(Richard Shut'es wife, Sarah, is also on the deed, and Joseph Drake is called "their son-in-law.").8
- He served during at New York Provincial Militia in 1700. As a Leiutenant in a company of foot, in the town of East Chester.9
- He appeared on the census of 1710 at Eastchester, Westchester Co., New York, as Joseph Drake, Senr., age 47.10
- Joseph Drake, Sr. of Eastchester, conveyed 1709/10 at Fairfield, "land my brother Samuel gave by will to my son Joseph and sold by latter to me."3
- Joseph Drake is named in his son Joseph Drake, Jr.'s will dated 20 Nov 1711.11
- His will was dated on 10 March 1731 proved 12 May 1732. Joseph Drake of Eastchester. Leaves to his wife Sarah, the use of lands and house for life and then to son Jasper, who has also two home lots in Eastchester, bounded north by James Dillpeck, east by road, south by Nathaniel Tompkins, west by Joseph Fowler. Also 16 acres at a place called Hutchinsons, bounded east by the road to the Hammock, south by land formerly of Nathaniel Tompkins, west by Nehemiah Palmer, north by Little Rattlesnake Brook. And a piece of salt meadow opposite the mouth of Rattlesnake creek. To son Joseph "a piece of land called Colonels," bounded west by the road to Hutchinsons, south by road, east by Nehemiah Palmer. Also 13 acres bounded west by Hutchinsons creek, north by land formerly of Nathaniel Tompkins. Also half of my priviledge in the Old Patent of Eastchester. Also a small piece of meadow at Great Hammocks bought of John Pickney, deceased. Legacies to daughters Mary Fowler, Sarah Slaughter, and Anne Fowler. Executors to sell six acres bounded north by Lewis Guion, east by the road to Nathaniel Tompkin's meadow, south by John Fisher, north by road. (Lib.2:275).12
- A biographical note to the abstract of the will of Joseph names him as the son of Samuel Drake who came to Eastchester in 1663 from Fairfield, Connecticut. Joseph's son, Jasper lived in New York and owned the lot where the U.S. Hotel Stands on the corner of Fulton and Pearl Streets (1898). (Early Wills of Westchester County).

- In 1832 Josiah Drake Jr. resided at Milton, Saratoga Co., New York; In a deposition dated 20 Oct 1832, Josiah Drake, Junior stated that he was at present a resident of the Town of Milton, Saratoga County, and that he was 59 years of age. The deposition was signed by J.H. Coe, Justice of the Peace. (This deposition is among a collection of letters and documents belonging to the descendants of Nicholas Brouwer and Sarah Drake, no further information is given in the deposition).1
- He appeared on the census of 8 August 1850 in the household of Jonathan H. Calkin at Milton, Saratoga Co., New York; Jonathan H. Calkin, age 44, born in New York. A carpenter, no real estate. - Josias Drake was baptized on 28 May 1682 at Amersfoort, Kings Co., Long Island, New York; sponsors Willem Brouwer, Elizabeth Brouwer (recorded at the Flatbush Church).3
- He possibly died before 23 February 1735 at Middlesex Co., New Jersey, intestate (see below).
- Also known as Josias Draatz.
- Three deeds found in Kings County Deeds vol.4 describe transactions involving the same piece of property. The property, a house and garden spot situate in the town of Flatlands in Kings County, was described as "bounded on the north by the highway, south and east by the heirs of Gerrit Coerten deceased, and west by Hermanus Hoogelandt, containing two acres be it more or less." On 18 July 1717 Rutgert Waldron of New York City, and his wife Cornelia, sold the property to Josiah Drake of Oyster Bay in Queens County for £85. Next, by an indenture dated 28 Aug 1716, the same Rutger Waldron and his wife Cornelia, sold this property to John Drake of Jamaica in Queens County for £85. This deed, which pre-dates the prior deed by almost a year, was not recorded until 9 June 1720. Finally, by an indenture dated 12 April 1719, Josias Drake of Flatlands, conveyed this property to John Drake of Jamaica for the same £85. By this deed, Josias signed his name as Ijoseijas Drake. It is not certain wether the Josiah/Josias Drake mentioned in these deeds is father or son.4
- On 23 Feb 1735, administration on the estate of a Josiah Drake of Middlesex Co., New Jersey was granted, "Int. of John Berrien, merchant, of Somerset Co., as administrator. Andrew Hay of Perth Amboy, innkeeper, fellow bondsman." (Lib. C, p.71). The only other Josias Drake known, who might have lived in Middlesex Co. at this time, would be his father, Josais Janzen Drats.5
- Josias Drake is NOT Joseph Driggs as proved by recent DNA testing of direct descendants of both Josias Janszen Drats and Joseph Driggs. According to published accounts of the descendants of Joseph Driggs, of Middletown and East Haddam, Connecticut (Driggs Family History, two volumes, 1959, and 1971) who contend that the Driggs family progenitor, Joseph Driggs was born Josias Drats/Drake, Jr., son of Josias "de Raet" and Aeltje Brouwer. This idea, however, has now been disproved. DNA test results (Dec. 2008) of a confirmed direct descendant of Joseph Driggs have been compared to the previously acquired DNA test results of a number of different descendants of Josias Janszen Drats. It is clear that any common ancestor, shared between the Driggs and Drats/Drake families, would have lived thousands of years ago. It is very clear, that a common ancestor could NOT have lived within the past eight to ten generations or within the past 300 years (see footnote).6
