43. Dec 1844, David J. Walton is issued Letter of Administration for the estate of his father, Martin Walton in Robertson Co TN. (Robt Co TN Will Bk 12, pg 251)
44. Aug 17, 1845, David was murdered by his slaves, Ned & Peter Walton. David approached Ned & Peter who were chopping wood & an argument broke out between David & his 2 slaves & Ned axed David to death. One of his wounds was on the back of the neck 3 inches long & 2 inches deep which was believed to have killed him instantly. Ned & Peter were indicted Oct 8, 1845. The jury found Ned guilty of murder in the first degree. Peter was found not guilty & made to pay court costs. The Court appointed Sheriff Green Benton to execute Ned by hanging on Oct 31,1845. Witnesses said that Ned rode in a 2 horse wagon from the jail to the scaffold sitting in his coffin. (Robt Co TN Circuit Court Bk C, pg 160-164)
