This JOSEPH CUMMINS was a pioneer In the State of Kentucky, a landowner, a business man, a farmer and the father of thirteen children. WHERE DID HE COME FROM ?? We are still trying to determine just where he did come from to Kentucky. There are three different stories as to where he was before arriving in Kentucky. His son George said in a biographical sketch of himself in a book on the history of Harrison County, Kentucky, "His father came to Kentucky from Maryland as a young man with his parents'. William, another son of Joseph, said his "father came from Pennsylvania".The most widely circulated story Is, "Joseph Cummlns was born about 1755 in Scotland, came to New York, arriving 7 August 1778, worked in the shipyards until Christmas Day, then leaving New York he made his way to Kentucky'. NONE of the above quotes have a basis of fact. We are still trying to determine where Joseph Cumnins lived before he arrived in Kentucky, who his parents were, where they lived, and when he or they come to the United States. We do know the name of Cumnins /Cumnlngs is a well known name in Scotland,, The history of Scotland indicates the name Cummlns is a Norman surname, The name appears in Scotland Its history is interwoven In the colorful tartan of the heritage of Scotland. Historians used such ancient manuscripts as the Doomsday Book ( compiled in 1086 by William the Conqueror), the Honour Roll of the Battle of Abbey, The Curla Regis, the Falaise Roll, tax records, baptismals, local perish and church records to establish the first record of the name.----- The CUMMINS name was found in Northumberland where they were granted lands by Duke William of Normandy, for their distinguished assistance at the Battle of Hastings in 1066 A.D. Many alternate spellings of the name show up in the various records. Some of These variables are Cummins, Cumlnes, Cummings, Comine, Comyn, Cummin, Cummine, Cuming, Cumyn, Cummyn, Commyn. The scribes of those days spelled the name as It sounded to them. In those days a person could be born with one spelling, marry with another and be buried under yet a different spelling of the name. William Brown Attorney That on Mar.l5, 1808 Joseph Cummlns mortgaged unto your orator the property ( or so much at as said Cummins had not disposed of) of 10.111 1/2 acres of land in the counties of Pendleton and Harrison. Entered in the names of James Moody and Sarmrel McMillian and which the dlffendent, held by a conveyance from John Ewlng. Begining upon the condition towit; The said Morrison and defendent had entered into an agreement sometime in the year of 1806, by which defendent, bound himself to deliver to said Morrison in Orleans a quanity of staves and said Morrison obliged himself to pay defendent therefore and did actually pay him a considerable sum of money in goods towards the said staves delivery, and defendent bound himself to deliver on or before 12 mo. To pay and satisfy said Morrison the amount paid.. The quantity of land indisposed of in said tract was _?_ acres. Cummlns agrees that he will In all of the month of April next (1807) deliver to said Morrison or to his order in the city of New Orlans 90,000 prime white oak staves which shall have been inspected by the person appointed for that purpose in said city. 1/3 of the quanity of staves is to be pipe staves; 1/3 hogshead and 1/3 barrel staves with heading stuff or staves in the porportion or one fourth the whole amount. It is understood that 200 staves are given to each thousand (1,000 staves is to consist of 1200 pieces) conformable to the established rule of usage at New Orleans, The dimension of staves to be as follows; pipe-54· long, 4" wide 1 1/4' thick. Heading for same 30' long, 6' wide, 1 1/2' thick. Hogshead 44' long, 4' wide 1 1/4' thick.Heading for same 32' long. 6' wide 1 1/4' thick. Barrell 34' long, 4" 1/4' thick. The whole to be \clear of sap and knots, perfectly straight and free from cracks and wind shakes sound and clear of worm holes etc, For the 90.000 staves, delivered as aforesaid, Morison Is to pay Cummins $1086, In money as followsi 5200 as Cummins may call for it in all the next month and $200 in the month of Nov'r following 1/2 of each payment to be made in merchandise. George Cummins vs (Bill filed Oct. 4 1836) Mary Best and others George Cummins sheweth unto your Honour; That his father Joseph Cummins departed life on the 8th day of October 1834; previous to his death he purchased from, Alvin Mountjoy now dec'd, a tract of land in Pend. Co. upon the waters of Richland containing by survey 83 acres, and Joesph was to give 25 cents per acre for same. Mountjoy executed his Title Bond for the conveyance of said land upon payment of the purchase money. Your Orators father sometime before his death paid the purchase money. After the death of MountJoy your Orators father having given and granted said land to your Orator, delivered to your Orator a written order upon the heirs of said Mountjoy directing them to convey said land to your Orator. For the purpose of getting Mountjoy heirs to convey said land, your Orator delivered said order with the Title Bond to John Frazer who in right of his wife Sarah, was one of the heirs of Alvln MountJoy dec'd. That said Frazer shortly afterwards died without having procured the deed. Since his death your Orator has applied to Exr A. Robbins for them, but your Orator was informed that the Title Bond and order for a deed cannot be found. Your Orator states that his father had a very large family and in the latter part of his life owing to the fact that he was decrepped, old and infirm he was unable to provide for them by his own exertions. That thus situated his elder sons had left him, while your Orator remained with him for a number of years after arriving at the age of maturity, extended to him and the family these exertions and that labour and care which he deemed due from a son to an aged parent and owing to this, and in part compensation of your Orator's labour and care thus afforded to him and the family he was Induced to give your Orator said land & said order. The heirs of Alvin Mountjoy are Sarah Frazer the widow of John Frazer and Mary Best. That Joseph Cummins departed this life leaving; 1. Robert Chapman & Margaret his wife late Marqaret Cummlns, 2. Robert Cummins, 3 Joseph Cummins Jr., 4. William Cummins, 5. Isaah Malnor and Mary his wife the late Mary Cummins, 6. John Cummlns, 7. Josephus Cummins, 8. James Cummins. All of the above are non residents of the state. 9. James Bailes and his wife Sarah the late Sarah Cummins, 10. Jackson Cumnins, 11. Moses Cummins, 12 Fleming Cummins. Since the transfer of said land to your Orator by his father, he has been and now Is In the possession and occupancy thereof and hath made valuable improvements on same anterior to the death of his father. John was the SEVENTH child, fifth son, and was probably cared for by his eleven year old sister Margaret, as much as by his mother, who had seven children now to guide and care for, as well as her other dutiess of a wife In the early 1800's......... John, like his twelve brothers and sisters, grew up on his parents farm, among the hills,forests and streams emptying into the Licking River. It was there he learned to farm or till the land to bring forth a good harvest In the fall of the year. This knowledge was to of great benefit to him later,................... On 29 April 1828, John Cunmmlns, 21 years of age, married Nancy Chapman, daughter of his brother-in-law Robert Chapman who had married John's sister Margaret in 1818. Nancy Chapman was born 10 September 1811 in Franklln County, Tennessee, daughter of Robert Chapman and his first wife, Ann Martin................... In the 1879 history of Edgar County Illinois, page 698, Biographical Sketches, Elbrldge Townshlp,there is a short sketch of John Cummins that said, "In 1830, with wife and one child and his brother James Cummins, started for Illinois in a wagon drawn by a span of horses and $5.12.' Actually James had already been in Illinois with his brothers Joseph and Robert and gone back to Kentucky, Evidently James and John must have left Kentucky In the late sumner of 1830, because John was Ilsted in the U.S. census of Pendleton County, Kentucky for the year of 1830. James was listed in the U.S. census of Lawrence County,Illinois, for 1830. So It was after the census dates that James returned to Kentucky and then with his brother, John, returned to Illinois, this time James again went to Edgar County Instead of Lawrence County Illinois......... The first four years John and his family spent In Edgar County, Illinois, he rented a farm. It wasn't until 1834 he purchased 40 acres of land that lay south of Vermilion.That same year he built a log cabin and lived there until 1850. By that time he had rnanged to accunrlate 280 acres of land. It was here in the log cabin and on this land John and Nancy raised their family of 13 children. By the year of 1850 their oldest child Joseph had married and their next oldest child Margaret had died...................... John along with his brother James served a short period In the War against Chief Black Hawk of the Sac Indians in the summer of 1832. The following was extracted from the History of Illinois and the campalgn against Chief Black Hawk 1831-1832. BLACK HAWK WAR Cummings, James. Edger County, Illinois Cpl 7, Furloughed Aug. 4, 1832. Cummings, John. Edgar. County, Illinois Pvt 7, Furloughed Aug. 4, 1832. The above named Cummlngs were In the 2nd Brigade Illinois Mounted volunteers, commanded by General Atkinson ......... In the second and final campaing of the Black Hawk War, called under a proclaratlon issued by the Governor John Reynolds dated May 15, 1832,........ They were in Captain Samuel Brunberry's Company, 1st Regiment, 2nd Brigade, organized 10 May 1832 and started from Paris, Edgar County Illinois, June 4, 1832 to Hennepin, from there to Wilhorn to rendezvous 15 June1832, Formed Into a Regiment June 17 1832, into a Brigade June 18 1832,and on June 19 1832 mustered Into service.. At the conclusion of this episode of war with Chief Black Hawk of the Sac Indians, When he was captured August 15 1832, the volunteers of this war were also mustered out of service august 15, 1832, It was said by John Cummins' children that John and James, Were in the last battle with Chief Black Hawk, at the battle of "Bad Axe".This part could not be confirmed by the episode in the History of Illinois pertaining to the "BLACK HAWK WAR",,,,,,,............. After 48 years of companionship, John and his wife Nancy were seperated by her death, on 28 February, 1874.. Nancy "Chapman" Cummins was 62 years, 5 months,and 18 days old, at her death.. She was a member of the Methodist Episcopal Church. her remains were laid to rest in Vermillion Cemetery,near the home she had occupied for so many years..John Cummins continued to live another !7 years.. JOHN CUMMINS died 4 February 1891,(age 85 years, 1 month, 10 days)..He also was a member of the Methodist Episcopal Church.. He is buried next to his loving wife NANCY in Vermillion cemetery, Elbridge Township,Edgar County, Illinois, Aside from serving as a Road Comissioner of Elbridge Township for a number of years, John Cummins had little to do with public affairs.... County Clerk's Office, Edgar County, Illinois.} LAVINA was born 20 August 1824 In Edgar County, Illinois, daughter of Edward and Anna Purcell, Lavlna's mother, was born In Union County, South Carolina. Lavina is the sister of Sarah Elizabeth Purcell who married Joseph Cummins, brother to Robert Cummins . Robert was a farmer and veterinarian, doctoring for himself and other farmers in the area. They were parents of two sons, LAVINA 'Purcell' CUMMINS died 6 March 1856 and is buried in the Blackburn Cemetery, Elbridge Township, Edger county,Illinois. Robert Cummins married again, on 5 May 1857 In Jasper County, Illinois, to MELISSA "ELISHA" 'Letitia' SOVERIGN. (Sovern). Elisha was born 22 February 1838 in Indiana. ( She may be the daughter of Henry and Mary Scott Soverign.) Robert and Elisha farmed In Elbridge Township, Edgar County, Illinois, MELISSA "Elisha""Soverign" CUMMINS, died 9 September 1899. She Is buried in Vermilion Cemetery, Edger County, Illinois. ROBERT CUMMINS, died 29 June l906, at the house of his grandaughter, EVA LEE RAMSEY, in Wabash Township, Clark County, Illinois, he Is buried next to his second wife Elisha in Vermilion Cemetery, Edgar County, Illinois. The 1900 U.S. census of Elbridge Township, Edger County,Illinois, dated 2 June 1900, ( See microfilm T-623 Roll No. 298, SD No.13, Ed No. 64, sheet A--2, line 41, ) states their first child was born In Kansas...At the time of the census in 1900 Stephen and Belle had living with them a nephew and niece, ISHAM and IVA HYATT, both were born in Missouri. Stephen A, and his family moved back to the State of Kansas before 1910. They were patents of only two children (both sons) STEPHEN A. DOUGLAS CUMMINS died 20 December 1939, South of Harper, Harper County, Kansas. He Is buried In Stitch Cemetery, Norwich, Kingman County, Kansas..RACHEL ANN BELLE 'Oyler' CUMMINS died 26 September 1955 in Harper, Harper County, Kansas. She Is buried next to Stephen A. in Stitch Cemetery.. 7-3-4-1 CUMMINS, FRANKLIN THEODORE "Frank" First son of Steve and Belle Oyler Born 14 December 1887 in Harper, Harper County, Kansas. On 29 April, 1919 in Hutchinson, Reno County, Kansas, Frank married NELLIE FLORENCE WELLS; born 11 November 1896 in Argonia, Sumner County, Kansas, Daughter of Bryant and Mildred 'Weller' Wells..they were the parents of four children.------ FRANKLIN THEODORE CUMMINS Died 10 MAY 1963 in Harper, Harper County, Kansas. Foucault) Reply-to: muggins@evansville.net To: Chascum@aol.com Hi Charlie: I was cleaning out some files and on some yellowing paper found the following: Grandfather had no property in Kentucky and with hard times for the family he soon was talking how much better off they would be in Illinois. It seems that Grandmother was adverse to moving. The result was that Grandfather Josephus again took Fleming and drove away for Illinois. Grandmother followed again. Grandfather pulled the same trick to get back to Kentucky again and again Grandmother followed. Two migrations and two times back he went. Then for the third time, Grandfather took his son, Fleming, and headed for Illinois and again Grandmother followed. In time, Grandfather again became itchy for the Kentucky hills and Grandmother was adamant for staying on the 40 acres of land they owned. She began to keep close watch over the children and especially Fleming. She foiled any attempt for Grandfather to take one of the children, and he left alone. That was his last trip. He died in Kentucky. In 1939, Mrs. Eliza A. Wise, a daughter of Josephus, made a trip to Harrison County Kentucky, in search of living relatives. She was accompanied by her daughter-in-law, Mrs. Golda D. Wise, and among the relatives they found a Mrs. Rankin, granddaughter of George Cummins, and her mother, a daughter of George Cummins who was a brother to Josephus. In a discussion of the family, this daughter of George told of his father and mother hearing the sound of a wagon pulling into the barnyard in the night and would say, "Here comes that no-good Josephus". They were referring to Josephus' return from one of his migrations to Illinois. One time Grandfather figured he had been overcharged by a local merchant. The merchant bought eggs from the farmers and they usually were delivered in a washtub filled with oats so they would not break. One day Grandfather was in the store when a farmer brought in a full tub of eggs. Immediately after the merchant purchased the eggs, Grandfather offered to bet him 50 cents that he could jump into the tub and not break an egg. the merchant said, "You're crazy. I'd bet 10 to 1 you can't do it". Grandfather immediately jumped into the tub and broke nearly every egg. He reached into his pocket, handed the merchant 50 cents and said, "You win". He was a great lover of horses and he had good horses. During the war between the North and South, both sides took horses and other things and gave the people I.O.U.'s which in most cases were never redeemed. Grandfather built a frame of fence rails out in the woods and covered it with hay. He had a fine stallion and whenever raiders from either side were in the area, he kept this stallion in the rail and hay hideout in the woods. That stallion was a great help in maintaining good horses in the country during and after the war. Grandfather had a strong neck, back and teeth. He had an exceptionally square jaw caused by a double row of jaw teeth*. Uncle Flem told of Grandfather being at odds with a saloon keeper. He went to the saloon and eventualluy got a bet with the keeper of the saloon that he would take an 8 gallon beer keg in his teeth and throw it over his head without touching it with his hands. The bet was $5.00. Grandfather set the beer keg in the middle of the saloon floor. He then got his teeth set over the edge of the staves that project above the head of the keg. He lifted the keg with his teeth, swung it slowly back and forth and maneuvered until he had his back toward the bar. He then made a big swing and straightened up, throwing his head back and let loose with his teethh. The keg flew over the bar and into the back bar with its larger mirror, drinking glasses and display of special liquors. The damage probably came to near $300.00. Uncle Flem said that Grandfather argued that the saloon keeper was as liable as anyone for the damage but to show that he was sorry for what had happened, he would not make the saloon keeper pay the bet, the saloon keeper could keep the $5.00 that was coming to Grandfather on the bet. Another time, Grandfather took Uncle Flem with him and they drove 25 miles over to another county in Kentucky. there, he looked up a man (whose name Uncle Flem did not remember) who was reported to be a great fighter. When they found him, Grandfather said, "I understand you are the Bull of the Woods over here." The man said, "That's correct." Grandfather said, "I'm Josephus Cummins and I'm the Bull of the Woods where I come from. Let's just see who is the best man." They proceeded to battle and Uncle Flem said Grandfather won. The man got his finger into Grandfather's eye and tried to gouge it out, but Grandfather managed to turn his head and got the man's thumb in his mouth. He closed down and the man gave up as the flesh on his thumb was torn off to the bone. Grandfather offered to shake hands, got back in the wagon, and they drove home. NOTE* About the double set of teeth. I alway understood from my father, Flem Cummins, that all of his teeth were like jaw teeth. I have been told by a cousin, Edna Bower White that there is a decendent, one of Thelma Bower's sons, who I believe is living in the Hidalgo area, has the same genetic inheritance. I'm not sure whether his name is Kinsel or Carr. I don't know where I got the above or when - I know it had to be in the late 60's or early 70's. It seems that the first part of the story is missing. Have you seen this story before? If so, can you tell me more about it? Also, in the same file, there is a letter written about the beating of some of the Cummins children.
