Mr. James Downey, whose death occurred at St Paris a few days since, was formerly a citizen of this community and enjoyed the universal esteem of his neighbors. He was, we believe, a native of Virginia, and died at the age of sixty-four years. He was a good man and departed this life with a full assurance of an inheritance in the better land.

(Research):The reason you don't find Lawrence in Bucks County is because he was Disow ned for Disunity by the Quakers. I'm unsure what happened after this, bec ause up to this point,(1807), the family owned a lot of property in the Mi ddletown area. I have yet to find the Father's (David) will, or Lawrence 's will. After the "Disowning", the family seemed to go their separate way s. I think the Quaker way of life had kept everyone bound together. Jonathon was born June 26,1811 and was Lawrence & Naomi Brown's first bor n. I beleive he was named after Naomi's Dad, Jonathon Brown. Jonathon married Mary Neeld of Bucks County.

[History .is never free from imperfections. Particularly is this true of the collected and collated records and data of pioneer periods — the beginnings of history. This is most natural as the memoranda are furnished by different authorities who discern the events recorded from various points of view or who are not accurate in their method of statement. The Ohio State Archaeological and Historical Society endeavors to gather and preserve all that is worthy of preservation concerning the early history of our state. It therefore gladly welcome* criticism upon and corrections of the material which it puts forth. It of course goes without saying that the Society is not to be held responsible for the authenticity or accuracy of articles contributed by- various writers to the columns of the Society's publications. We therefore readily publish "corrections" when they come from persons deserving credence. One of the most learned and critical scholars of Ohio's early history is Professor R. W. McFarland, who was born near Urbana in 1825, and who still at the age of eighty-two, with eye un- dimmed and faculties unimpaired takes an enthusiastic and active interest in the events of "ye olden time." He knew and conversed with many of the prominent settlers of the Buckeye State. Probably no one living; has so much knowledge "at first hand" of the startings of our state history. Professor McFarland's memory retains it strength and clearness unabated and what he says has the stamp of original authority. The editor of this Quarterly has often during the past years been indebted to Mr. McFarland for much valuable assistance in the effort to obtain reliable data of pioneer times and also for much revision and correction of material published. The editorial desk retains safely pigeon-holed many letters from the professor touching upon articles appearing in the Quarterly. We have culled from them some of the "items" we believe deserve not only the light of day but permanent place in the literature of the Society. The purpose of their appearance and their value speak for themselves. While much of the matter herewith published was intended only for the personal benefit of the Editor of the Quarterly, we gladly give the readers of the Quarterly and thereby all students of Ohio history, the benefit of the statements. — Editor.]

NAME OF SANDUSKY TOWN.
The name "Sandusky" as applied to the town, was not generally known as the name for more than twenty-five years after 1816. It was called Portland. I lived in the western part of Champaign county when I was young; and as late as 1842 my father sent a wagon-load of flour to Portland. All the country round did likewise, as being the best market for flour — , and everybody said Portland. It was after 1842 that the name of Sandusky became general

On Wednesday oflast week, while the carpenters were engaged in roofing a n ew addition to the dwelling of J. M. McFarland, the scaffold gave way, pre cipitating Mr. McFarland and Mr. N. F. Gibbs to the ground, a distan ce of 16 or 18 feet. Mr .Gibbs fell upon a large rock used for a doorste p, and a bunch of shingles which he was handling when the scaffold gave w ay followed and struck him on the back, injuring him to such an extent as to confine h im to his bed for several days. Mr. McFarland alighted square on his fe et and was subjected to no inconvenience, save the sudden halt when he came in contact with mother earth.

On the 18th «b» «/b»last, a number of friends and relatives celebrated the fifty-fifth birthday of J. M. McFarland, of this immediate vicinity. The inclement weather prevented many from attending who otherwise would have been present; yet sufficient were present to make things agreeable. A number of presents from various parties were among the items of interest. A life size portrait of J. R. McFarland and wife, of Goshen, New York, was not the least feature of the occasion. Mr. McFarland is a native of this township and is one of nineteen children of the late Robert McFarland. He has spent almost his entire life within sight of Concord chapel. In 1848 he went to Cincinnati with a drove of hogs for Uncle Dick Baldwin, working for 37 ½ cents per day, board included. On their return a part of the boys concluded to come home on the canal as far as Piqua, while the others walked back, those coming on foot beating the others several hours.

Mary Lou Smith Evilsizor, age 82, of Urbana passed away at 5:40 a.m. on Sunday, January 20, 2008 in Mercy Memorial Hospital, Urbana.
She was born on March 15, 1925 in Urbana the daughter of the late James and Valeria (Studer) Ahern. She married Raymond Smith on June 7, 1945 and he preceded her in death on November 29, 1980. On June 18, 1984 Mary Lou married Clyde Evilsizor and he also preceded her in death on January 2, 2002. Mary Lou and Raymond raised a son and two daughters who survive along with their spouses: Rodney E. and Pat Smith of Springfield, Cynthia and Bruce Miller of Albuquerque, New Mexico and Patricia and Richard Kniss of Springfield, Illinois. Mary Lou is also survived by five grandsons: Matthew (Karen) Miller of Atlanta, GA, Gregory (Ashlene) Miller of Albuquerque, NM, Steven Smith of Columbia, Missouri and Zachary and Nicholas Kniss of Springfield, IL; and three great-grandchildren: Kiera and Kyle Miller of Albuquerque, MN and Charlotte Miller of Atlanta, GA. Three sisters also survive Mary Lou: Rosemary (Rollie) Schindler of Punta Gorda, FL, Lucille Keating of Dayton, and Margie Cleary of Cincinnati. She is also survived by a sister-in-law, Libby Ahern of Kettering, a close friend and cousin, Maxine Stevens of Christiansburg, and many nieces and nephews. In addition to her parents and her two husbands, Mary Lou was preceded in death by three brothers, John, William and Thomas Ahern and two sisters, Loretta Cashin and Sister Mary Valeria. Mary Lou loved her family and friends. She always had a joke or a good story to tell. She enjoyed making her friends and family laugh and their happiness was important to her. Mary Lou was a 1943 graduate of St. Mary's Catholic School in Urbana. She was a member of the Sacred Heart Catholic Church of St. Paris and she retired from Grimes Manufacturing in Urbana. A funeral mass will be celebrated on January 26, 2008 at 11:00 a.m. in the Sacred Heart Catholic Church with Fr. Greg Konerman presiding. Burial will follow in Terre Haute Cemetery, Terre Haute, Ohio. Visitation for family and friends will be held on Friday, January 25, 2008 from 4:00 p.m. to 7:00 p.m. in the Atkins-Shively Funeral Home, 216 S. Springfield St., St. Paris, Ohio. Mass cards will be available in the funeral home.

!MARRIAGE: Mrs. Aleshire told me on the phone July 13, 1995 that she a nd her husband were married on December 17, 1927 in the Tremont City Methodist Ch urch Parsonage by Rev. Howard Carpenter. She said they were the first cou ple married by the young pastor in his new parish.

DORTHEA ALESHIRE 95, of Springfield, died Friday morning, March 26, 20 04 in Mercy Medical Center following a brief illness. She was born in West ville, Ohio on September 6, 1908 the daughter of the late Charles and Henr ietta (Baylor) Wiegel. She was a 1927 graduate of Lawrenceville High Scho ol and was a life-time member of Tremont United Methodist Church. She ga ve piano lessons to many students in the Springfield and Urbana area. Surv ivors include her son and daughter-in-law, Robert Elmo and Joyce Aleshi re with whom she made her home; three grandchildren, Brent (Nancy) Aleshi re of Westchester, Ohio, Rita (Tim) Wisecup of Enon, and Brad (Julie) Ales hire of London; eight great grandchildren, Leah and Scott Aleshire, Britta ny and Jonathan Wisecup, Brandi Payton, and Shannon, Jessica and Kaylee Al eshire; two great-great grandchildren; and a brother, Don Wiegel of Spring field. Also surviving are two nieces, Julie (Bob) Brust and Jane Lohnes; t wo nephews, J. Eddie (Betty) Jones and Richard (Denise) Jones; two grand n ieces; and three grand nephews. Her husband of 65 years, Robert L. Aleshi re preceded her in death in 1993. A gathering of family and friends wi ll be held from 2-5 p.m. Sunday in the LITTLETON & RUE FUNERAL HOME, SPRIN GFIELD. She served as a 4-H advisor for many years and was inducted in to the 4-H Hall of Fame in October of 1979 in recognition for her effor ts to promote 4-H Clubs for inner city youths. Edna was a member of the F irst Christian Church. Survivors include two daughters, Carolyn Sue and h er husband, Chuck Mohr of Huron, Ohio, Phyllis J. and her husband, Willi am Driscoll of Columbus, Ohio; and three sons, John M. and his wife, Don na Hupp of Martinsville, Indiana and Robert C. and his wife, Doris Hu pp of Springfield; nine grandchildren; two great-grandchildren; and a brot her, Leroy (Grace) Farish of London, Ohio. Survivors include two daughters, Marsha (Tom) Berry of Springfie ld and Gayle Carlyle of Indian Lake, Ohio; five grandchildren, Mike Ber ry of Las Mesa, California, Jon (Robin) Berry of Mutual, Ohio, Sue (Joh n) Rogers of Springfield, Steve (Linda) Caryle of Bakersfield, Californ ia and Curt (Diane) Caryle of Houston, Texas; and nine great-grandchildre n. ALESHIRE, Robert Elmo 75, of Springfield passed away Saturday morning, Mar ch 12, 2005 in Mercy Medical Center following a courageous battle with can cer. He was born in Urbana, Ohio on July 13, 1929 the son of Robert L. a nd Dorothea (Wiegel) Aleshire. Elmo was a 1948 graduate of Lawrenceville H igh School. He served his country in the United States Army, station ed in Austria from 1951-1952. He was a Boy Scout leader from 1953-195 4. He worked at P.E. West and Ripley's for 13 years as a mechanic, Mr. Ins urance for six years as a salesman and in management at Rhoades Paper B ox Company for 28 years, retiring in 1995. Since his retirement he has enj oyed spending time with his family, traveling and dining out. He also enjo yed golf, flying, photography, being a HAMM radio operator, his flowers, g ardening, and being a handyman. He will be missed by everyone who knew hi m. Elmo is survived by his wife of 53 ½ years, Joyce (Baker) Aleshire; thr ee children and their spouses, Brent A. and Nancy Aleshire of West Cheste r, Ohio, Rita Jo and Tim Wisecup of Yellow Springs, and Brad L. and Jul ie Aleshire of London; eight grandchildren, Brandi L. (Mike) Payton, Shann on M. (Lance Dorr) Aleshire, Jessica M. Aleshire, Kaylee Aleshire, Leah a nd Scott Aleshire, and Brittany and Jonathan Wisecup; and two great grandc hildren, Alex and Hunter Payton. [HI24328] (Research):Springfield Sun News, June 10, 1905 Murdered By Desperados Tremont Man Is Killed in an Arkansas Lumber Camp The sad news has reached here of the murder of Carroll MICHAEL near Oza n, Arkansas, on the 26th of the month. Carel was connected with a limberi ng mill with his father at that place, and as the country is full of despe radoes, thieving is common. Some lumber had been missing from the mill a nd Mr MICHAEL, the father of the murdered boy, spotted some of the valuab le boards, and accused one of the desperadoes of stealing it. The murder er of the boy said that he would "fix the MICHALE'S." That evening as t he young man was going to his home in the town, he was deliberately shot o ff his pony and instantly killed. The desperado was caught and put in jai l. The deceased was the second son of William MICHAEL and Hannah BUSHONG M ICHAEL aged 28 years. The family, formerly lived in this locality and ha ve many relatives who feel very sad about the affair.

(Research):Mar 27, 1910 While sitting in his home near Tremont City at 7:30 p.m. Saturday evenin g, George BERRY died suddenly. His wife had just stepped into another ro om after a glass of water for him when the end came. Upon her return she f ound him dead in the chair. During the day, Mr BERRY was in Tremont City c hatting with the men at the stores and appeared in excellent spirits. Retu rning home he ate a hearty supper and was preparing to enjoy the eveni ng in the sitting room when death came. Mr BERRY was a well known small fr uit grower and attended the local market for years. He was acquainted wi th all of the business men of the city for several years he had been suffe ring with complications of diseases. Lately his condition appeared to impr ove. Mr BERRY is survived by his widow and two daughters. , Mrs Lula ALSHI RE, of Tremont City, and Miss Ruth BERRY, who is attending the school of o ratory at Chicago. He also leaves two brothers, Monroe BERRY, who liv es in Spokane Washington and Albert BERRY, who resides in Westville, Ohi o, and a sister Mrs Charles O STRAUB of 142 West Grand Avenue, this cit y. Mr BERRY was 52 years old. The arrangements for the funeral will be ann ounced later.

[HI24335] (Research):October 18, 1902 The citizens of Tremont were sorrow stricken, Saturday morning when word w as received of the horrible accident which happened to Charles MAGGART a nd his three boys in the great conflagration of the TUCKER wood rim facto ry at Urbana. Charles MAGGART, father of the unfortunate boys, with his li ttle family lived in Tremont prior to moving to Westville, Ohio from whi ch place they moved to Urbana. Samuel MAGGART is the father of Charles, a nd Henry SEITZ is his father-in-law. Both families hastened to Urbana on r eceiving the news. As the touching story went the rounds among the citizen s, tongue nor pen could not describe the awful shock to the many acquainta nces of the family. The poor little 7 year old boy, whose body was consum ed by the flames, probably not enough of the remains can be found for buri al, was a remarkably bright child. Whoever met little Charley was his frie nd and he was possessed of a very pleasing disposition and loved by al l. At the very latest report it is learned that the mother is in very dang erous condition from grief, and no one knows what the result may be,.
[HI24337] (Research):October 25, 1902 The remains of little Karl MAGGART, who was consumed in flames at the wo od rim factory fire last Saturday morning at Urbana, were interred in Mt C alvary Cemetery Wednesday afternoon. The condition of Leroy, the boy who w as so badly burned, is very distressing, but friends have hopes of his rec overy. The grief stricken mother is recovering from the shock, although f or a while her condition was alarming. Charles MAGGART, the father, who w as so badly hurt, was able to attend the burial of little Karl. The frien ds of the family at Tremont and elsewhere are glad that citizens of Urba na are subscribing to the MAGGART relief fund. This is a worthy cause as t he family is in need of kind gifts of friends.

The firm of contractor-carpenters, Martin & Ream, are constructing a modern seven-room house on their lot in South Main street, a square below the South District school, purchased sonic time ago from County Treasurer N. 0. This adds another new residence property to the eighth square in this street which has seen several new homes constructed in the past year or so. (Research):Family record shows that Nathanile and Rebecca and party made the journ ey on horseback, carrying two sons, John and Thomas.
Nathaniel and his wife, Rebecca Van Meter came to Ohio between 1805 - 181 0, settling in Pleasant township. In 1822, Nathaniel built a flouring mi ll on the south branch of Buck Creek. Later, he added to it a woolen mi ll and distillery.

HISTORY OF CLARK COUNTY. Lafferty and Hendricks were the joint owners of the farm on Buck Creek, wh ere they lived, and which they afterward sold to Nathaniel Cartmell, fr om whom it received its present name "the old Cartmell farm."
There is an interval of a few years, during which no accession was ma de to this early settlement; but, from the year 1808 to 1812, and about th at time, the spirit of enterprise seemed to have prevailed in the older se ttlements, and a number of fearless men with their families joined the bra ve and hardy pioneers. The men who came at this time were Nathaneil Cartme ll, ..................
Nathaniel Cartmell settled on Buck Creek as before mentioned.
A few years later, about 1822, Nathaniel Cartmell added another to the num ber of grist-mills; this was situated further west upon the same strea m, to which place he afterward added a woolen-mill and distillery, These m ills evidently met a demand rendered pressing by the increasing produc ts as well as inhabitants.

Nathaniel C artmell a brother and a sister, Sarah Cartmell, wife of William Morris ea ch held 1/9 of William’s estate. When Sarah’s husband, William Norris die d, his children were: Ann Morris, Nathaniel Morris and Elizabeth Norris (m entioned only once). Sarah later married John Handcock. Before her remarri age Sarah turned over her portion, (1/9) of her brothers s estate and of h er mother’s estate ($700) to her chiI.dren, but she insists that it by und er duress by her brother, Nathaniel. In this case, Sarah is asking for t he return of her portion of both estates. On 13 August 1827 the court dism issed the case at the costs of the Handcocks.

In 1835 John Arrowsmith filed a bill in equity against William Frank and o thers for the sale of land needed to pay bills; In lot number 112 in Urba na and Lot Number 6 (81 3/4 acres) in Section 3 Twp 4 Range 12 (Concord Tw p). John Anderson, in his will, gave the land to his grandsons, son of Jam es Anderson, Sr. The land should have been divided seven ways but was divi ded eight ways, including a portion for the father, James, Sr. The childr en of James Sr; John Anderson, William Anderson, George W Anderson, Jam es Anderson, Richard Anderson, Crawford Anderson, Ward Anderson. When Jo hn Anderson died, William Ward held the title to the land, but the title w as given to James Reed deceased as agent or trustees. The title was lat er transferred to James Anderson Sr, deceased. Urbana; was born in Dauphin Co., Penn., Sep t. 21, 1830; is a son of Abraham and Fanny (Rush) Herr, natives of Pennsyl vania; they removed to Ohio in April, 1840, locating in Clark Co., an d, in the fall of the same year, he bought and located upon the farm adjoi ning the one where our subject resides; here they lived and died; he di ed in February, 1863; his wife died in September, 1877 ; they had seven ch ildren grow up to maturity-Jacob, Abraham, Fanny, David, Elizabeth, Barba ra and Benjamin; the latter is now deceased, dying with typhoid fever in t he army, on Black River, Mississippi. Mr. Herr was a plain, quiet farme r, never holding or seeking office, but diligent and industrious, attendi ng strictly to his own affairs, a good neighbor, and honored and respect ed by all who knew him. Our subject, brought up at home to farm labor, w as married, March 18, 1852, to Nancy Maria, daughter of Harvey Bates: th ey had seven children, four now living-Nancy Jane, Charles E., Alma B. a nd Emma G. Mr. Herr located about four miles north of his present locatio n, on a farm of his father's; he lived there four years, and then on anoth er rented farm, near Lippincott's Station, where he stayed four year s; he then bought and located upon his present excellent farm, ownin g, in all, 315 acres of land, the home place embracing 156 acres, with go od buildings and improvements-constituting a beautiful home and farmer's r esidence. Mr. Herr has held the office of Township Trustee more than twen ty years; is a popular man in his township, and, like his father before hi m, is highly respected. He and his wife are members of the Baptist Churc h, having been such since 1853.

The parents of Henry Foltz, Dav id and Christina Foltz, were natives of Shenandoah Co., Va., and came fir st to Clark Co. in 1835. They have three children living that were bo rn in Virginia-Martha, Sarah and Nathaniel ; Henry was born in Clark Co. D avid Foltz was a tailor by occupation, and worked at his business in Virgi nia previous to his removal, and subsequently carried on the busines s. He came to Mad River Township in 1848, where he had previously purchas ed a farm, and has principally engaged in agriculture since living here. H is children are all living near him except Martha, who wedded Noah Zerk le ; they reside in Clay Co., Ill. Sarah married Elias Neese. Nathani el is the husband of Sarah C. Leonard, and Henry married Sarah A. Zerk le ; they reside on the home farm with the old people, and the farm is man aged by the two sons. All the children have . married into the old famili es of the township, most of whom are represented in the history of this co unty. Henry and his wife are parents of Hester Alma, Emory Harlan and Char les Anson. The boys are bright little fellows, and give promise of much in telligence ; Heater will soon complete her studies. The farm has been clea red since Mr. Foltz came, and the substantial improvements have been ma de by him. His sons have been of much service, and are now reaping their r eward. They are substantial men, and enjoy the confidence of the communi ty in which they reside. They are ardent Democrats, and are strong advocat es of the party principles. They are all members of the Lutheran Church, a nd are prominent in the furtherance of every good work.

(Research):From Larry Hurley 8/1/2004 lhurley918@earthlink.net There was several reasons for us moving to Indiana in the early 50's. The re was a colony move d from Ohio to Indiana. Among them was Rube and Will is Zirkle, two Gentis families mand a Rus t or two and a few others. Whene ver they caame back to Ohio they would report Indiana much su perior in fe rtility to Ohio whicxh created a western fever which never left them unt il they m oved. Another reason was a dozen boys coming on that needed a j ob of work at home. The home p lace in Ohio was only 60 acres and no oth er land joining it couol be bought, Then Uncle has t wo boys and he wan ts land for them. And, another thing in the fall of 1881 Jacob Apple ca me t o Indiana and bought 80 acres 1 mile north and 1 mile west of Swayze e. Then mother and fathe r said we will go to Indiana as soon as we can g et a farm there. I know in th spring of 188 2 I was to go for myself so Ja cob wanted me to drive the team through to Indiana. But Grandmo ther to ld me Indiana was a swamp, that there was no drainage, that water had to e vaporate, th at it was full of the third-day ague and in the fall fu ll of Typhoid fever, that I would go o ut there and get sick and spend a ll I had and would have to be brought back. I told her tha t I would b eg my living and walk back. On the 13th day of March 1882 I left for St. P arris. T he next day at 6 o'clock Will Apple and Dave Knull and I started for Indiana with Jakes tea m a nd my horse with a saddle aand bridle on it. On the 16th we wanted to g et to the Marion Pi ke at New Cumberland, but it was so dark and I was wal king ahead of the team picking out th e best place to drive. I slipp ed in a rut over boot top deep and got my feet wet. We got to W ill Appl es on the 17th in the afternoon. Jake and I was to look for a place for th em. They wa nted a 160 acre farm. We picked out three farms for them and w rote them. One place was NW Qua rter Sec. 16, Franklin Twp; another was 1 /2 NE Grand 1/2NW Quarter sec. Sims Twp; another wa s what was to become t he home place SE 120 SW of sec. 12, Sims Twp. They wrote back for the d es cription of the place and an estimate of the oak timber. On Sunday Dave Kn ull and I counte d it [the farm] as having over 25 trees that would measu re 3 feet and over at the stump; 25 t rees 2 feet and over and 30 tre es 18 inches or over. I sent this report back home and in a fe w days g ot an answer that they would be out to see the place as soon as they got t he corn pla nted. When they came, I took them in a 2 horse wagon to sever al places. They decided on the h ome place in sec. 13. They went back to O hio for the summer. Then Grandmother was very much d ispleased with what t hey had done and said that they would move out west and she would neve r see them again and s he had no way of traveling but with kit, the old gray mare and a carria g e. In September, Father and Oscar and Elmer came out with two loads of goo ds and to sow whea t and make some arrangements with Mrs. Mark to mo ve in September. When the wheat was sowed, t hey drove back to make the sa le to move. I went back to drive the milk cows for them. The sal e w as on Monday. We were going to start for Indiana on Wednesday but so ma ny people came in t o help us off that we did not get started that da y. On Thursday morning it was the same. The house was full but mother sa id if they got started , Cyrus and I would take the 6 head of cows a nd we were to go 1 mile or so and 1/2 mile eas t of St. Parris and wait f or the wagons. We got there ahead of them. They came in about an ho ur. Th ere we ate our first lunch at the Apple schoolhouse. We started again a nd drove west o f Picqua for the first night. Saturday we at sundown w as 2 mile NW of New Cumberland and th e hash box was empty. It was filled at Union City las t. We could not get anything at New Cumb erland so we decided to dri ve to Jonesboro, Indiana for more hash and stay overnight. We go t to 3 Jo nesboro at 6:30 all hungry and tired. Daddy and others went in a sto re to get food fo r supper and breakfast. Anna hollered and called at t he top of her voice. The old hound was t ied under Oscar's wagon and he be llowed and made everything attractive for the loafing popula tion which tu rned out in force to see what was taking place and to ask all kinds of que stion s imaginary as to who we were and where we were going and ready to g ive all kinds of advice . One man told us to go 1 mile N and 1/2 mi le W on the Kokomo Road and stay overnight as th e stock was about worn ou t. We went to the schoolhouse as he said. There we let everything re st wh ile we ate lunch. Then we decided to go home 10 more miles. Cyrus was a ll in so he got o n the wagon. That left me with the cattle. The wagon dro ve on and was soon out of sight. Th e cattle were foot worn and tired whi ch made them hard to get along. The wagon got home at 1: 00. I drove the c attle W to Roseburg Road, then N to Roseburg, then W home. When I got 1 /2 mi le W, I was all in as I had to heel every cow or they would lay do wn for me. When I got to th e woods I decided we would take an hours res t. That was 1:30 but I forgot and went to sleep s etting in a fence corne r. When I woke up daylight was peeping over the eastern horizon. I soo n h ad the cows on the move again. I did not get home again intil 7:30. I a te my breakfast, sh aved, cleaned up, ready for the night, then I laid down for a rest. But, they did not call m e and I overslept again, never w aked until after dark. I had an appointment with a girl at Sw ayzee. All I could do was go to sleep aga in and forget it and square myself wilth her for nex t Saturday evening. Kidd charged th at on 22 Dept 1849 he suffered physical abuse and was dragged by the defe ndants through town to jail and kept in a dungeon for 24 hours. The men we re found guilty of false arrest and fined $25 in damages.

Joseph Calland was appointed to rep lace Taylor as Lorenzo's guardian on 17 December 1865 in Franklin Count y, Ohio. (Research):Beers bio pg 737 JOSEPH KELLEY, retired farmer; P. O. St. Paris. Among the pioneers of Jack son Township, our subject deserves place in the front rank. He is the olde st native of the township now living, and said to be the first white ma le child born in it, although he doubts it himself. He is a son of Samps on and Margaret Kelley, whose history is noted in the sketch of William Ke lley. Joseph was born Dec. 14, 1808. He remembers seeing Hull's ar my as it passed through this country. His mother died when quite young, a nd his father when be was about 18 years of age. He learned brick-layi ng in early life, which he followed till health and strength failed. He en tered eighty acres of land, and began right in the woods, working at his t rade during the summer season, and clearing after night and through the wi nter. He worked for 25 cents per day, when they had to pay 371 cents per y ard for calico. Although times were very hard, by honest industry and econ omy they kept themselves above want, and never suffered for the necessari es of life. They still occupy their first home, and are comfortably situat ed for old age. For over fifty years they have enjoyed each other's socie ty in wedded life, having married May 11, 1830, Mrs. Susan Kelley, former ly Miss Susan Downey, was born in Virginia Aug. 4, 1806. This union has be en blessed with four children-Tabitha A., Sampson E., Frances M. and Ma ry E. Tabitha and Frances M. both died of scarlet fever when young. Mrs. K elley is a member of the M. E. Church.

Beers bio pg 737 WILLIAM KELLEY, retired tanner and harness-maker; P. O. Christiansburg. Am ong the pioneers of Champaign Co., the gentleman whose name heads this ske tch deserves mention in this work. He was born April 18, 1810. His parent s, Sampson and Margaret (Brown) Kelley, came to Jackson Township, Champai gn Co., from Virginia, about 1806. According to the best information we c an get, they have the honor of being the parents of the first white male c hild born in Jackson Township. Sampson was a weaver by trade; he entered e ighty acres of land, and set to work to subdue the forest and secure a com fortable home. During the fall and winter seasons he worked at his trad e. Mrs. Margaret Kelley departed this life in 1814, and he in 1829, but h ad married for his second wife Mrs. Rebecca Pence (formerly Miss Rebecca D avis), by whom he had four children; one only survives at present. Eight c hildren were the issue of the first marriage. One died in infancy, one abo ut 45, and another upward of 50. Five are still living, the youngest bei ng past 69 years of age. At the age of 15. William commenced an apprentice ship at tanning, which trade he followed for about twenty-five years whe re he resides, in Addison. In 1847, he commenced harness-making, whi ch he followed till about twelve years ago ; he quit his trade and boug ht a farm, and has since lived rather retired. He has served his townsh ip as Trustee four years, and has been Postmaster for about eleven year s. His marriage with Nancy Strain was celebrated Aug. 11, 1831. For almo st half a century this union has lasted, and has been blessed with elev en children; eight survived their infancy and grew to maturity, viz. : Edw in, Semantha A., Margaret E., Angeline, Isabel, Louise and Emma (both dece ased), and Oliver H. Mrs. Nancy Kelley is a native of Virginia, but the da te of her birth is not known. It is supposed to be in the year 1813.

(Research):Record Book 16, Page 460 - Filed 22 April 1840 - Bill of Interpleader Jo hn West, Administrator of Sampson Kelley Vs Jacob Baker et al SampsonKelly married Rebecca Pence, widow of Lieutenant Pence of the la te war. By an act of Congress, 1 June 1813, the widow became entitl ed to a portionof Jacob Pence's pay which was collected by one Henry Nort hup, one half pay for five years service. The judgement against Northu p, $713.43, was obtained by Kelley in his lifetime. An agreement (mark ed "A" with the suit), dated between the heirs of Sampson Kelly, dat ed 31 October 1831, stated that Rebecca would receive the widow's portio n, Sampson Kelly's heirs were to receive $10 each, except Sarah Jane & Reb ecca Ann Kelly who would receive two equal 1/9 parts each, and the balan ce was to be paid to Ruth Pence, heir of said widow. After the payments w ere made West settled the probate of Kelly, but since then a further s um of $422 has come to the estate. John West made a partial distributi on of the second amount according to the agreement, however, a problem h as arisen which he wants the court to settle. There is $388 of the $422 l eft for distribution. ' The portions that have been distributed were to-R ebecca Kelly, Ambrose & Nancy Grafton, children of Lewis Darnall ' Sarah J an; Kelly and Rebecca Ann Kelly. Sampson Kelly's legal heirs: Joseph Kell y;William Kelly; Robert Kelly; Ambrose Grafton & his wife, Elizabeth; Ezek iel Darnall & his wife, Mary; Abimelech Darnell & his wife, Nancy; Margar et Darnall, formerly Margaret Kelly who married Lewis Darnall, who died le aving the following children: Wesley Darnall, Joseph Darnall, Sampson Darn all, and William Darnall; Sarah Jane Kelly (minor) and Rebecca Ann Kelly ( minor). By the end of the case, Henry T. Kyle was appointed guardian ad l item for only Rebecca Ann Kelly. "The only child and heir of said widow P ence, by her first husband, Lieutenant Pence, is their child Ruth Pence me ntioned in said contract marked A and now the wife of Jacob Baker." Conten ts of an answer filed 12 October 1840 by Jacob and Ruth Baker: Jacob Penc e, father of Ruth was believed killed at the Battle of Brownstown in the s ervice of the United States in August 1813 and Rebecca married Kelly cir ca I September 1818. Ruth had received $244.25 for "half pay," but she w as not sure that she had received the total amount that she should. The o ther defendants neglected to plead or answer.

(Research):CHANCERY RECORDS OF THE COURT OF COMMON PLEAS Record Book 14, Page 555- Filed 25 July 1836 William West vs Joseph Kelly et al Before 1818 (under the 1800 Land Act) William West c ould not purchase less than 160 acres and therefore, jointly purchased wi th Sampson Kelly, the south-west quarter of Section 3 Township 3 Ran ge 11 (Jackson Tp.). William occupied the west half and Sampson the east h alf of the quarter. The patent was issued on 27 June 1816. On 21 August 18 18 William West filed a deed (Champaign County Deed Book D, Pages 368-36 9) granting the east half of the land to Kelly, however, Kelly did not fi le a deed granting the west half to West. Sampson Kelly died in 1827 or 18 28 leaving the following heirs: Joseph Kelly; William Kelly of Illinois; R obert Kelly; Mary wife of Ezekiel Darnall; Elizabeth wife of Ambrose Graft on; Nancy wife of Alemaleck Darnall; Margaret deceased wife of Lewis Darna ll left the following children: Wesley Darnall, Joseph Darnall, Sampson Da rnall and William Darnall; Sarah Jane Kelly and Rebecca Ann Kelly. Elizabeth's estate is recorded in Champaign Co. Minute Book 19, Pa ge 312, 1846. By his marriage, William had acquired interest (child's portion) in the land of Jose ph Sipe. On 7 August 1845 he petition the courts to settle the esta te of Joseph Sipe in William Davis vs Christian Sipe & others; which ca se was settled on 3 April 1846 (Chancery Book 20, Pages 292-296 ). On 4 April 1846 he again petitioned to sell the land and use the m oney to purchase .. wild land" (area not located) in William Dav is vs Frances Elmira Davis & Others; which case was settled on 16 Nov ember 1846 after the sale of the land. For $1,000 he purchased the so uth half of the north-east quarter of Section 1, Township 3, Ran ge 11 (Jackson Tp.), 80 acres; from Noah and Catharine (Sipe) Kite (C atharine's portion) (Book S, Page 227). Then he purchased from Andr ew Davis and Frances (Sipe) Davis, (Frances' widow's portion) for $3 00 interest in the north-east quarter of Section 1, Township 3, Ran ge 11 on 28 July 1846. (Book T, Page 153). In Record Book T, Pages 1 52 and 153 we f ind that William B. Davis and his wife Elizabeth Ja ne (who had been dead since 1842, t@erefore, he must have sold in h er behalf) sold 80 acres of the south quarter of the north-east quart er for $1,000; one-third of the north-east quarter for $300 and the n orth half of the north-east quarter for $300 of Section 1, Townsh ip 3, Range 11 (Joseph's Sipe's land in Jackson Tp.) to Benoni Barne s. On the same day he sold to Benoni Barnes his children's intere st in half of the north-east quarter of Section 1 (Book T, Page 15 4) - all dated 16 September 1846. After this time, 1846, Willi am is no longer found in Champaign County records.Surely, he took t he widow's dower interest to Frances Sipe Davis in Grundy Co. MO, b ut where did he settle to purchase "wild land"? According to the wi ll of Andrew Davis Senior, William Davis was to receive the homeplac e, or at least the house. A deed was not located whereas William disp osed of this land. However, the deed index indicates that William Dav is and "Jane Eliz." his wife, did convey 2 acres located in the we st half of SW1-4, Section 4, Township 3, Range 11 (Jackson Townshi p) to John Fitzpatrick (Deed Book T, Page 447). This last deed nee ds to be checked to determine if the index lists the correct locatio n. William B. Davis and Francis Davis, his daughter, are the peop le who are listed in Champaign @ounty Deed Book X, Page 73, where by William received $93 dollars from James and Francis Hendrick. Will iam may well be the "William V. Davis of Wayne County, Indiana" w ho purchased the west half of the SE-4, Section 20, Township 3, Ran ge 11 (Jackson Tp.) from John Springer of Fayette County, Indiana (Ch ampaign Co. Deed Book U, Page 494). William "V." sold this land to Be noni W. Robbins (Champaign Co. Deed Book U, Page 495). According to t he 1850 Indiana Census Index, one William V. Davis was to be found li sted on page 70, Medina Township. I did not find this entry on the ce nsus film. Champaign County, Ohio, Chancery Book 15, Pages 4-7 is a c ase of John Blue, Plaintiff vs Christian Sipe, Henry Sipe, Amos Sip e, Joseph Sipe, John Sipe, Sarah Sipe, James Moore & Margaret Moor e, William Murphy & Mary Murphy, John Stull & Sarah Stull, Jacob Sip e, William Davis & Joseph Davis, Sarah Davis, Elmira Rolick & James R olick her husband, children of Wm. & Elizabeth Davis, his wife late E lizabeth Sipe dec'd, Noah Kite & Catharine Kite, late Sipe, George Ha rner/Havner and Susannah Havner his wife, Defendants (the heirs of Em anuel Sipe, deceased) - Petition to obtain a clear title. In 1846 William purcahsed 80 acres in jackson Twp from, from Noah and Caro line (Sipe) Kite (Catherine's pprtion of her father's estate_ 7/28/1846-Pu rchased from Andrew Davis and Frances (Sipe) Davis (Frances widow portio n) for $300 interest om the NE 1/4, S1, T3, R11.
7/28/1846 William B Davis and his wife Elizabeth Jane (who had been dead s ince 1842, therefore he musrt have sold on her brhalf) sold 80 acres for $ 300 (Joseph Sipes land in jackson Twp) to benoni Barnes.
By his 8/7/1845 marriage to Elizabeth, minor heir of Joseph Sipe, Willi am acquired interest in the land of Joseph Sipe. He petitioned the cour ts to settle the estate of Joseph Sipe in the Case William Davis vs Chrris tian Sipe and others. The case of William Davis vs Christian Sipe was sett led on 3 April 1846. The estate was incumbe red with the dower estate of Frances Sipe (her whereabouts and married na me are not mentioned). William wanted to sell the land and invest the mon ey in wild land” which was selling for $1.25 an acre (the area of this bar gain land was not mentioned). The suit was settled in Davis favor.

Her age was 74 years and past She leaves an in valid husband and several children, all grown and married. Mr. ROLLER, h er husband has been lying seriously ill for many weeks and his death can a lso be looked for at any time. This good lady and mother was largely relat ed throughout Clark and Champaign counties, and was held in high este em by all who knew her.

Record Book 32 pg 581 Filed 13 Dec 1869 Petition to Partition Joel S Fuson, Guardian of Jasper Fuson vs Philander R Fuson & Amelia Ann Fuson Joel Fuson died circa 24 Nov 1862 and was seized of 241 acres located in t he NW 1/4 and the west half od the NE 1/4 of Sec 24 Twp 4 Range 12 (Harri son Twp). In his will, Joel left the land to his widow, Jane Fuson, for h er natural life or until she remarried. At the time of the filinf this sui t, Jane was deceased. Beers Champaign Co, History Harrison Twp pg473 EARLIEST SETTLEMENTS. In or about the year 1803, a solitary young man, accompanied only (we beli eve by the faithful horse he was riding, left the State of Virginia, pure ly through a spirit of adventure, and, crossing the waters of the Ohio, en tered the Buckeye State. His saddle-bags were filled with white seed cor n, which was dropped, on the (blazed) wayside as he rode along. To h im is attributed the introduction of white seed corn into the Western soi l, and the name of Fuson corn has become a household word in every Weste rn State of the Union. Fuson came to Champaign County in 1804, and entered a part of Sectio n. 24 in this township in 1808. History records him as the first white m an who settled in Harrison Township. He was elected Trustee at the first T ownship election, and was continued in that office for a number of year s. He was a zealous worker, an enterprising citizen and a kind neighbo r. Of the children (we could not learn the date of marriage or maiden na me of wife), the following are living Lucinda married John Terrel, and resides in Missouri; William resides in C alifornia; James resides in Iowa; John is a resident of Indiana; Jeremi ah has taken up his abode in Missouri. Hannah married Alexander Pitman ; a fter his death she married Ebenezer Pitman, whom she survives also ; s he is living in this township. Artie married Burke, living in the West; Ce lia (now Mrs. ---- Speece) resides in the West. Fuson's wife died while he was yet in the vigor of manhood. He was unit ed in marriage, some time after the death of his wife, to Jane Johnso n. Of this marriage, the following children, yet living, were born .
Joel Fuson and his four brothers were pioneer preachers. Jeremia h, Samuel and james were in the Christian Church. William was a regular mi ssionary Baptist. Joel preached the tenents of Union Baptist, later call ed the Free-Willed Baptist. Little was found concerning Joel's work as a m inister other than he was regularly ordained and was an early pioneer pre acher. The Rev War Pension Records show that Joel Fuson, a Baptist Clergym an , testified as to his fathers credibility and standing on William Fuso n's application for Rev War pension in 1832.
Joel was supposedly buried on the John Russell Farm, a mile from We sley Chapel, one mile south and a half mile west of the location of Gla dy Creek Church. Glady Creek Church has long since disappeared. It sto od on the south-west corner of the intersection of the Wesley Chapel and S pring Hill Roads, now and open field. On a trip to this locality Sept 1 3, 1935, this author visited several cemeteries and private burial plot s, without locating Joel's grave, which is probably unmarked. David Fus on of DeGraff, Ohio, grandson of Isiah Fuson, and the oldest living Fus on in the locality is authority for the location of Joel's grave. (Dav id Fuson died June 12 1939).
Concerning Bethamia Bramble, Joel's Virginia bride, we learned littl e. Sometimes after her death in 1833, Joel married a second time, a daught er of a prominent Wayne township family, Jane Johnson by name. Jane Johns on Fuson's grandfather, William Johnson, was a native of Maryland, but ca me from Western Pennsylvania to Ohio in 1804, where his wife died in 18 17 and his death followed in 1820. William Johnson left four sons, Jaco b, Barnett, William and Otho. William owned 337 acres of land in Wayne tow nship on the present site of Mingo and he and his family were the first wh ite settlers on the north side of Mingo Valley in 1806. Jane Fuson's fath er was William's oldest son, Jacob Johnson, born July 27, 1766 in Marylan d, died in 1845 Champaign County, Ohio. He married in 1790 Martha Boggs Mc Farland, a widow in Virginia. Jane's grandfather Boggs was a native of Vir ginia, although her mother, Maretha, was born in Pennsylvania, Oct 20, 17 74 and died in Ohio 1854. Jacon and Martha Johnson had eight children: mar y, William, Lavina, Hiram, Belson B, Jane, Alfred,and an infant. Jacob bou ght 478 acres of land in Mingo Valley in 1804 or 5, at $2.50 to $4.00 p er acre. The Indians had farmed it the year before. From Beers histo ry of Champaign County I learned that jacob and his three sons later own ed 1900 acres, at one time valued at $120,000. The Johnson family burial g round was on the Mingo Valley Farm, but we did not learn where Jane was bu ried, nor the date of her death.
Joel Fuson's large family became widely scattered and not easily trac ed.

History of Shelby County - R. Sutton and Co., Philadelphia, 1883 p. 230 John C. ELLIOTT was born in Clark County. Ohio, October 6, 181 2. He is a son of Thomas and Martha ELLIOTT In 1817 his parents mov ed to Jackson County, Ohio remained until 1826, when they returned to Cla rk County. Mr. ELLIOTT remained on the farm with his parents until he arr ived at the age of twenty one years. His first business engagement was th at of making shingles, which he followed for several years. On the 9th d ay of August, 1835, he married Miss Sarah CLATON, then of Clarke County, b ut a native of Greene County, Ohio. In the autumn of 1836 Mr. and Mrs. EL LIOTT came to Shelby County. He entered, made improvements, and settl ed on eighty acres of land in Section 9, Jackson Township, on which he liv ed, and followed farming as his vocation until September, 1869, when he mo ved to Montra, same township where he is now residing. On the 16th of Nove mber, 1870, he engaged in the mercantile business in Montra, which he h as had been conducting with success. He also owns a large farm in Secti on 9, Jackson Township. By his union with Miss CLATON he reared a fami ly of nine children, viz., Thomas, Margaret, William C., Clark, Lewis, Dru scilla, Martha, George W., and Sarah, all of whom are yet living except Wi lliam and Margaret. William C. died at Meadow Bluff, Virginia July 20, 18 62, while serving in the late war. Mrs. ELLIOT died June 5, 1860. On t he 26th of October, 1862, Mr. ELLIOT married Mrs. Martha PATTON, nee STEPH ENSON, then of Logan County, Ohio, but a native of Clark County Ohio, whe re she was born August 9, 1826. By this union he has three children, viz ., Angeline, Charles, and John. He served as justice of the peace of Jack son Township about eighteen years, and as commissioner of Shelby County tw elve years. Captain C. ELLIOTT, son of John C. and Sarah ELLIOT, was bo rn in Jackson Township, Shelby County, Ohio two and a half miles northea st of Montra, on the 27th of October 1842. He was brought up on a farm a nd has made farming his principal avocation. January 15, 1868, he marri ed Miss Jennie N. STALEY, of Jackson Township, this county, who was bo rn September 13, 1843, daughter of John and Catharine STALEY, by whom he h as two children, viz, Ada O. and Grace C. In 1870 he purchased and mov ed on the farm in Section 19, one mile south of Montra, on which he is n ow residing. He served as clerk of Jackson Township one term.

John C. ELLIOTT, a pioneer resident of Shelby County died at h is home in Montra shortly after noon today. He died from the effec ts of a stroke of paralysis which he had Friday December 27. Mr. ELLIO TT is one of the oldest residents of Shelby County. He was over 90 yea rs of age and had resided in Shelby County since 1835. Mr. ELLIOTT was bo rn in Clark County, Ohio October 6, 1811. He lived there until he was 34 y ears of age when he came to Shelby County. The year before coming to th is county he was married to Sarah CLAYTON, and they had 10 children. Mr s. ELLIOTT died in June 1860, and in June 1862, he was married to Martha P ATTON who survives him. To the second marriage three children were bor n. He has 6 sons and 3 daughters still living. They are Thomas ELLIO TT of Waynesfield, C.O. ELLIOTT, Louis ELLIOTT, Charles ELLIOTT, and Jo hn ELLIOTT. Mrs. N.B. AIKEN of Jackson Twp., Mrs. Frank DAVIS of Salem Tw p., Mrs. Thomas HURT of Nebraska, and G.W. ELLIOTT of this city. When M r. ELLIOTT came to this county in 1835, he entered 80 acres of land in Jac kson Twp... between Jackson Center and Montra. When he located on the far m, there were only two houses within 5 miles of it, and he spent 6 wee ks in camp while building his cabin in the forest. He still owns the fa rm besides considerable other land, in addition, to farms given to ea ch of his sons. In 1869, he moved to Montra and engaged in the dry goods b usiness. He continued in this business until 1889, when he retired. He ser ved Shelby County for twelve years as Commissioner - two terms in 1845 a nd two terms in 1865. He was a Justice of the Peace in the township for ei ghteen years and was the first assessor ever elected to that township. T he arrangements for the funeral have not yet been made.

Sidney, Ohio February 28, 1911 ELLIOTT, Martha STEPHENSON was born in Clark County, Ohio near North Hamp ton, August 9, 1826, and died February 25, 1911 - aged 84 years 6 months a nd 16 days. On March 10, 1845 she was married to Frank PATTON, and they to ok up their residence near Quincy where they were engaged in the pursu it of farming for six years when Mr. PATTON was called to his reward. To t his union were born three children; one dying in infancy. Her only survivi ng daughter is Mrs. Frances ELLIOTT of Jackson Center. The deceased daught er was the wife of J.K. CLAYTON who resides near Jackson Center. Mrs. PATT ON was married to her second husband, John C. ELLIOTT, October 26, 1862. T hey moved just west of Jackson Center and were busy tillers of the soil un til 1870 when they went to Montra where Mr. ELLIOTT engaged in the mercant ile business until about eight years ago when Mr. ELLIOTT died. She then m oved with her son Charles a mile west of Jackson Center, where she lived u ntil her death. Of three children, two survive their mother. They are J. T. ELLIOTT of Dayton, Ohio and Charles with whom she spent her last year s. Those who knew Mrs. ELLIOTT loved her. She was naturally sweet-spirit ed and kind. Even to strangers, she seemed as a mother and friends and nei ghbors speak of her in the highest regard and respect. As a mother, none c ould be more tender or affectionate. Her aim was always to lead her childr en in the best and highest path. While she had many sorrows and her hea rt was sorely afflicted, yet in them all, she remained sweet and resigne d. Mrs. ELLIOTT'S last illness was brief and her suffering intense, but s he bore it calmly and patiently with the name of God of love and mercy up on her lips. As she departs this life, she leaves many dear ones in sorr ow and tears. Two sons, one daughter, thirteen grandchildren, and a lar ge company of living friends. The funeral services were held Februa ry 27 at 10:30 am in the Montra Methodist Episcopal Church, conducted by R everend W.M. KELLER. Interment was made in the Glen Cemetery at Port Jeffe rson.

A sensational divorce case has been filed in the common pleas cour t. It is styled Benjamin F Deal vs Emma J Deal, grounds adultry. In his pe tition, Benjamin sets forth matters smewhat in this manner. They were marr ied in November 1891, and shortly thereafter a child was born to them. Bef ore the marriage, she was asked who the guilty person was, and she replie d, " If you were stung by a hive of bees, could you tell which one did it? ". Benjamin was finally picked out and the ceremony was solemnized. In jan uary 1892 he was taken to the penitentiary for forgery, and before his ti me had expired, another child was born to his wife. In this case he accus es her of adultry with William McAlexander, of Adams two. Shortly before t he birth of this last child, she becan proceedings against Benjamin Deal f or a divorce, but circumstances necessitated her dropping the case. Now Be njamin thinks it is time Emma is sent on her way rejoicing.
