Will of Sarah Louisa Bird



This indenture made and entered into between Mrs. Elizabeth Duggar, Mrs. Eliza Edwards, Mrs. Alice Southwell, Miss Francis Johnson and William Johnson, heirs of Mrs. Sarah Louisa Bird, deceased, wife of Capt. Israel L. Bird, desceased, and Mrs. Susie Bradley and Mrs. Martha Hodges and Mrs. R.P.Bird, CRH Bird, J. P. Bird, J.G. Bird, and Lizzie Bird surviving children of Robert P. Bird and Mrs. Birdie Darsey surviving children of George P. Bird, heirs at law of the said I.L. Bird, late of Liberty County, deceased, husband of the said Louisa Bird:

WITNESSETH, that whereas the said Capt. I.L. Bird and the said Mrs. Louisa Bird, husband and wife, are both now dead; and,

Whereas, letters of administration were taken out by and in the name of Caspers C. Daniel; and,

Whereas, the said Caspers C. Daniel has since departed this life and the affairs of both the estates of the said Capt. I.L. Bird and Mrs. Louisa Bird being unrepresented now and not wound up, and

Whereas all parties hereto believing it to be the best interest of said estates that the same should be wound up without further administration being had thereon in terms of the law in order to save said estates expenses necessary upon a new administration and,

Whereas, prior to the death of the said Caspers C. Daniel, administrator, his brother Judge J. I. Daniel, at the request of the said administrator took charge of said estates, and is now in the possession of all the funds and property of the said estates.

Now, therefore, the premises considered, and for and in consideration of the benefits to accrue to the said estates, and the beneficiaries thereof, we the undersigned do hereby agree that the said J.I. Daniel shall wind up said estates and pay to the heirs of said Louisa Bird that portion of her estate remaining after paying the expenses of administration thereon, or its proportionate share thereof, and that the said J.I. Daniel shall pay to the said heirs of the said Capt. I.L. Bird the money derived from his estate after the payment of the cost of administration thereon, or its proportionate share thereof, after deducting therefrom such amounts, or the items hereinafter mentioned as may have been paid by the said Mrs. Louisa Bird from her own money after the death of the said Capt. I.L. Bird and prior to the death of the said Mrs. Louisa Bird. The said amounts paid by the said Mrs. Louisa Bird are as follows: For the doctors bill and medicine in the last sickness of Capt I.L. Bird $30, for the burial expenses and casket of said Capt. I.L. Bird $35, for the tombstone erected at the grave of the said Capt. I.L. Bird $80; and the proportionate share of the State and county taxes paid by the said Mrs. Louisa Bird from her private funds upon the property of the said Capt. I.L. Bird after his death and prior to the death of the said Mrs. Louisa Bird $45.73.

And it is further agreed that the amounts so paid out by the said Mrs. Louisa Bird on account of and for the estate of the said Capt. I.L. Bird, her deceased husband, shall be deducted from his property and added to the amount to be received by the heirs of the said Mrs. Louisa Bird.

And it is further understood and agreed that the expenses of administration of the said estates be divided or prorated between the two estates as their liability therefor may appear.

It is further agreed that the said J.I. Daniel shall deduct from the amount ot be paid to the heirs of the said Louisa Bird all amounts due be her estate for doctors bills, medicine, burial expenses, tombstones, and such other legitimate expenses as may be lawfully chargeable to said estate, and the remainder of the funds in his hands shall be paid over to the heirs of the said Mrs. Louisa Bird.

In witness whereof the parties have hereunto set their hand and seals the day and year shown in the attestation clauses opposite their respective signatures.
