Isaac Dubose III Will

In the name of God, Amen, I Isaac Dubose of Saint Stephens Parish in Craven County in the Province of South Carolina being of sound and disposing mind, memory and understanding thanks be given to almighty God for the same do make and declare this to be and contain my last will and testament in manner and form following, first and principally I recommend my immortal spirit into the hands of my great creator trusting in the moiety of my ever blessed Savior for pardon and remission of all my sins, my body I commit to the earth to be buried at the discretion of my executors herein after named, and as to what temporal estate it hath pleased God to bestow upon me in this world I give and bequeath and dispose of the same, as is herein particularly set down mentioned and expressed
First I order all my just and lawful debts to be satisfied and paid,
Secondly I give devise and bequeath to my son Isaac DUBOSE and to his heirs and assignings forever one tract or parcel of land whereon my dwelling house now stands it being the land I bought from Peter COUTURIER containing two hundred and eighty two acres (more or less) situate in St. Stephens Parish Craven County and Province aforesaid,
I also give bequeath and devise to my said son Isaac and to his heirs and assigns forever, one other tract or parcel of lands adjoining the above it being the lands I bought of Jonathan DUBOSE containing one hundred and sixty nine acres be the same more or less,
I give devise and bequeath to my said son Isaac and to Philip WILLIAMS of Saint Stephens Parish and to their heirs and assigns forever as tenants in common one tract of land containing four hundred acres it being all pine lands situate in Saint Stephens parish to be equally divided between them
I give devise and bequeath to my said son Isaac and to his heirs and assigns forever one pew in Saint Stephens Church distinguished and known by the Number Twenty One, situate near the South door of said Church.
Item, I give devise and bequeath to my other two sons named David DUBOSE and Samuel DUBOSE them and to their heirs and assigns forever as tenants in common one parcel or tract of lands containing five hundred acres (more or less) situate in Santee River Swamp in St Stephens Parish, Craven County and Province aforesaid which lands was originally granted to myself to be equally divided betwixt them by five indifferent men freeholders and livers in St Stephens parish, two to be chosen by each party concerned and the fifth by them so chosen.
I also give divise and bequeath my said two sons David and Samuel to them and to their heirs and assigns forever as tenants in common one other tract of land containing five hundred and fifty acres (more or less) situate in St Stephens parish aforesaid to be equally divided between them as aforesaid, (it being the3 lands I bought from John FRIERSON, I also give divise and bequeath to my said two sons named David and Samuel and to their heirs and assigns forever (as tenants in common one other tract of land containing twenty acres, (more or less) it being the lands I bought of Rene and Samuel RICHBOURG situate in the parish aforesaid to be equally divided between them as above said I also give and devise to my said two sons named David and Samuel and to their heirs and assigns forever, a pew in the parish Church of Saint Stephens known and distinguished by the Number Twenty and is situated at the Northwest corner of said Church (it being the pew I bought of Francis Vill ponteance,
Further, it is my will in case it should so happen that my son Isaac should die under age or before he attains to twenty one years, then and in that case the aforesaid three parcels of land containing in the whole six hundred and fifty one acres (more or less) which I have herein bequeathed to my said son Isaac shall be equally divided betwixt my said two sons David and Samuel to them and their heirs and assigns forever as tenants in common and it is my further will that in case it should so happen that either my sons David or Samuel should died before he attains to the age of twenty one years then and in that case the part of lot of lands hereby intended to be bequeathed to the one so dying I give bequeath and divise to the surviving two sons to be equally divided between them as above mentioned by indifferent men to them and to their heirs and assigns forever as tenants in common, it is my will in three years after my decease that negro fellow named Sabey and his wife named Grace shall be free to all interest and intents and purposes whatsoever, and it is my desire of my children that they will reasonably maintain the two said negroes names Sabey and Grace from the time they become free to their end lives
Item, I give devise and bequeath to my four children named Joanna DUBOSE, Isaac DUBOSE, David DUBOSE, and Samuel DUBOSE all the rest and residue of my estate to them and to their heirs and assigns forever to be equally divided amongst them share and share alike my sons to inherit at the age of twenty one years and my daughter at the day of marriage or at the age of twenty one years which sall first happen.
Lastly, I nominate and appoint Mr. Peter GOURDINE of St John's parish, Mr John GAILLARD and Mr David GAILLARD both of Saint Stephens' parish and Mr Theodore GAILLARD Junr. of Charles town to be executors of this my last will & testament, revoking and annulling all other will or wills and testaments heretofore made by me declaring the within on one sheet of paper to be and contain my last will and testament,
And now having settled all my temporal concerns, I humbly beseech almighty God that as he hath been graciously pleased to conduct me through all the vicissitudes of this mortal life that he may bring me in his own good time to be partaker of his endless and unspeakable glory in his heavenly kingdom thro the merits and for the sake of his own dear son and my ever blessed savior and redeemer Jesus Christ amen & amen.
In witness whereof I the aforesaid Isaac DUBOSE to this my last will and testament have hereunto set my hand & seal before the subscribing witnesses the tenth day of March in the year of our Lord, one thousand seven hundred & seventy three.

Proved before the Honorable Wm BULL Esq. Lt Govr in the court of Ordinary the 2nd day April 1773 at the same time qualified John GAILLARD Exor to said will before the Honorable Wm BULL Esqr Lt Govr in the court of Ordinary 16 April qualified David GAILLARD Exor to said will by virtue of a dedimus from the Honble Wm BULL Esqr Lt Govr to Wm NISBETT Esqr qualified Peter GOURDINE Exor to sd will the 21 April 1773.


Note: Isaac was married to Catharine Boisseau & both are buried on their plantation which is now part of the Oakland Hunting Club on SC Hwy 45 in Berkeley County. He was the son of Isaac Dubose II & Madeline Rembert. He died in 1773.
