THOMAS JOHNSON TO JAMES BYRD
Registered 25 November 1823
This indenture made the 29th
day of October in the year of our Lord, 1823, between Thomas Johnson of
Nichols County in the State of Kentucky, by his attorney in fact, Aschal
Johnson of Hawkins County, State of Tennessee, of the one part and James
Byrd of Hawkins County, State of Tennessee, of the other part.
Witnesseth, that the said
Thomas Johnson, for and in consideration of the sum of Two Hundred and
Fifty Dollars to him in hand, paid the receipt whereof is hereby acknowledged.
Hath by these presents, doth grant, bargain, sell, align, endorse, ________
to the said James Bird, his heirs and ___________ forever, a certain tract
or parcel of land containing 80 acres be the same more or less ___________,
in the County of Hawkins on the waters of Big War Creek.
Bounded by lines beginning
on a Beech by the road leading from Cloud's Ferry to the Flat Gap in Clinch
Mountain. Said Beech stands at the mouth of said Bird's Lane and
near the north foot of War Ridge, running thence South 56 degrees, West
115 poles to a Sugar tree; thence South 17 degrees, East 20 poles to a
Beech and Ash; thence South 28 degrees, West 20 poles to a Birch; thence
North 68 degrees, West 78 poles to three Lynns; thence North 17 degrees,
East 10 poles to a Birch and Sugar tree; thence North 60 poles to a white
Oak; thence North 75 degrees, East 123 poles to a stake; thence South 28
degrees, East to the beginning.
Together will all &
singular the way, woods, water courses, mines and minerals, profits, commodities,
hereditments, appertinances whatsoever to the said tract of land belonging
_________ __________ appertaining the reversion and revisions remainder
__________ rents ___________ thereof and all the estate, rights ___________
__________ property claim and demand of him, the said Thomas Johnson, his
heirs __________ forever ___________ and to the same and every part
___________ thereof whether in law or equity, to have and to hold said
eighty acres of land with the appertences unto the said James Byrd, his
heirs, assigns forever against the lawful title claim and demand of the
said Thomas Johnson, his heirs, assigns and against the lawful title claim
and demands of every other person or persons whatsoever will warrant and
forever defined by these presents in writing __________ of the said Thomas
Johnson, by his attorney in fact, Aschal Johnson, to herewith set his hand
and seal this day and year first above written.
