Will of James K. Mason

State of Indiana, Hendricks County Sct.
Know all men by these present that I James K. Mason of the State and County aforesaid being of sound mind and memory do by these present make and publish my last will and testament. I hereby give and bequeath to my wife Phebe Mason all my personal property and moneys except one horse and wagon and enough of the balance to pay my doctor bills. I now will and bequeath to my three single daughters one hundred dollars each for attending on me in my sickness, Mahala, Phebe and Sophia J. Mason. I now will and bequeath to G. Washington Mason, one horse and wagon. I now will and bequeath to my wife Phebe Mason, her support off of my real estate unless she sees proper to sell it, if she does, she is to have one third of the amount of my real estate. I now will and bequeath that when my real estate shall be sold and my three single daughters Mahala, Phebe and Sophia J. Mason have received one hundred dollars each as above mentioned that the remainder be equally divided between all my children except one third of one equal share which I will and bequeath to my Grandson James William Barker and the remaining two thirds to my daughter Charlotte Barker and her remaining heirs, the remaining children then to receive equally to wit: Jesse Mason, George W. Mason, John Mason, Mahala Mason, Phebe Mason, James R. Mason, Margaret Stout, Sophia J. Mason.
In Testimony hereof I have hereunto set my hand and seal this twenty eighth day of October in the year 1858.

State of Indiana Hendricks County as before me Levi Ritter, Clerk of the Court of Common Pleas of the County of Hendricks aforesaid personally came John Jones and Elisha Franklin, subscribing witnesses to the foregoing and hereto attached instrument of writing, who being by me first duly sworn upon oath, depose and say that James K. Mason the testator named in said instrument of writing purporting to be his last will and testament, on the day of the date thereof, that the said testator was at the said time of the full age of twenty one years, and of sound and disposing mind and memory, and that he was not under coercion, compulsion or restraint, and that he was competent to devise his property, and that the said testator so signed, sealed, published and declared the same to be his last will and testament in manner and form as aforesaid, in presence of affiants, subscribing witnesses thereto, and that they each attested the same, and subscribed their names as witnesses thereto in the presence and at the request of said testator and in the presence of each other.

I, Levi Ritter, Clerk of the Court of Common Pleas, of the county aforsaid, hereby certify that the foregoing last will and testament of James K. Mason has been duly admitted to probate before me. That the same was proven by the examination under oath of John Jones and Elisha Franklin the subscribing witnesses thereto, and that a full and complete record of the said last will fnd testament and of the proof and examination of the witnesses by whom the same was proven, has been made and is now of record in Will record No 3 of said County at page 50.
