This Indenture made and entered
into this fifth day of August in the year of our lord one thousand eight
hundred and twelve Between Jacob Roberts Austin Seay Samuel Ford &
John Chappel Commissioners appointed by the County Court of Amelia to
sell one half of the Mill seat late the joint property of the Orphan children
of William Clement dec.d and Cheadle Burch of the one part and Thomas
Powell of the second part all of the County of Amelia Witnesseth that
the said Jacob Roberts Austin Seay Samuel Ford and John Chapell commissioners
as aforesaid and Cheadle Burch for and in consideration of the sum of
one hundred and forty dollars and five cents to them in hand paid by the
said Thomas Powell the receipt whereof ?? hath granted bargained and sold
and by these presents doth grant bargain sell and confirm unto the said
Thomas Powell his heirs and assigns forever the mill seat late the joint
property of the orphans of William Clement deceased and the said Cheadle
Burch containing by estimation forty two acres the same more or less to
have and to hold the said mill seat together with all its improvements
appurtenances priviledges and anvantages thereunto belonging to him the
said Thomas Powell his heirs and assigns forever. And the said Jacob Roberts
Samuel Ford Austin Seay & John Chappell do hereby covenant and agree
with the said Thomas Powell to warrant and defend the rights and title
of the said Mill seat to him the said Thomas Powell his heirs &c forever
against the claim or claims of all and every person whatsoever leaving
under them other as individuals or as commissioners as aforesaid for the
said Orphans morety of the mill seat aforesaid. And the said Cheadle
Burch on his part doth hereby covenant and agree with the said Thomas
Powell to warrant and forever defend unto him the said Thomas Powell the
right and title of his morety of the mill seat aforesaid against the claim
or claims of all and every person or persons whatsoever In Witness whereof
we have hereunto set our hands and affixed our seals the day and year
above written

The commonwealth of Virginia
to William Meriwether & Samuel Ford Gentlemen justices of the County
of Amelia greeting whereas Jacob Roberts Austin Seay Samuel Ford and John
Chappell and Cheadle Burch by their certain Indenture of bargain and sale
bearing date the 5th day of August 1812 have sold and conveyed unto Thomas
Powell the fee simple Estate of and in forty two acres of land with the
Mill seat and othe appurtenances thereunto belonging lying and being in
the County of Amelia And whereas Judith Burch the wife of said Cheadle
Burch cannot conveniently travel to our County Court of Amelia to make
acknowledgement of the said conveyance ??? unto you or any two of you
??? Power to receive the acknowledgement which the said Judith Burch shall
be willing to make before you of the conveyance aforesaid Contained in
the said Indenture which is hereunto annexed And we do therefore command
that yo do personally go to the said Judith Burch and examin her prively
and apart from the said Cheadle Burch her Husband whether she doth the
same freely and voluntarily without his persuasions and threats and whether
she be willing that the same should be recorded in our said County Court.
And when you have received her acknowledgment and examine her as
aforesaid thatyou distinctly and openly certify us thereof inour said
County court under your seals sending then the said Indenture and this
writ Witness John T. Leigh Clerk of our said Court this 8th day of August
1812 in the 37th year of the Commonwealth

Pursuant to the within commission
to us directed we have proceeded to examine Judith Burch the wife of Cheadle
Burch seperate and apart and and apart from her husband the said Cheadle
Burch and the said Judith Burch freely voluntarily and without the threats
of her husband Cheadle Burch acknowledged the said deed and is willing
that the said be recorded in the said County Court of Amelia given under
our hands and seals this eight day of August 1812

This deed from Samuel Ford Austin Seay and John Chappell three of the
commissioners appointed by a decretal order of this Court to make sale
of one half of the Mill seat late the joint property of the orphan Children
of William Clement dec.d and Cheadle Burch and the said Cheadle Burch
to Thomas Powell was exhibited into Court acknowledged by the said Ford
and Seay to be their act and deed proved by the oaths of three of the
witnesses thereto subscribed as to said Chappell and Burch and ordered
to be recorded. And the Commission thereto answered with the certificate
of the examinatiion thereof was at the same time returned and also ordered
to be recorded
