This researcher will be the first to confess that experience has jadedme against ever accepting oral family legend without a grain of salt.In the case of Kelsey M. Cobb, bona fide documentation will not makeany sense whatsoever unless you do give at least some credence toundocumentable tradition and combine that with what you can prove.
It is believed that when Kelsey's parents moved to Texas in 1856 fromGeorgia, the party was initially composed of two families; that ofRowland Cobb, and that of George W. Eaton who had married Rowland'swifes sister Lavenia in 1854. It will be recalled that Lavenia'sfirst husband was Rowland's brother, Andrew Ambrose Cobb who had diedin 1844.
It is known that the combined party did not complete the move to Texasintact. The Eaton family dropped out in Fayette County, Alabama,along with one of Rowland's sons John L. Cobb. Both of these familiescan be found on the 1860 census for Fayette County. Another ofRowland's sons Warren dropped out in Sevier County, Arkansas, and diedthere in 1857. Kelsey did of course complete the move to Texas, andby 1860, he was married and had two small children.
According to oral family tradition, when the War Between the Statesbegan, Rowland and his wife became concerned for their relatives backin Alabama. Further according to legend, Rowland and sons Kelsey andRufus returned to Fayette County.
Apparently, Kelsey had also expressed his intention to offer hismilitary service to the Confederacy, and his wife had the desire toreturn to her family in Georgia while he was away.
It cannot be proven that the elder Rowland Cobb returned to Alabama,but there is documentation to show that Kelsey and brother Rufus did.Rufus died in Fayette County, Alabama in 1864, and his grave has beenlocated there. It can also be shown that Kelsey did in fact returnand placed his wife and children with her family in Georgia. Elviraand the children are found on the 1870 census for Whitfield County,Georgia.
Apparently after leaving his wife in Georgia, Kelsey returned toFayette County, where he filed his Will and then enlisted in CompanyC, 26th Alabama Infantry Regiment in March 1862. He was immediatelyordered to Virginia. On June 28, 1862, Kelsey was killed in action,probably in the series of engagements known as The Seven Days Battle,fought near Richmond, the last week of June 1862, immediately afterRobert E. Lee had assumed command of The Army of Northern Virginia. Aslate as 1933, a letter was still in family possession, sent by one ofKelsey's comrades to his family advising them of the circumstances ofhis death and burial. I have a partial transcription of that letter,detailing that Kelsey was shot through the Heart and died immediately.Then later that night his comrades returned and buried him where hefell after wrapping him in his own blanket.
An exhaustive search has failed to produce an official militaryservice record for Kelsey. It is presumed that the reason for this isthat he lived for such a short time after enlisting. However, asingle index card in the Alabama Department of Archives and Historystates that his widow filed a claim for his unpaid military wages duehim at the time of his death. The claim was initiated from CalhounCounty, Georgia. The card does specify the unit in which Kelseyserved and the date of his death. And the claim being made by hiswidow in Georgia, does verify that she had returned to her familythere.
Kelsey Miller Cobb was probably the only legal resident of FanninCounty, Texas to originally enlist in a non-Texas unit during the war,and to be killed in action in Virginia. Of all the units formed inFannin County, all were either assigned to the Army of Tennessee, orto the Trans-Mississippi Department. None were ever assigned to theArmy of Northern Virginia. It is quite possible that Kelsey never sawhis youngest child Mary, born in 1862.
I will also point out that in the same Company C, 26th AlabamaInfantry Regiment, was one Wilson H. Cobb, a cousin of Kelsey. He wasthe son of Andrew and Lavenia Edwards Cobb Eaton, and one of theAlabama relatives Rowland Cobb and wife Mary Edwards were concernedabout to begin with. Wilson had married just before the war started.He survived the conflict, fathered fifteen children, and eventuallymoved to Fannin County, himself. It was a small world then, too.

Obituary: James McLaurine Shivers
Col. J. M. Shivers, who for 38 years was a leader in all of theaffairs of the county died at his home Sunday afternoon at 4:00O'clock. He had been in failing health for some time and had beenconfined to his home for ten months, but was fatally stricken only afew days before he passed away.
James McLauren Shivers, was born in Marengo County, Alabama, onFebruary 10, 1834, son of Dr. 0. L. Shivers and Mrs. Catherine WoodfinShivers. He was educated in the public schools of the homeneighborhood and in Howard College, Alabama. Before his 18th birthdayand just after he graduated from College, the war notes sounded,calling the sons of the South to arms and he entered the ConfederateArmy in April, 1861, as a private in the 4th Alabama Infantry. ARegiment which for its bravery and fighting qualities, earned thesobriquet of the "Glorious Fourth". The young patriot was severlywounded, and before he recovered, he was stricken with typhoid fever.Crippled and ill he was given an honorable discharge and returned tohis home in Alabama.
He taught school for a few months, and also served with the Statetroops at Fort Gaines, on Mobile Bay. In 1862, another company wasorganized and this young patriot re-entered the service for a periodof 90 days, but before the time elapsed, he re-enlisted in the regulararmy, joining the First Alabama Light Artillery, attached to the Armyof Tennessee, with which command he fought during the remaining yearsof the war and for his gallantry was promoted to a Lieutenant. He waswith his command in the engagement at Shiloh, Farmington,Munfordville, Perryville, Murfreesboro, Chicamauga, Missionary Ridge,Riggold, New Hope Church, Atlanta, and at Spanish Fort. After making aglorious record when the cause went down at Appomatox, he was paroledat Meridian, Mississippi, May 14, 1865. Col. Shivers came from afighting family. His Great Grandfather served in the RevolutionaryWar. His Grandfather was an Indian fighter in Florida and his Fatherat the age of 21 raised a company for the aid of the Texas revolutionin 1836. All of them noted for bravery and intrepidity in battle.
After the cessation of holtilities Col. Shivers went back to Alabamaand lived in Perry for some time. In May, 1865, he was married to MissCornelia F. Cocke of Marion, Alabama, and filled the position as depotagent at Greensborough, Ala. He and his family came to Poplarville,Miss. in 1884 and he engaged in the lumber business. When the divisionof Marion County was made and Pearl River County organized, Col.Shivers was appointed the first Sheriff of the new county and servedone full term. He studied law and was admitted to the Bar andcontinued in active practice until a few weeks before his death. Heheld the office of Town Attorney for the town of Poplarville for anumber of years. Col. Shivers was a member of the Baptist Church, aMason and could be found on the right side of every issue. For a shortwhile he was also Editor of the Free Press back in the early days ofthe paper's life.
