseer for several of the Whites. I have known them well. They were great money makers. I worked for James and Dougherty White.

My step-father, Pearce Cottongin, used to steer salt boats. I never did. My grandfather, Richard Lucas, was a man of great physical power. He was a drummer in the militia. A man named Butts, from Tennessee, rode 400 miles to whip him. He rode up to grandfather's saddler shop and called, "Does drummer Lucas live here?" "Yes, sir," said my grandfather. "Well, I live in Tennessee, 400 miles from here, and have come to whip you." "What have I done to you?" said Grandfather. "Oh, nothing, I am the bully of Tennessee, and I understand you are the bully of Kentucky; and if I whip you I will be the bully of the world." "Well, get down and go in. I keep a hotel, and you can stay with me. It won't cost you nothing," said Grandfather. "No, I won't whip a man and live off him too." "Well, it may not turn out that way," said Grandfather. Mr. Butt went to another hotel. The next morning, they fought after the manner of the times, and Grandfather was victorious. The Tennesseean seemed perfectly satisfied, and he returned to his home. My grandfather, afterwards, joined the Methodist Church. He was hospitable and big- hearted.

My maternal grandfather was John Cundiff. My father died when I was six years old. It was about 1821. Grandfather Cundiff was a loyal friend. He would do anything in his power for a friend. He was a great power in elections. My uncle, John Cundiff, killed Eli Bowling. Bowling was a bully, a man of great power. He led my uncle to old Bill Dincel's house, where old Millie Henson lived. They had a quarrel about the woman. Bowling kicked my uncle, a small man. He went away and came back with a dirk knife, called Bowling to the door, and plunged it into him. He died in a few minutes. My uncle left the country and never returned. Uncle Sam Lucas took his wife to him. Eli Bowling was a bad man. His son, James Bowling, was hunting for my uncle, John, when he met my grandfather Cundiff. "Jim, put that gun down. We have gotten rid of two bad men and let the matter stop." He did so. The Cundiffs of Breathitt County are the same stock.

Old George Stivers, a Methodist preacher, taught school. I went to school to him. He was a man of much prayer. He held family prayers, night and morning; also, at school. He said he did not sin. At family prayers, his son, Simeon, put a pin in the toe of his sock, and while I was kneeling at family prayer, he stuck it into my body. This made me jump, and I struck Bro. Stivers. After prayers, the father said, "I will pay you for that, Simmie," and he did give him a severe thrashing. This was in Manchester in 1847. I was 29 years old. I went to school to Milton Pigg, a crippled man. Marshon was a teacher in the county also.

Eli Bowling was a great rogue. I have heard him tell of stealing his neighbor's horse, put him in a cave, fattened him, cut off his tail, trimmed his ears, and led him to his neighbor's door a few months afterwards; and the owner did not recognize the horse. He would laugh when he told me. He told it at a horse race at the old tanyard, which was above town. He also said he bet a fellow $5 that he could steal his blanket as they were camping on a hunt, and he got it.

Rev. David Weaver, of Laurel, had family prayers (Mrs. Burchell told me last Sunday night that Mr. Carnahan was the only man in Clay County that holds family prayers, as far as they knew). George O. Barnes told the people, when at Booneville, where I heard him preach, to come drunk or sober; it would be all the same, if they only confessed.

Rev. A. D. Collins, who lives on Laurel in Clay County now, lived then in Owsley. He wanted to turn his members out, who shook hands or joined Barnes. He is a Missionary Baptist. I left the church and joined the reformers.

Rev. George Stivers had a large family of sons, who were the most reckless men ever reared in the county. Sam Stivers wanted to kill Gen. Garrard. In order to get a chance at him, he stabbed a man named Fritz (perhaps Fitzgerald), thinking that Garrard would come to Fritz's defense, and then he could kill him. Fritz died, and Stivers left the country and never returned. Gen. Garrard was a man of great physical strength, a very brave man, and men feared him. He rarely, if ever, had a fight. He was peaceable himself.

George Stivers, Jr., who lives near town with his nephew, James Stivers, was seen in his office in the courthouse, naked and with a woman. The grand jury saw him, but did not indict him. James Stivers' lawyer, who now lives near this place, killed his men at Irvine.

Dr. Baker was hung here for killing Daniel Bates. After his conviction, the jail was strongly guarded to prevent his friends from rescuing him. Fortifications were built around the jail, and a guard of 150 men from Madison County, and 150 from Clay were kept on duty. The friends of Baker let drop remarks about a cannon that was coming for their use, in order to intimidate the guard. One night, some bodies built fires, like a camp, and a demonstration, which caused a stampede among the Clay County militia. They threw away their guns and ran like scared dogs. The next morning all that had run were discharged. It was a ruse of Baker's friends. I was one of the guards. John Cole was jailer. A party was organized to rescue Baker, but never made the attempt. Baker was crazy. He was jealous of his wife, who was as pure as the mother of Jesus. It was his jealously that caused him to kill Bates.

A man named Bledsoe feared my uncle, John Lucas. My uncle was inside of a circus tent, and Bledsoe stabbed him through the cloth, cutting him in the back and about the bowels. He lived ten years, but was never himself again. Bledsoe fled the country.

Uncle William was a tanner. The rebels took him prisoner at Wild Cat Mountain. He said there was terrible screaming among the rebels. Col. Garrard, the general's father, was a Southern sympathizer. He told the general's wife that the rebels would be whipped at Wild Cat. When brother John went to California, I loaned him $300 and paid $100 debt for him. Gen. Garrard and John went off together. John paid me.

Barton Potter was a merchant in Manchester, as far back as I can remember. He was a drinking man, never too drunk to attend to business; a clever man. He made money, and he left a large amount to his children.

Dave Walker was the bully of Clay County when I was a young man, and my uncle, James Cundiff, was almost equal. James Cundiff was killed by Lewis Stivers, son of Rev. George Stivers. I think Stivers was insane. He wanted to kill Gen. Garrard. He was a soldier in Col. Lucas' company when he killed Cundiff. They were camped in Manchester. Cundiff was in the same company.

Stivers was court-marshalled and shot. Every ball took effect. Gen. George Morgan was in command. There were 12 soldiers and six guns loaded. I came into town a few minutes after he was shot.

My grandfather was a bully, a dissipated man. He whipped James Crum out of his house and cohabited with his wife, and she had three children by my grandfather. These made good men and women. Grandmother raised these children. I have seen him shoot at a candle 60 or 100 yards at a shot. He usually shot the candle out. Beef shooting was common in those days. He usually won. My grandmother was a gentle, pious woman. She did whatever her husband asked. The Cundiffs, of Breathitt County, are my cousins. So is the present jailer of Clay. Howard Redmon killed Dan Price, James Price's brother. It was he who went to the Virginia caves and committed suicide to escape arrest.

James and Dougherty White each had a great many slaves. Dough would get on a log or a stump when he whipped a Negro. The slaves liked James, but did not like Dough. When I was working for James White, we killed 60 hogs before daylight. We scalded them in a salt kettle, and handled them with a sweep. My step-father, Cottingin, gutted them. We were the only white men at it.

The source for David's death date is also included in the papers Barbara provided to me and is mentioned in both a Declaration of a Widow for Accrued Pension dated June 1, 1911 and a Deposition dated April 16, 1912, both given by Susan Armena Dezarn, David's widow. She states the last payment of his pension was made to the 4th day of February, 1911 and that he died on the 11th day of April, 1911. Susan was 62 years old and lived in Luttrell, Union County, Tennessee.

85. Hezekiah Dezern was born on 25 December 1841 in Scott County, Virginia,11,26 died on 2 November 1910 in Greene County, Tennessee26 at age 68, and was buried in November 1910 in Bethany Freewill Baptist Church, Greene County, Tennessee.27

General Notes: According to research by Russ Bralley in 1989: On March 26 1862, Hezekiah Dezarn enrolled as Private in Company A, 1st Regiment of the Tennessee Volunteer Cavalry, Union Army, commanded by James P. Brownlon. He was honorably discharged at Nashville, Tenneesee on April 4, 1865. After being discharged, he worked as a farmer.

In addition, the 1890 Veteran's Schedule for Greene County, Tennessee lists Hezekiah Dezern, Private, Company A, First Tennessee Calavry, date of enlistment: 26 March 1862, date of discharge: 9 April 1865, length of service: 3 year, 11 months, and 13 days. U.S. Civil War Soldier Records and Profiles indicate Hezekiah enlisted at age 20 while living in Scott County, Virginia on 7 January 1861, placing his date of birth about 1841. Although his cemetery headstone cites his date of birth as 25 December 1843, census data from 1850 and 1860 indicates he was most likely born in 1841.

According to family tradition, his wife, Nancy Ellen Bellamy's maiden name was actually Hensley. Tradition holds that her first husband, James Bellamy, was killed in the Civil War. Hezekiah's tombstone gives an incorrect date of his death. He actually died on 2 October 1906. He served in the Confederate Army and later switched his allegiance and also served in the Union Army.

Hezekiah was awarded a pension at the rate of twelve dollars per month to commence on the 28 July 1890. Pension being for disease of the eyes. While living in Jeraldstown, Greene County, Tennessee, he had earlier applied for a pension, which was declared invalid, at age 45 on August 14, 1886, in Washington County, Tennessee. His personal description at age 45 was height 5 feet, 10 inches; complexion fair; hair fair, eyes blue.

87. William Frederick DeZarn was born about 1844 in Scott County, Virginia,11 died on 22 January 1895 in Union County, Tennessee17 about age 51, and was buried in January 1895 in Chesney Cemetery, Union County, Tennessee.27

General Notes: William F. DeZearn, who stood 5 feet, 6 inches, was a Union soldier in the Civil War. He survived in the war, but he was later killed when a tree fell on him. He enlisted at age 20 on 15 October 1863 and served in the 8th Tennessee Cavalry, Company H.

On 8 August 1891, William applied for an Invalid Pension for his service in the Civil War. He was granted a pension of $8.00 per month. He stated he was 53 years old, meaning he was born about 1838. This date conflicts with his being age 19 at the time of his enlistment in the Union Army in October 1863, meaning he would have been born about 1844.

Following his death on 22 January 1895, his widow, Catherine Wininger Dezarn, on 12 February 1895 submitted a Declaration of Widow pension claim application. She had appointed and was represented by Goram Acuff, Attorney of Maynardsville, Tennessee. At the time, Catherine and family lived near the Maynardville, P. O. in Union County, Tennessee. The application mentions 4 children under the age of 16 who were living with her. The children were Martha V. Dezarn, born 28 February 1881; Hesaciah Dezarn, born 3 April 1884; George P. Dezarn, born 12 July 1886; and Maggie Dezarn, born 30 January 1889. The application further states that William and family lived on a farm comprised of 60 to 70 acres of rugged ridge land.

Later, on 29 July 1895, Malinda Wininger, Catherine's mother, gave a general affidavit to support Catherine's pension claim application. Malinda stated she was 65 and was a resident of near Maynardville, Union County, Tennessee.

On 8 July 1895, another affidavit was submitted of M. W. (Mathias Winton) Hensley, a resident of Sheer's Ferry, Scott County, Virginia. He was the husband of Elizabeth Dezarn Hensley, William's sister. This affidavit also included David Dezarn, William oldest brother, who lived near Big Cut, Scott County, Virginia. Another affidavit dated 8 July 1895 also mentions Samuel A. Wininger, age 44, a resident of Cameron, Scott County, Virginia.

Catherine ultimately received William monthly pension of $8.00 per month. On 19 April 1908, the pension amount increased to $12.00 per month.

According to information provided by Lamar DeZearn in May 2000, five sons of the six sons of William F. and Elizabeth DeZearn were killed in the Fraterville, Tennessee mine explosion on 19 May 1902. The sons killed in the explosion were: John, David, Samuel, Carr, and George. Another son, William Winton, was home plowing the field. Otherwise, he probably would have been at the mine and possibly killed along with his five brothers. William Winton DeZearn was Lamar DeZearn's grandfather. The family of William F. DeZearn migrated from Scott County, Virginia to Union County, Tennessee.

The following story is transcribed by a copy of a newspaper article provided by Carol DeZearn Loy, a sister to Lamar DeZearn. The story is based on an interview with Catherine Wallace Loy.

The Knoxville Journal, Thursday, January 24, 1980:

Mother lost five sons in Fraterville Explosion. Her father and eight uncles were killed in the Fraterville Mine explosion of May 19, 1902, but Catherine Wallace Loy was two and a half years old then and cannot recall the day itself.

She does remember the sadness in the family for a great many years following.

Catherine's grandparents on her mother's side were Bill and Catherine Dezern of Union County. They had six sons and three daughters.

The father, a Union soldier in the War Between the States, was killed sometime before the Fraterville explosion. Catherine says the family story she remembers is that he was cutting a tree and was crushed under it when it fell.

When the younger children were all about grown, the family moved to Coal Creek. John, the oldest brother, had been working in a mine there for some time.

The danger of working in a coal mine was countered by the pay, better than from logging or sawmilling and much better than from farm labor, or most other jobs available locally at the time.

So it was that five Dezern son and two sons-in-law were in Fraterville Mine the morning of the explosion. All seven were killed.

Mrs. Dezern then had only one son left. He was Wint, who stayed out that spring to plant his crops, but had planned to return to the mine in the fall.

The five sons killed were John, Samuel, Carr, David, and George. Catherine say her Uncle George was only 14 years old and the youngest of the brothers. George's body was one of the last to be found.

He had crawled to within a few feet of what would have been safety. At intervals, he wrote notes telling how bad the air was getting and that he wouldn't be able to take it much longer.

Finally, he wrote and asked his mother to give his possessions, including the toys of his recent childhood, to family members and friends. He named those that he wanted to have them.

A story persists that Catherine Dezern had the casket of all five sons in her home before their burial. That was customary then, before the time of taking the dead to funeral homes to await burial.

Two of Mrs. Dezern's daughters married miners, and both of those sons-in-laws also were killed that day. Daughter Mary lost her husband, Robert H. Allen, and daughter Victoria lost her husband, James Wallace.

(Victoria and James Wallace were the parents of Catherine Wallace Loy, who now lives at Lake City and is trying to answer our questions about her family "as well as I can remember from what I have been told.")

James Wallace's brother, William Henry Wallace, also was among those killed, and their sister Lucy lost her husband, Bart Hightower.

Other fragments of disaster lore that Catherine remembers hearing:

Her mother, Victoria, was out hunting the family cow, in the woods near the mine, for the morning milking, when first news of the explosion began to spread.

Catherine's family, and several of her aunts, had to leave the company-owned homes they rented at Fraterville. The homes were for the families of working miners only, and now all the miners in those families were dead.

The widows and children received "very little death benefit" from the company. Catherine never did know the exact sum her mother received, but recalls hearing that it was "about $300."

Other surviving children of men killed at Fraterville have mentioned $300 to $350 as the most common amount paid to a dead miner's family.

Some say their mothers didn't accept the amount offered, and filed lawsuits to try to collect more, and after lawyer's fees netted "about half of $300."

One son of a Fraterville miner says he believes his mother collected "about $1500."

A workmen's compensation law had not yet been enacted in Tennessee, and federal Social Security was more than 30 years in the future at the time of the Fraterville disaster.

Some of the Fraterville widows married again, and in most instances those marriages are believed to have been to other coal miners.

Almost all of the children surviving today were so young when their fathers were killed, almost 78 years ago, that they were not fully aware of the hardships that followed, nor by what measures their families survived. Most believe that it was with the help of relatives.

(Catherine Wallace Loy, who helped us with much of today's information, also is the widow of a miner. He was Ocle Loy Sr., electrician and mechanic for the big mine at Beech Grove about Lake City. He was retired from coal mining when he died in 1959.)


Lamar also indicated that his line of the DeZearn family were generally farmer of some sort, usually tenant farmers. Their education seldom exceeded the third grade. By age 7 or 8, most of the children were working in the fields. When times were hard for the family, many would do contract work in the mines. It is apparently for this reason that the five brothers were all at the Fraterville mine at the same time.

• Military Service: 19 October 1863-11 September 1865, Maynardville, Union County, Tennessee. On 19 October 1863, William F. DeZarn, age 19, volunteered to serve the Union Army in the Civil War. He enlisted at Rodgersville, Tennessee for a term of 3 years and was assigned to Company H, 8th Regiment, Tennessee Calvary. The companies' description book described him as being 5 feet, 6 inches, fair complexion, blue eyes, with light-colored hair. William mustered out of the army on 11 September 1865 in Knoxville, Tennessee.

• Census: 1 June 1870, Scott County, Virginia. Estillville Township, age 46, line 20 - William F. Dezren, 32; Catherine, wife, 21; John, son, 2, and William W., son, 1; all born Virginia.

William married Elizabeth Catherine Wininger, daughter of David Wininger Jr. and Malinda Jane Barrett, on 16 December 1869 in Scott County, Virginia.71 Elizabeth was born on 7 June 1847 in Scott County, Virginia,38 died on 7 September 1921 in Coal Creek, Anderson County, Tennessee17,50 at age 74, and was buried in September 1921 in Leach Cemetery, Coal Creek, Anderson County, Tennessee.17,27

General Notes: At the time of her death, Catherine Wininger Dezarn was living with her son-in-law John Dyer near Coal Creek, Anderson County, Tennessee. On 22 September 1921, John filed an Application for Reimbursement for burial expenses. The application states that Catherine died of paralysis, which began on 25 August 1921.
