In the Name of God Amen.  I Thomas Huckell of the Borough of Stratford upon Avon in the County of Warwick ? being weak in body but of sound and disposing mind and understanding do make and ordain this to be my last will and testament in manner and form following that is to say I give devise and bequeath unto my uncle John Huckell of the Borough of Stratford up Avon aforesaid chandler and my cousin William Walford of

the same place wine merchant all and singular my messuages lands tenements and hereditaments situate and being within the Boroughs of Stratford upon Avon aforesaid and Evesham [Worcestershire] and in Rous Lench [Worcestershire] and Coughton [Warwickshire] in the Counties of Worcester and Warwick or elsewhere and also all and singular my personal estate of whatsoever nature kind or quality the same shall or may consist or wheresoever the same shall or may be found after my decease and not hereinafter in the this will otherwise disposed of to have and to hold the same and every part thereof with their and every of their rights members and appurtenances unto the said John Huckell and William Walford their heirs executors and administrators to and for the several uses trusts intents and purposes hereinafter in this my will ?ssed mentioned and declared ? the same that is to say upon trust and confidence and to the intent and purpose that they the said John Huckell and William Walford their heirs executors and administrators do and shall by and out of the ? ? and profits of the messuages lands tenements and hereditaments herein before given them or by mortgage or sale thereof or any part or parts thereof and also by and out of my said personal estate before given them raise and pay all such sum and sums of money as I shall give to any person or persons whatsoever at the time of my decease my funeral charges and the chare of proving this my will and from and after the time and just payment thereof

 

then upon further trust and confidence and to the end intent and purpose that they the said John Huckell and William Walford their heirs executors and administrators do and shall by all or any of the ways and means aforesaid raise and pay the annual or yearly sum of money together also with the legacies hereinafter mentioned that is to say to my dear wife Mary Huckell the annual sum or yearly payment of five and twenty pounds of lawful money of Great Britain free from all deductions whatsoever to be yearly ?ing going forth and out of all the said premises and to be paid to my said wife Mary Huckell or her assigns for and during the term of her natural life at the four usual days and times of payment in the year that is to say the five and twentieth day of March, the four and twentieth day of June, the nine and twentieth day of September, and the four and twentieth day of December the first payment thereof to begin and be made upon such of the said days or times as shall happen next after my decease and if it shall happen that the said annual sum or yearly payment of twenty five pounds or any part thereof to be behind or unpaid at any of the said days or times of payment as aforesaid it shall and may be lawful to and for the said Mary Huckell or her assigns into all and singular the premises hereby subjected and made liable to the payment thereof or any part thereof to enter and ? and the distress and distresses then and there found to lead drive carry away impound detain and keep until the said yearly sum or annual payment of twenty five pounds and all arrears thereof if any be and all costs charges and expenses in and about the same shall be fully satisfied and paid and upon the further trust and confidence to raise and pay to my said wife Mary Huckell the sum of fifty pounds of lawful money within the space of twelve months next after my decease and also that they my said trustees do and shall deliver unto my said wife to and for her own use so much of my plate China silver household goods and implements of household as she shall think fit to choose not exceeding in value upon a fair and honest valuation the further sum of fifty pounds

 

 and as to for and concerning my said messuages lands tenements and hereditaments charged and chargeable as aforesaid or such part and so much thereof as shall remain undisposed of for the purposes aforesaid I give devise and bequeath the same and every part thereof to my sons John Thomas and William and to my daughter Martha  and to such other child or children as shall happen to be born after my decease in case my said wife shall be with child at the time of my decease their heirs executors and administrators to be equally divided to and amongst them share and share alike at their several and respective age or ages of one and twenty years or day or days of marriage which shall first happen and my will and meaning is that my said trustees the said John Huckell and William Walford and the survivor of them his executors or administrators do and shall in the meantime and until my said children shall arrive at their respective age or ages of one and twenty or be married as aforesaid pay apply and dispose thereof and of all or any part thereof for and toward the education maintenance and preferment of all and every my said children in such manner as they my said trustees or the survivor of them or the executors or administrators shall think meet and fit and my will and meaning further is that if any or either of my said children shall happen to die or depart this life before they shall attain their several and respective age or ages of one and twenty or be married as aforesaid that then the share and part of him her or them so dying shall go to and be divided amongst the survivor and survivors of them share and share alike and be paid unto them at such time and times and in such manner and form as his her or their own fortune would become payable according to the intent and meaning of my will

 

 and lastly I do hereby nominate and appoint my said uncle John Huckell and cousin William Walford executors and my said wife executrix of this my last will and testament and hereby also revoking all former and other wills by me at any time before made and executed make and ordain this to be my last will and testament.  In witness whereof the said Thomas Huckell the testator to this my last will and testament contained in four sheets of paper to each sheet thereof have set my hand and to this my seal this fifth day of March in the year of our Lord one thousand seven hundred and forty.

This will was proved at London before the Right Worshipfull John Bettesworth Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted the second day of November in the year of our Lord one thousand seven hundred and forty one.  By Mary Huckell widow the relict of the deceased and one of the executors in the said will named to whom was granted administration of all and singular the goods chattels and credits of the said deceased being first sworn by Commission duly to administer power reserved of making the like grant to John Huckell and William Walford the other executors when they or either of them shall apply for the same.

In the Name of God Amen.  This is the last will and testament of me John Huckell of the Borough of Stratford upon Avon in the County of Warwick – chandler as follows, that is to say first I give my soul – that precious and immortal part of me to almighty God in hopes of enjoying eternal life through the merits of my redeemer Jesus Christ and my body I give to the grave there to be decently interred at the discretion of my executor and executrix hereinafter named and as to my real and personal estates my will and intention shall go and remain to the several persons hereinafter appointed for the same.

 

First I give and devise unto my kinsman John Huckell one of the sons of my late nephew Thomas Huckell deceased and to his heirs all that my messuage or tenement lands and hereditaments and real estate whatsoever lying and being in Lower and Over Binton in the said County of Warwick with all rights members and appurtenances thereto belonging and therewith enjoyed and the reversion and reversions, remainder and remainders thereof to have and to hold the same and every part thereof -------------unto my said kinsman John Huckell and his heirs forever yet nevertheless charged and chargeable with the payment of the sum of three hundred pounds of good and lawful money of Great Britain

 

With said sum of three hundred pounds I give and bequeath unto my kinsman Thomas Huckell and kinswoman Martha Huckell another son and the only daughter of the said Thomas Huckell deceased to be paid to and equally divided between them share and share alike at his and her respective age or ages of one and twenty years but in case either of them the said Thomas Huckell the son and Martha Huckell shall happen to die before he or she shall attain to his or her respective age or ages of one and twenty years then and in such case my will is and I do hereby subject the said messuage or tenement lands and hereditaments and real estate whatsoever in Lower and Over Binton aforesaid to pay and answer the sum of two hundred pounds and no more which said sum of two hundred pounds I give and bequeath unto the survivor of them the said Thomas Huckell the son and Martha Huckell to be paid to him or her so surviving at his or her age of one and twenty years.

 

I also give and devise unto my nephew John Huckell the son of my late brother Benjamin Huckell deceased and to his heirs forever all my messuages or tenements lands and hereditaments and real estate whatsoever lying and being in Welford in the county of Gloucester with all rights members and appurtenances thereto belonging and therewith enjoyed and the reversion and reversions remainder and remainders thereof to have and to hold the same and every part thereof unto my said nephew John Huckell and his heirs forever subject nevertheless to the jointure of my said wife Phoebe Huckell therein and also charged and chargeable with the payment of the sum of one hundred and fifty pounds of good and lawful money of Great Britain which said sum of one hundred and fifty pounds I give and bequeath unto my niece Anne Huckell the sister of my said nephew John Huckell to be paid to her at the end of one year next ensuing the death of my said wife Phoebe Huckell.

 

 I also give and devise unto my sister Ann Gower and her heirs forever all that my one yard land with the appurtenances and all my real estate whatsoever lying and being in Shottery in the Parish of Old Stratford in the said County of Warwick to have and to hold the same and every part thereof unto my said sister Ann Gower and her heirs forever.

 

I also give and bequeath unto my niece Mary Watson a widow the sum of one hundred pounds.  I also give and bequeath unto the three younger daughters of my aunt Susannah Walker the sum of forty pounds apiece.  I also give and bequeath unto my niece Elizabeth Dunn the sum of forty pounds.  I also give and bequeath unto my nephew John Walford a tanner the sum of one hundred pounds.  I also give and bequeath unto my cousin Elizabeth Hutchins the sum of twenty pounds.  I also give and bequeath unto my nephew Samuel Walford the sum of ten pounds.  I also give and bequeath unto my kinswoman Anne Walter the sum of twenty pounds.  I also give and bequeath unto my nephew William Walford the sum of fifty pounds and my will is further and I so hereby order and direct my executor and executrix hereinafter named to pay the several legacies aforesaid and not charged on my real as aforesaid at the end of one year next ensuing my decease by and out of my personal estate.

 

 I also give and bequeath unto the poor of the Borough of Stratford upon Avon aforesaid the sum of twenty pounds to be distributed amongst them at the discretion of my said executor and executrix either in money or other necessaries.  I also give and bequeath unto the poor of the Parish of Binton aforesaid the sum of ten pounds to be distributed amongst them at the like discretion of my said executor and executrix and I do hereby forgive and release all sums of money owing to me from my said brother Benjamin Huckell deceased on bond or otherwise after the payment of the said several legacies hereinbefore mentioned and also my debts and funeral charges by and out of my personal estate as aforesaid the surplus and remainder thereof I give and bequeath to my wife Phoebe Huckell and of this my last will and testament

 

I make and institute my said wife Phoebe Huckell and the said William Walford executor and executrix hereby revoking and declaring void all and every other will or wills by me formerly made.  In witness whereof I the said John Huckell the testator have to this my last will and testament in two sheets of paper contained and to each whereof I have set my hand and seal the seventh day of August in the year of our Lord one thousand seven hundred and forty-two.  John Huckell signed sealed published and declared this to be the last will and testament of me John Huckell the testator in two sheets of paper contained to each of which I have set my hand and seal in the presence of the several persons who have subscribed their names as witnesses of the same in my presence and at my request.  Tho. This will was proved at London before the Right Worshipfull John Bettosworth Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted the twentieth day of September in the year of our Lord one thousand seven hundred and forty-six by the oath of Phoebe Huckell widow the surviving executor named in the said will to whom administration was granted of all and singular the goods chattels and credits of the said deceased being first sworn by commission duly to administer the same.
