Isaiah Ferguson to Michael Kearney 22 Feb 1864

To the Register appointed by act of Parliament for registering deeds wills and so forth in Ireland
A Memorial of an Indenture of assignment made the Eighteenth day of February one thousand eight hundred and sixty four Between Isaiah Ferguson of Lower Rathwire in the County of Westmeath Farmer of the one part whereby after reciting that lease dated the twenty fifth day of August one thousand eight hundred and sixty Thomas James Smyth devised unto the said Isaiah Ferguson his executors anmors and licensed assigns all that and those that part of the lands of Loughagar containing as therein setforth situate in the barony of Moyashell and Magheradernan and county of Westmeath To hold unto the said Isaiah Ferguson his executors admors and licensed assigns for and during the term of twenty one years from the first day of May their last at the yearly rent or sum of fifty four pounds nineteen shillings payable as therein menitoned The said Indenture Witnessed that he the said Isaiah Ferguson for and in consideration of the sum of Four Hundred and forty one pounds sterling to him in hand paid by the said Michael Kearney at or immediately before the execution thereof granted bargained sold assigned and made over unto said Michael Kearney his executors admors and assigns all that and those that said part of the the lands of Loughagar situate in the in the barony of Moyashell and Magheradernan and county of Westmeath together with all and singular the rights members priviledges and appurtenances thereunto in anywise appertaining to derived and granted in and by the said recited Indenture of lease of twenty fifth August one thousand eight hundred and sixty and all the Estate right title and interest of him the said Isaiah Ferguson his executors or admors therein or thereto To hold unto the said Michael Kearney his executors and assigns from the day of the date thereof for and during all the rest residue and remainder then to come and unexpired of the term of twenty one years granted in and by the said recited Indenture of lease and the the said deed of assignment and this memorial thereof respectively as to the execution of the same by said Isaiah Ferguson and Michael Keareny are witnessed by Richard Booker Lee of Mullingar in the County of Westmeath Clerk of Petty Sefsions and George Robert Gumineg of number fifty two north great George's Street in the City of Dublin Solicitor
Signed and sealed in the presence of - Richard Booker Sol - Isaiah Ferguson - Geo Robt Gumming Sol - Michael Kearney - 2/6 22 Feb '64
The above named George Robert Gumming Solicitor Maketh Oath and saith that he is a subscribing witness to the Deed of which the above writing is a Memorial and also to the said Memorial and saith that he saw the said Deed duly signed sealed and delivered and the said Memorial respectively duly signed and sealed by the above named Isaiah Ferguson and Michael Kearney and the partes thereof and saith that the name George Robert Gumming and set and subscribed as a witness to the execution of said Deed and Memorial respectively is his this deponents proper name and of his handwriting And Saith that on the twenty second day of February one thousand eght hundred and sixty four at the hour of ten minutes after two oClock on the afternoon ___ this Deponent delivered the said Deed and this Memorial thereof unto Patrick Vincent FitzPatrick Esquire Afsistant Registrar in the Registry Office of Deeds situate in Henrietta Street in the City of Dublin Sworn before me this the 22nd day of February 1864 at the Regstry Office of Deeds in Henrietta Street in the City of Dublin.
