This Indenture Made this eighteenth day of february
in the year of our Lord One thousand eight hundred and sixty nine Between
Jose. G. Estudillo the President and Marcus
Schiller and Joshua Sloane, Trustees of the city of San Diego, in
the County of San Diego, State of California, parties of the first part
and Joseph
S. Mannasse of the same place party of the second part Witnesseth
That whereas, the President and Trustees aforesaid by vote of the duly
qualified electors of the said city of San Diego at an election for that
special purpose held in said City on the 25th day of May A.D. 1868, in
pursuance of the provisions of an Act of the Legislature of the State
of California entitled "An Act to repeal the Charter of the City
of San Diego, and to create a Board of Trustees" approved January
30th 1852 were directed authorized and empowered to sell Pueblo or City
Lands the property of said City, and whereas on the eighteenth day of
February A.D. 1869 the said President and Trustees in compliance with
said vote and said Act of the Legislature, sold to said party of the second
part, the land and premises hereinafter described, for the sum of ten
Dollars, in gold coin of the United States of America, being at the price
of twenty five cents per acre, upon the conditions provided for and prescribed
in a certain Resolution or Order of said Board of Trustees, made and entered
on the eighth day of June AD 1868 and said party of the second part, has
made and completed all the improvements upon said lands by said resolutions
or order required to be done, and has fully paid said sum of ten dollars
into the treasury of said city. Now therefore, the President and the Trustees
of the said City of San Diego, parties of the first part for and in behalf
of said City, by virtue of the power and authority in them vested by law
and for and in consideration of said sum of ten dollars in gold coin of
the United States, to them in hand paid by the said party of the second
part at or before the ensealing and the livery of these presents, the
receipt whereof is hereby acknowledged have given granted, bargained and
sold, released and quitclaimed, and by these presents do grant, give,
bargain and sell, release and quitclaim unto the said party of the second
part his heirs and assigns forever, all the right, title, interest, estate
and claim whatever of the said City of San Diego, of in or to the following
described piece or parcel of land situate in the said City and within
the limits of the Pueblo lands of said City, and more particularly described
as follows: Being that lot of land, lying East of Lot number eleven hundred
and twenty one (1121) and West of west lines of number eleven hundred
and twenty two and eleven hundred and nineteen, in a rectangular form
forty (40) chains North and South and nine and twenty five one hundreth
(9.25) chains East and West According to the official map of said City,
made by Charles H. Poole AD 1856, and on file in the office of the Secretary
of said Board Together with all and singular the tenement and appurtenances
thereunto in any wise appertaining. To have and to hold all and singular
the above described premises, unto the said party of the second part,
his heirs and assigns forever as fully and absolutely as we the said President
and Trustees may or can by virtue of the power in us vested convey the
same. In Testimony Whereof the President and Trustees aforesaid have hereunto
set their hands and private seal (there being no corporate seal as yet
provided) the day and year first herein above written.

County Clerk and an office Clerk of the County Court of said San Diego County
Joe G. Estudillo the President and Marcus Schiller and Joshua Sloane Trustees
of the City of San Diego whose names are subscribed to the annexed instrument
as parties thereto personally known to me to be the same persons described
in and subscribed in and who executed the said annexed Instrument as parties
thereto, who duly acknowledged to me that they executed the same freely
and voluntarily, and for the uses and purposes therein mentioned.
