Will of Robert Foord of Maidstone (1796-1872)

This is the last will and testament of me ROBERT FOORD of King Street Maidstone In the County of Kent plumber, glazier and painter. Firstly I appoint my son JOHN RICHARD FOORD and my friend FELIX KITE of Maidstone aforesaid, valuer and appraiser, executors and trustees of this my will. I direct my executors to pay all my just debts funeral and testamentary expenses as soon as conveniently may be after my death.
I give and bequeath the sum of £10 to each of my 3 grandchildren, the children of my deceased son CHARLES FOORD
I also give and bequeath the sum of £5 to each of my 6 grandchildren, the children of my said son JOHN RICHARD FOORD
I also give and bequeath the sum of £5 to each of my 6 grandchildren, the children of my daughter ELLEN the wife of JAMES BETTS
I also give and bequeath the sum of £5 to each of my 5 grandchildren, the children of my daughter TRYPHENA the wife of ARTHUR HUGHES
I also give and bequeath the sum of £5 to each of my 2 grandchildren, the children of my daughter HARRIOT the wife of EDWARD HUGHES
I also give and bequeath the sum of £5 to my grandchild, the child of my son ALFRED FOORD
I also give and bequeath the sum of £5 to be divided equally between my four grandchildren the children of my son WILLIAM FOORD
I also give and bequeath the sum of £19/19shillings to my housekeeper CAROLINE CHALONER
I also give and bequeath the sum of £19/19shillings to my executors as some renumeration for their time and trouble in carrying out the directions container in this my will.
I also give and bequeath the sum of £5 to HENRY MEAD the elder of King Street, Maidstone aforesaid baker. I also give and bequeath the sum of £19/19shillings to the Royal Masonic Institution for boys at Lordship Lane, Wood Green in the parish of Tottenham the same to be paid to the treasurer for the time being of the said Institution for the purposes of the Institution. And I direct that the said legacy shall be paid out of my personal estate and shall be understood and taken as coming from me a mason of lodge No 503. I hereby direct my executors to sell the household furniture and effects in and about my dwelling house at my death and I declare that the proceeds of such sale shall fall into and form part of my residuary personal estate.
I give and bequeath the iron chest in my house to my sons JOHN RICHARD FOORD and ALFRED FOORD for their own use and benefit.
I give and bequeath the 9 shares that I hold in the Maidstone Waterworks Company to my said sons JOHN RICHARD FOORD and ALFRED FOORD, their executors administrators and assigns to hold to my said sons JOHN RICHARD FOORD and ALFRED FOORD their executors administrators and assigns in equal shares.
I give and bequeath unto my said son ALFRED FOORD all my share on the stock in trade working tools, horses, and carriages, money and books used in the trade or business of a plumber, painter and glazier which I now carry on in partnership with my said son JOHN RICHARD FOORD to hold the same unto my said son the said ALFRED FOORD his executors administrators and assigns absolutely for his own use and benefit.
I give and devise all that my now warehouse and Smiths shop siuate in George Yard in King Street, Maidstone aforesaid now in the occupation of JAMES WOOD together with rights easements and appurtenances thereunto belonging, therewith used, held and enjoyed unto my said sons JOHN RICHARD FOORD and ALFRED FOORD to hold the same unto and to the use of my said sons JOHN RICHARD FOORD and ALFRED FOORD the heirs and assigns for ever in equal shares as tenants in common.
I give and devise unto the said JOHN RICHARD FOORD and FELIX KITE their heirs all those my 7 cottages with the gardens and appurtenances therein unto belonging situate in the QUEEN ANN ROAD in Maidstone aforesaid together with the rights easements and appurtenances to hold to them the said JOHN RICHARD FOORD and FELIX KITE and the heirs upon trust as to one moiety or equal half part thereof for my said daughter HARRIOT the wife of EDWARD HUGHES and as to the other moiety or equal part thereof upon trust for my said daughter TRYPHENA the wife of ARTHUR HUGHES during the natural life of each such daughter respectively without impeachment for waste. And from and immediately after the decease of either one of my said daughters then in trust as to the moiety of the one so dying in the lifetime of the other, for the heirs of the daughter so dying as tenants in common during the life of my one surviving daughter without impeachment for waste and from and after the decease of the survivor of my said daughter then upon trust to sell both the same moieties. And I declare that the said JOHN RICHARD FOORD and FELIX KITE their executors or administrators or other the trustees or trustee for the time being of this my will shall stand possessed of the net proceeds of the sale of the said two moieties. Upon trust as to one moiety or equal half thereof the child or children of my said daughter HARRIOT who being a son or sons shall attain the age of 21 years or being a daughter or daughters shall attain that age or marry before attaining that age in equal shares and proportions and if only one such child then the whole in trust for that one. And as to the other moiety or equal half part of such net preceeds, upon trust for the child or children of my said daughter TRYPHENA who being a son or sons shall attain the age of 21 years or being a daughter or daughters shall attain that age or marry before attaining that age in equal shares and proportions and if only one such child then the whole in trust for that one.
I give and devise all that the house of mine messuage tenant and premises situate in and being No 72 Week Street, in Maidstone aforesaid in the occupation of HENRY JAMES LOADER with the rights easeents and appurtenances thereunto belonging unto y said daughter ELLEN the wife of JAMES BETTS to hold the same to my said daughter ELLEN to the use of my said daughter ELLEN during the term of her natural life without impeachement for waste and from and immediately after her decease to the use of the children of my said daughter ELLEN lawfully begotten in equal shares as tenants in common their heirs and assigns for ever.
I give and devise unto the said JOHN RICHARD FOORD and FELIX KITE and their heirs all that my messuage or tenament belonging to me situate next to the police station in King Street, Maidstone aforesaid and being No.50 in the said street and also all those two cottages situate in Union Street in maidstone aforesaid and being No. 118 and 120 in the said street with all the rights easements and appurtenances to the said several messuages belonging or appurtaning to hold the same unto the said JOHN RICHARD FOORD and FELIX KITE and their heirs and assigns to the use of the said JOHN RICHARD FOORD and FELIX KITE their heirs and assigns upon trust to sell the same and I herby declare that the said JOHN RICHARD FOORD and FELIX KITE or the survivor of them or their heirs executors or administrators of such survivor or other the trusteees or trustee for the time being of this my will shall stand possessed of the clear proceeds of sucvh sale after paying all expenses. Upon trust to pay therout the legacy of £50 to my Grandchild GEORGE ROBERT COMPORT, £50 to my grandchild CHARLES COMPORT, £50 to my grandchild LAURA ANN COMPORT, £50 to my grandchild ADELAIDE COMPORT and as to the residue (if any) of the said monies I direct that the same shall fall into and form part of my residuary personal estate. And as to all the rest and residue of my real and personal estate not herein before specifically devised and bequeathed I give devise and bequeath the same unto my said sons JOHN RICHARD FOORD and ALFRED FOORD their heirs executors administrators and assigns to hold to them their heirs executors administrators and assigns according to the nature and tenure thereof in equal shares and proportions as tenants in common, but subject never-the-less to end charges with the payment of all my just debts funeral, testamentary and executorship expenses and also with the legacies bequeathed by this my will and the duty and expenses thereon and hereby direct my executors to pay the legacy duty on all legaciers thereby bequeathed provided always and I hereby declare that the appointment of my said son JOHN RICHARD FOORD as executor of any of the bequeaths or dispositions hereby made shall not extinguish or affect any debts owing or which my be owing to or from me by or to such one or other or any other of my children or any other claims which are or may be depending or submitting between me and my said son or any other of my children and I hereby further declare that my executors and trustees for the time being shall have the power of compunding debts of selling my real and personal estate and all other powers and advantages conferred upon executors and trustees by an Act passed in the 23rd and 24th years of the reign of her present Majesty entitled “An Act to give trustees, mortagees and others certain powers now commonly invested in settlement mortgages and Wills” and all other Acts of Parliament now passed amending the said Act and the clauses in the said Act and the said amending Acts shall be taken and read as if they were in this my will so far as they may be applicable now and except that if any of the clauses of the said Acts are inconsistent and conflicting with any clauses or provisions contained in this my will then the clause or clauses of the said Act so inconsistent or conflicting shall be read and subject to the clause or clauses of this my will with which such clause or clauses may be inconsistant or conflicting. I devise and bequeath all the estates which at my death shall be invested in me upon any trusts or by way of mortgage and at which I shall at my death have power to dispose by will unto the said JOHN RICHARD FOORD and FELIX KITE their heirs and executors and administrators respectively according the the nature thereof respectively upon the trust and subject to the equity of redemption which at my death shall be outstanding or capable of taking effect therein respectively but the oney secured on such mortgages shall be taken as part of my personal estate and lastly I revoke all other wills codicils and testamentary dispositions heretofore made by be on witness thereof I the said ROBERT FOORD have to this my last will and testament contained in this and 4 proceeding sheets of paper se my hand this third day of October 1872 - Robert Foord (signed)
