Zealy Stone Letters and Documents
Zealy Stone was the son of John and Mary Stone of Virginia and Spartanburg County, South Carolina. He was born in 1792 in Virginia and died after 1870 in Gwinnett County, Georgia. He married Nancy Holmes, daughter of Jacob and Mary Holmes. who was born in South Carolina in 1793. They had the following children:
1. William (1815- ?) born in SC
2. Frances (1817- ?) born in SC
3. John W. (1819- aft 1857) born in SC and died in Georgia. He married Francess and had: Martha J., Regina and Delilah.
4. Thomas (1821- ?) born in SC
5. Missouri C. (24 Sep 1822- 14 Jun 1902) born in SC and died in Gwinnett County, Georgia. She married Williamson Johnson and had children: Mary Jane, Harriet C., James W., Elizabeth (my ggg grandmother), Sarah Arkansas, Emily Alice and Rebecca.
6. Aaron Oscar (1833- 15 Feb 1865) born in SC and died as a confederate POW at Camp Douglas, Chicago, Illinois. He married Matilda E. Cole and had children: William T., Nancy, Victoria and Rhoda J..

Jacob’s estate was probated in 1802. The following is found in the probate index for Union County South Carolina:

The following information from the Union Co. Courthouse from the Western Circuit Court Equity Record:
Zabud Holmes, son of Jacob Holmes, deceased, a minor above the age of 14, petitioned that his mother, Mary Holmes, be appointed his guardian. Petition granted upon Mary giving bond and security to the commissioner.
Mary Holmes, widow of Jacob Holmes, prayed that she be appointed guardian of the persons and property of her five minor children, viz, Mary, William, Nancy, Jacob and Amos. Petition granted, Mary giving security to the commissioner.
Court of Equity to be holden at Union Court House for the United Districts of Spartanburg, Union, York and Chester on 29 February 1804. South Carolina Magazine of Ancestral Research, V. 11 No. 4, Fall 1979, p. 197.

R. 193 Zabud Holmes, Sam’l Quin who intermarried with Polly Holmes, Zealy Stone who intermarried with Nancy Holmes, Jacob Holmes, Amos Holmes of Union District for $112.50 to Sam’l Davis of same, tract of land on Shoal Creek, a watercourse on Fairforrest, 45 acres, part of a tract originally granted to Jedathon Porter, 28 Mar 1822, Zabut Holmes (LS), Sam’l Quinn (LS), Zealy Stone (LS), Jacob Holmes (LS), Jacob Holmes (LS), Amos Holmes (LS), wit: A. T. Davis 28 Mar 1822 before J. Rogers. Q.U. Recorded 18 March 1822.

28 Jun 1846 - Letter from Zealy Stone to Catherine Smith Stone, widow of Zealy's brother Moses Stone.
p. 248-250. 22 July 1849. Mortgage. Catharine Stone of Spartanburg Dist, to B.F. Bates, Jacob A. Walker. I, Catharine Stone (MOSES STONE'S WIFE) am the guardian of my three children Susan Ann, Catharine Letitia & Martha Levinia & I have given Bond to the Commissioner in Equity for Spartanburg Dist for the faithful performance of my duties as Guardian & have given as sureties to said Bond Col. B.F. Bates & Jacob A. Walker Esqr..... Now, I, Catherine Stone, for the purpose of indemnifying & holding harmless B.F. Bates & J.A. Walker in the Event they should by any way put to Expense, trouble, hazard or loss, this day I conveyed unto them two tracts of land, one, 211 acres assigned to me in the division of Moses Stones Estate, whereon I now live joining Robert White and Elias Wingo. The other, 239 acres known as the Zealy Stone tract joining Henry Harvy, Mooney Harvy, John Easterwood and others; also six Negroes, one man named Phil, Rhodah, Ann, Sarah, Miles & Gilbert. If Catherine Stone shall well and truly discharge her duties and finally release & discharge Bates & Walker from all liability as Bond security this conveyance shall be utterly Void and of none effect.
