     WHEREAS, on March 11, 1876, Charter Ordinance No. 78 was adopted by the Board of Trustees of The City of San Diego placing five acres within Calvary Cemetery under the free and exclusive control of the parish of the Immaculate Conception of the City of San Diego to be held in trust and to be used and controlled exclusively by said parish forever for cemetery purposes only, subject, however, to such general supervision of the corporate authorities of said City as is now or may be vested in them by law; and

     WHEREAS, the Roman Catholic Bishop of San Diego on March 27, 1968, quitclaimed all its right, title and interest in and to said five acres in and to the City of San Diego; and

     WHEREAS, on June 11, 1968, by Resolution No. 193940, adopted by the City Council of The City of San Diego, Calvary Cemetery was abandoned according to Sections 8825 through 8829 of the Health and Safety Code, with the intent to convert said land into a pioneer memorial park to be known as "Mission Hills Park"; and

     WHEREAS, pursuant to the foregoing, Charter Ordinance No. 78 should be repealed;  NOW, THEREFORE,

     BE IT ORDAINED, by the Council of The City of San Diego, as follows:

     Section 1. That Ordinance No. 78, approved March 11, 1876, be, and the same is hereby repealed.

     Section 2. This ordinance shall take effect and be in force on the thirtieth day from and after its passage.
