pg 180) This indenture made this eleventh day of May 1794 in the year of our Lord one thousand seven hundred & ninety four & of the sovereignty & independence of America the eighteenth between Richard WOOLEY Sr. of Chester County Pinckney District & State aforesaid planter of the one part and Francis LEE of the County, District & State aforesaid, planter of the other part witnesseth that for & in consideration of the sum of five shillings to him in hand well & truly paid by the said Francis LEE at & before the sealing & delivery hereof the receipt whereof is hereby acknowledged, hath bargained and sold & by those presents doth bargain & sell unto the said Francis LEE, his executors, administrators & assigns a certain plantation of land

pg 181) containing two hundred acres more or less lying on a branch formerly called Bowers Mill Creek but now a branch on the waters of Little River together with all & singular the gardens, orchards, fences, ways, walls, waters, water courses, easements, profits, commodities, advantages, emoluments, hereditaments & appurtenances whatsoever to the said plantation or tract of land & the reversion & reversions, remainder & remainders part & every part & parcel thereof. To have and to hold the said plantation or tract of land & all & singular other the premises therein before mentioned & intended to be here by bargained & sold & every part & parcel thereof with their & every of their appurtenances unto the said Francis LEE, his executors, administrators & assigns from the day next before the day of the date of these presents for & during the full time & unto the full end & term of one whole year, from thence next ensuing & fully to be completed & ended, yielding & paying therefore unto the said Richard WOOLEY Sr. his executors or administrators the rind of one ear of Indian corn on the last day of the said term & the same shall be lawfully demanded to the intent, purpose that the said Francis LEE by virtue hereof & by force of the statutes for transferring of uses into possession may be in the actual possession of the premises herein before mentioned & intended to be hereby bargained & sold & every part & parcel thereof with their & every of their appurtenances & may be hereby enabled to accept & take a grant & release of the provision of inheritance of the same to him & his heirs forever. In witness whereof the said parties to these presents have hereunto interchangeably set their hand & seals the day & year first above written.

Sign, seal & acknowledge the written lease to Francis LEE & also saw the other subscribing witnesses subscribe the same as witnesses, sworn to & subscribed before me this 13th day of June 1794.

pg 183) actual possession now being by virtue of a bargain & sale to him thereof made by the said Richard WOOLEY Sr. for on whole year for the consideration of one ear of Indian corn by an indenture of lease bearing date the day next before the day of the date of these presents to commence the day next before the day of the date hereof & sealed & delivered before the executing of these presents & also by force of the statute for transferring to uses into possession in that case made & provided & unto his heirs & assigns forever all that plantation or tract of land containing two hundred acres which said plantation of tract of land is part of a plantation or tract of land granted to Jacob BOWERS containing four hundred acres by a grant bearing date the third day of August in the year of our Lord one thousand seven hundred & sixty eight under the hand of his excellency Thomas BOONE Esquire, as in & by the said grant will more fully appear & by the said Jacob BOWERS sold & conveyed to the said Richard WOOLEY Sr. by indenture of lease & release bearing date the ninth day of August in the year of our Lord one thousand seven hundred & sixty eight. And which said two hundred acres, be the same more or less, beginning at the boundary of the West side & running thence East halfway through the said tract of four hundred acres of land & thence North until it reaches the North side. Together with all singular the gardens, orchard, fences, ways, wells, waters, water courses, easement, profits, commodities, advantages, emoluments & appurtenances whatsoever to the said plantation or tract of land containing two hundred acres, be the same more or less, belonging or in anywise appertaining & reversion & reversons remainder or remainders, rents, leases & profits thereof & of every part & parcel thereof & also all the estate, right, title, interest, possession, property, profit, claim & demand whatsoever whether on law or equity which he the said Richard WOOLEY Sr. now hath or ever had or which he or his heirs hereafter shall __ __ __ or right to have

pg 184) of, in, to or out of the said plantation or tract of land and other the premises with their & every of their appurtenances, together with all deeds, plats, grants, charters, writings & __ whatsoever which he the said Richard WOOLEY Sr. now hath in his custody or possession or can come by without suit in law or equity that do only concern the premises. To have and to hold the said plantation or tract of land & all & singular the premises hereby granted & released or meant or intended to be hereby granted & released unto the said Francis LEE his heirs & assigns to the only proper use & behoof of the said Francis LEE, his heirs and assigns forever. And the said Richard WOOLEY Sr. for himself & his executors, heirs & administrators do covenant, promise, grant & agree to & with the said Francis Lee, his heirs & assigns by these presents in manner and form following that is to say that he the said Richard WOOLEY Sr. now at the time of the sealing of & delivery of these presents is & standeth lawfully & absolutely seized of & in the said plantation or tract of land & all & singular other the premises herein before mentioned & intended to be hereby granted & released & every part & parcel thereof with their & every of their appurtenances of a good, sure, perfect & absolute estate of inheritance in fee simple without any manner of condition, trust, proviso, power of revocation or limitation of any use or uses or other restraint, matter or thing whatsoever to alter, charge, change or defeat or evict the same & also that the said Richard WOOLEY Sr. now hath in himself good right, full power & lawful & absolute authority to grant release & confirm the said plantation or tract of land and all & singular other the premises herein before mentioned and intended to be hereby granted & released & every part & parcel thereof with their & every of their appurtanances unto the said Francis LEE, his heirs & assigns forever. And also that it shall & may be lawful to & for the said Francis LEE, his heirs & assigns from time to time & at all times forever hereafter peaceably & quietly to enter into, have , hold, occupy, possess & __ the said plantation or tract of land & all singular other the premises herein before mentioned

pg 185) and intended to be hereby granted & released & every part and parcel thereof with their & every of their appurtanances without any __ lawful __ trouble, molestation, eviction or interruption of the said Richard WOOLEY Sr., his executors, administrators or any other person or persons whatsoever claiming or to claim by, from or under him. And that free & clear & freely charge and absolutely acquitted, exonerated & discharged & from all & all manner of former & other grants, gifts, bargains, sales, uses, wills, entails, jointers, dowers, judgements, executions, charges and incumbrances whatsoever had made, done, committed or suffered by the said Richard WOOLEY Sr. or any other person or persons whatsoever lawfully claiming or to claim by, from or under him. And that the said Richard WOOLEY Sr. & his heirs & all & every other person & persons whatsoever lawfully claiming or to claim any estate right, title, trust or interest of, in or to the said plantation or tract of land and all & singular other the premises herein before mentioned & intended to be hereby granted & released or any part or parcel thereof shall & will from at all times hereafter & who the reasonable request & proper cost & charges in the law & the said Francis LEE, his heirs & assigns make do acknowledge & execute or cause & procure to be made done acknowledge & executed & every such further & other lawful & reasonable act or acts, thing & things, conveyances do assurances in the law whatsoever for the further, better & more perfect & absolute granting, conveying & assigning of the said plantation or tract of land & all & singular other the premises herein before mentioned & intended to be hereby granted & released & every part & parcel thereof, with their & every of their appurtenances to and for the use & behoof of the said Francis LEE, his heirs & assigns forever as by his or them, or by his or their council learned in the law shall be reasonably devised or advised & required. And lastly the said Richard WOOLEY Sr. for himself & his heirs the said premises hereby grant bargained, sold, granted, released __ & intended to be bargained, sold, granted and released with their & every of their appurtenances unto the said Francis LEE, his heirs & assigns against all & all manner of person or persons whatsoever shall & will warrant & forever defend by their presents.
