Certificate thereon was duly Registered in the Registers Office in Book

In obediance to the annexed writ} James W. Doak Sheriff of Said County on the 2nd day of December 1845 attend by John Sockwell, Jesse Thompson, Robert Thomas, Thomas Sockwell, George Hufhines, Emry Wooters, Jacob Garinger, Thomas Cummins, Able Hufhines, Peter Hufhines, Jacob Hufhines, & David Brown, freeholders unconnected to Mary Isley widdow of Christian Isley Dec'd or the Heirs of the Dec'd by affinity or consanguinity & entirely disentrusted by me duly sommoned with Jesse Wheeler Surveyor came in proper person to a certain plantation whereof the said Christian Isley Dec'd died Seized & possessed in said County containing Two Hundred and Fifty Six acres more or less there being Two other tracts in the County of Orange, one of Two Hundred Acres and the other one hundred & fourteen acres more or less and the freeholders aforesaid being duly sworn & required to allott and set off to her the sad Mary Isley one third part in value of all the lands Christian Isley Dec'd died siezed & possessed did allott and set off to her the said Mary Isley the part exparte on of the aforesaid plantation in the County of Guilford Included & comprised of the following limits & bounds Begining at the stake Lewis Cobbs corner running south twenty decrees east one hundred and five poles to a post oak Cobbs corner thence east one hundred and twenty four poles to a red oak on Sockwell's line thence north one hundred and two poles to a post oak thence west one hundred and eight two poles to the beginning containing ninety acres more of less including the dwelling house or mansion in which Christian Isley Dec'd most generally dwelt next before and at the time of his death with all the out houses buildings & improvements thereinto belong or in any wise appertaining which being done the aforesaid freeholders have put the said Mary Isley in possession of the same in witness whereof, the freeholders have hereunto set their hands & seals this day & year first written

a petitioner} Petition for a years allowance

We the undersigned commissioners have been appointed by the County Court of Guilford to lay off a years allowance for Mary Isley out of the personal estate of her deceased husband; after being duly sworn proceeded to allot to her the following, to wit:

All the old corn on hand and what new corn & fodder that is growing on said plantation and some rent(?) corn all the wheat on hand supposed to the 75 or 80 bushels all the bacon laird & tallow that is on hand 18 hogs of her choice 2 bovines(?) her choice 2 sheep her choice what oats is on hand what hay is on the Cocklereas (Kachelriess aka Cocklereese, Cocklereece) place 4 stacks hay at the home plantation of her own choice all the rye, straw, and wool that is on hand all the cotton that is on hand & the growing crop of cotton all the cloth & yarn on hand all the truck(?) patches & garden what coffee & pepper is on hand all the flax and salt on hand soap & dried fruit on hand 25 gallon of Brandy & Barrel ale the poulty that is on hand one bushel of Flax seed what leather is due of Elisha Wharton one piece of sole leather on hand at home all the vinegar also one wheel & cards one bed of furniture to be her absolute property and finding that a complete allowance cannot be made out of the crop stock & provisions on hand we adjudge that the administrator pay to the widow in cash 25 dols all of which is respectfully submitted

Petition of Daniel Isley, Christian Isley, George Isley, Eli Isley, Hanner Isley, Rosa Isley, Polly Isley, Margarette Isley, Sally Isley, and Peter, Elizabeth, Tempy, and Eliza Isley infants who petition by their next friend Peter Isley }

Ex parte } for partition of Lands

Your Petitioners aforesaid Shew unto your Honor that they are the children and heirs at law of Christian Isley, who hath lately died in our County of Guilford intestate, seized and possessed of some 448 acres of land to wit the home place in Guilford County containing 234 acres more or less on the waters of Reedy Fork, also two other tracts in the County of Orange on the waters of Haw River, one of 200 acres, the other of 114 acres; and that your petitioners are entiled to have said lands equally divided between them. Your petitioners therefor pray your Honor to order and decree a partition of said lands, and to appoint five suitable freeholders, whos duty it shall be to meet & after being duly sworn on their oathes to proceed to survey , value, platt and divide said lands you petitioners agreeably to law and to grant unto your peitioners all such other & further relief which the nature of their case may require

Ex Parte} Petition for Partition of Lands

This case comeing onto behind the Petition, the consent of the parties, and the agreement of counsel, it is decreed by the Court that the petitioners are the children and heirs at law of Christian Isley, who hath lately died in our County of Guilford intestate seized and possessed of Some 448 acres of land, to wit, the home place in Guilford aforesaid on the waters of Reedy Fork containing 234 acres more or less, also two other tracts in the County of Orange, one of two hundred acres, the other of 114 acres on the waters of Haw River, and that the petitioners are entitled to have said lands divided equally between them:

It is therefore considered ordered adjudged and decreed by the Court that John Sockwell, Jesse Thompson, Thos. Sockwell, Elisha Wharton, and Robert Thomas with the aid of a Surveyor, meet, and after being duly sworn to proceed to survey , platt, value, and divide said lands equally among the petitioners agreeably to quantity and quality taxing the more valuable lot or lots with the payment of such sum or sums of money to be paid to the lot or lots of inferior value as will make all equal. It appearing to the court that there is a widows dower on said lands it is considered that the said commissioners divide the lands not included in the dower into thirteen equal lots in manner aforesaid and also that part included in the dower into 13 equal shares as aforesaid, and that the said Commissioners report their proceeding in writing to the next Term of this Court.

To John Sockwell, Jesse Thompson, Thos. Sockwell, Elisha Wharton, and Robert Thomas, Greeting:

We reposeing especial confidence in your honesty and integrity in answer to the prayer of the petitioners hereinafter mentioned and in obediance to a decree of Guilford Superior Court of Law at Fall Term AD 1845 do hereby empower and require you after being duly qualified to meet on the lands of Christian Isley described in the petition as lying in our County of GUilford and the County of Orange on the waters of Reedy Fork and Haw River, and after being duly qualifed, proceed with a suiable surveyor to survey and divide the same among the Petitioners to wit: Daniel Isley, Christian Isley, George Isley, Eli Isley, Hanner Isley, Rosa Isley, Polly Isley, Margarette Isley, Sally Isley, and Peter, Elizabeth, Tempy, and Eliza Isley infants who petition by their next friend Peter Isley, and the same in equal shares in point of value as nearly as possable to allott chargeing the more valuable dividends with such sums or sums as will make all equal to make full and fair survey's and platts of the whole and of each lot appropriate to each of the aforesaid Petitioners and a full and fair report of your whole proceedings allotments, surveys and platts to make a return in writing & e. under your hands and Seals to the next time of our said Court to be held on the 3d monday after the 4th monday in March 1846.
