Petition to sell land to pay debts and for partition.
Summons and Order of Publication
State of North Carolina, to the Sheriff of Union County-
Greetings:

You are hereby commanded to summon B.W. Deese, K.M. Deese, J.W. Deese,
Edmund Deese, of Arkansas, J.M. Deese, of Tennessee, and others of  
N.C.,  heirs-at-law of Clement Deese, dec$d, the defendants above named,
if they be found in your county, to be and appear before the Judge of
our Probate and Superior Court, at a Court to be held for the County of
Union at the Court House in Monroe, twenty days after the expiration of
this summons, and answer the petition and complaint which is deposited
in the office of the Superior Court of the said county, and let the said
defendants take notice that if they fail to answer the said petition and
complaint within that time, the plaintiff will take Judgement against
them for the relief demanded.
Hereof fail not, and of this summons make due return.
Witness, S.H. Walkup, Clerk of Said Court at office in Monroe, this
eighth Monday after the second Monday in February, 1876, and in the 100
year of American Independence.  Issued the 3rd day of July, 1876.

It appearing to the satisfaction of the Court that Edmund Deese residing
In the State of Arkansas, and J.M. Deese, residing in Tennessee,
defendants in the above proceedings, are non-resident s of this state
and are of full ages; it is therefore, upon motion of H.B. Adams,
attorney for petitioners, ordered by the court that publication for six
successive weeks be made in The Monroe Enquirer, a newspaper published
in the town of Monroe, N.C., for said Edmund Deese and J.M. Deese to
appear at the office of the Clerk of the Superior Court of Union County,
in the town of Monroe, N.C., within twenty days after the expiration of
this notice, and plead, answer, or demur to the aforesaid petition, or
judgement pro confesso will be taken against them, and the case will be
heard ex parte as to them.  Given under my hand and seal of office at
office in Monroe, July 3rd, 1876.
