Information provided by Marcia Behnke KCBehnke@aol.com

Abraham Grove, called Abbie and Uncle Abe, is in family pictures of the Gr oves at the home place north of Breckenridge and it is stated that he is t he brother of Samuel. Information from Paul Hobbs, that he received from Edith Spidle Jones, s ay that Abe's son Joe lived in Breckenridge and had no children. His wi fe wouldn't live on the farm, so they lived in Breckenridge. Joe had a sis ter, Carrie, that married a Cornelius and lived in Breckenridge. Abe h as a grand daughter named Emma who was 32 on the Caldwell, Missouri 19 10 census. Abe was 74. Age doesn't fit with his known birth dat e. If he was 74, then his birth date would be 1836, and he would have be en the last born son of Samuel Sr. He also had a ggson who was 8 in 19 10 living in the home. Maybe he was Emma's son.

[HI40839] (Research):Charges For Misconduct In Office November Term 1827 Common Pleas Court of Champaign County, Honorable Joseph H. Crane, Preside nt and James Smith and William Runide Esquires his associates, as judg es 12 November 1827. J. B. Heylin, James Dunlap, Jr., E. B. Cavalier, E. Baines, Jesse Bayle s, James Campbell, W. H. Fyffe, John Hurd, Douglas Luse and John Hamilt on good and lawful men of the county of Champaign came into court here a nd gave the court to understand that Daniel S. Bell Esquire, an attorney a nd counselor at Law in the Judicial courts of the State of Ohio, has be en guilty of misconduct in his office as an attorney and counselor at L aw and of offending against public justice and good morals.
Charge that some time in the autumn of 1826 Bell called at the resid ence of Lemuiel (?) Blue who had been charged with larceny for stealing. B ell told Blue he would be sent to the Penitentiary but Bell assured Bl ue he could clear him and would do so for twenty five dollars. Blue w as to give him a note for that amount. If Bell did not clear Blue, he wou ld return the note and receive nothing. Blue was convinced that he wou ld go to the Penitentiary whether guilty or not. However, no prosecution h ad in fact, as stated by Bell, been commenced against Blue.
Bell immediately on obtaining the note and before services of a ny description had been rendered, and in violation of his most solemn agre ement, transfeffed said note to Samuel Miller instructing Miller to immedi ately commence suit against Blue. The trial before Esq. Markley, Bell empl oyed an attorney to appear on the part of the plaintiff Miller and to ende avor by all means in his power to obtain a judgment against Blue, althou gh Bell well knew the whole proceeding to have been most oppressive fraudu lent and unjust. •In this case, Bell represented to Danny Flowers that he had been employ ed by Jeremiah Bateman to bring an action of slander against Flowers, b ut that if Flowers would give him his note for a certain sum, he would n ot bring suit. Flowers gave the note and yet Bell afterwards brought su ch suit. •In this case, by artful representation to the witnesses, whose names a re to be found on record in the following case, who had been summoned to t estif~j in the case of the State of Ohio vs Lewis ShrQjf~ (?) that they mi ght or would not get their fees, he bought their certificates at a discou nt and drew the money thereon. •In exciting one James Thimton to sue one David Bayles telling him he cou ld recover a large property if suit were brought and that he would prosecu te it pr ¼ (?) of all that was recovered and pay all costs. •That he undertook with one Samuel Sanders to commence and prosecute an a ction of slander when said Sanders was plaintiff against one Hegekiah Burd ick in the court of Common Pleas of Union County on equal risk between th em said Sanders and Bell, that if in case of success said Bell was to ha ve half of what should be recovered and in case of failure to pay one ha lf of the costs that might occur. •In this that he undertook with one David Day the collection of a certa in doubtful claim held by said Day against one John Taylor. He, Bell, defr aying all costs and changes and reserving a certain portion of the dema nd in the event of succeeding otherwise nothing. a In the case of Mason vs Johnston in the Champaign Common Pleas he appear ed as the attorney and counselor assisting and supporting him by his advi se and advisory and to receive a fee only in the event of recovery by plai ntiff a In the case of Almon (?) vs Cox he undertook to collect the demand of t he plaintiff from the defendant assisting plaintiff by his professional se rvices and to receive compensation only on the success of plaintiff claim. He supported one James Rhodes by his counsel and advice and otherwise in t he collection of a certain claim against one (no name listed) stipulati ng to receive one half that might be obtained and to pay for the transcri pt for that purpose.

All which charges and specifications your complainants are ready to verif y, wherefore they pray this Honorable court to deprive the aforesaid Dani el S. Bell attorney and counselor at law and to make such other order in t he premises as to your Honors may seem right and proper.

Whereupon hearing the evidence in support of the charges flied and the def endant Daniel S. Bell, the court find that Daniel S. Bell is guilty of mis conduct in office as an attorney and counselor at law and to therefore ord er and adjudge that be is hereby suspended from further practicing as an a ttorney and counselor in the court of Common Pleas of Champaign County a nd it is further ordered and adjudged that Daniel S. Bell pay the cos ts of this prosecution amounting to forty five dollars and forty seven a nd one half cents.

And the said Daniel S. Bell now here in open court gives notice of his int ention to appeal from the order and judgment aforesaid to the Supreme Cou rt of the State of Ohio. •

ELVA N. MIDDLETON
one of the representative men and substantial general farmers of Green township, where he operates a tract of 100 acres, forty of which is his own and sixty belongs to his father, was bom October 12, 1873, on a farm one and one-fourth miles north of this one, the latter being situated in Shelby county, O., seven and one-half miles southeast of Sidney. He is a son of James G. and Margaret (Nutt) Middleton.
James G. Middleton was born in Hamilton county, O., a son of John and Lydia (Graham) Middleton, and a grandson of William and Rachel Middleton. John H. Middleton was bom in Hamilton county, January 29, 1814, a blacksmith and farmer. On December 5, 1838, he married Lydia Graham, a daughter of James and Mary E. Graham. She was born in Lancaster county, Pa., August 14, 1818, and accompanied her parents to Hamilton county, O., in 1823, and after marriage she and her husband lived in Hamilton county until 1853, when they came to Shelby county and settled in Green township. They had the following children: Lucinda H., James G., Mary J., David, Elizabeth. Lewis N., Alice B., and William. When his parents came to Shelby county, James G. Middleton was eleven years old and he has continued his residence on the old homestead farm, now living in comfortable retirement, being aged seventy years. He married Margaret Nutt, who also survives, and they have three children: H. C., who lives one mile south of his brother's farm; John, who lives one and one-half miles north of this property; and Elva N. After his school days were over, Elva N. Middleton followed farming on the old home place, and then settled on his own farm about fifteen years ago, and has devoted his attention to a general agricultural line. The excellent improvements seen on the place he made at different times and the appearance of comfort and thrift indicate Mr. Middleton's careful interest in his present activities. He married Miss Eva May Proctor, a daughter of George Proctor, one of the old settlers of Green township, and they have four children: Don, Catherine, Grace and Robert. In politics Mr. Middleton has been a stanch republican for many years. Fraternally he is identified with both the subordinate and encampment branches of Odd Fellowship and the auxiliary order of Rebeccas, and belongs also to the Modern Woodmen.

[HI41524] (Research):I recently was given a copy of a letter written by my father, Clayton Mitc hell, in 1980 just a few months before his death. Daddy was orphaned at t he age of eight in October 1919 with the death of his mother, his father h aving been a victim of the influenza epidemic the previous year. These dea ths happened in Brown Twp., Miami Co., Ohio, and they are buried in Fletch er Cemetery in Champaign County. In this letter, he mentions "I was put o ut for adoption to Charlie Evilsizer, which didn't work out". This wou ld have been between October 1919 and July 1923, probably closer to the 1 923 date. Although I knew that Daddy had had a traumatic childhood, I nev er knew about this.

family came from White Co., Tennessee sometime between 1914 and 1917. Gran dma was married twice - both in Tennessee. She was married to Wm. Car r, a widower almost 30 years her senior, and had seven children, Aunt Sar ah being one of them. She was a very sweet lady and, being 15 years old er than Daddy, was like a mother to him once he went to live with her. Dad dy's baby sister, Aunt Ruby, was already living with Aunt Sarah and her hu sband, Carey Deal.

Two years after William Carr's death, Grandma married John Mitchell, my gr andpa, who was 15 years younger than she, and had three children - Addy L ee (later changed to Adolee), Clayton Ray, and Ruby Frances.

Note from Denise Moore 1/24/2005 James Russell Neese "Jim" was living in Rosewood the last time that I kn ew of, however, he was, at the time of his death, living on Shanley Roa d, just east of Rosewood in Adams Township, Champaign County. That wou ld make his address, R. R. DeGraff, which is in Logan County. He di ed at his mother's house, which was on Licklider Road, Adams Township, b ut R. R. Conover, (which is in Miami County). So don't use DeGraff and Co nover as his residence and place of death - use Adams Township, Champai gn County for both.

The 8 year old is a female and her name is Vashti Magdalen Detwiler. S he was born in Urbana, Champaign Co., OH on the 23 Feb 1842 and died 7 M ay 1918 in Ann Arbor, MI. She married Spencer Willard Garwood (b. 21 Ju ne 1835 Zane, Logan Co., OH) on the 20th of Sept 1866 in Adams, Berkshir e, MA. I found the name Vashti unusual for a female. I live here in Germ any and know 3 children by the name of Vashti but they are all boys.
