Ludwig Brandt, John Hammond and David Brandt to Elizabeth Cain

This indenture made this seventeenth day of November in the year one thousand eight hundred and twenty seven between John Hammond and David Brandt executors of the Last Will and Testament of Lewis Brandt Sr. deceased late of Perry County Ohio of the one part and Elizabeth Cain of the other part. the said Elizabeth Cain being the daughter and one of the legatees of the said Lewis Brandt Sr. dec.d. All of the County of Perry except David Brandt he being of the county of Fairfield and State of Ohio. Witnesseth that whereas the said Lewis Brandt deceased by his last will and testament duly executed proven and recorded in the Court of Common Pleas of said county of Perry did direct that division and allotment of real property being the North West quarter of Section fourteen Township sixteen Range sixteen in said county of Perry should be made among the legatees named in said will in the proportion therein named and did likewise by said will direct the executors therein named to make such division and allotment of said land and to make deeds therfore to the respective legatees. Now therefore this Indenture witnesseth that we the said executors John Hammond and David Brandt as aforesaid having made the said division and allotment by virtue of the power in us vested by said will, have given granted aliened conveyed and confirmed and by these presents do freely fully and absolutely give grant alien convey and confirm unto the said Elizabeth Cain during her natural life and at her death to decend to her children- Mary Eliza Louis James John and Isaiah and any children said Elizabeth may beget according to the said will all the following described tract of land being the land bequeathed to her by said will. And is bounded and designated as follows, beginning on the south line of said quarter section ten chains east of the south west corner of said quarter section. Thence running North ten chains east twenty five chains south ten chains west twenty five chains to the place of beginning containing twenty five acres. To have and to hold the above granted and conveyed premises and all the privileges appurtenances and commodities to the same belonging or in any wise appertaining to her the said Elizabeth Cain to her own proper use and behoof as a good estate in fee till descending to her heirs as a good estate in fee simple agreeably to the will of said Lewis Brandt deceased. In testimony whereof we the said John Hammond and David Brandt executors as aforesaid have hereunto set our hands and seal this day and year first above written. This indenture made this twenty sixth day of June in the year of our Lord 1838 between Abel J. Cain and Sarah his wife ?? in the County of Ross and state of Ohio of the first part and Edward Corville of the same county and state aforesaid of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of three hundred dollars lawful money of the United States to them in hand will and truly paid by the said party of the second part, the receipt whereof hereby ? ? ? bargained, sold, aliened released, conveyed and confirmed and by these presents do grant bargain sell alien, release convey confirm ? unto the said party of the second part ? ? and assigns forever, all that ? tract a parcel of land lying and being in the County of Perry in the State of Ohio and more particullarly designated and described as being the west half of the Southeast quarter of Section No. 18 in Township No 13, of Range No 14 in the Zanesville Land District. And all the right, title interest claim and demand of them the said party of the first part of in and to the said premises and every part thereof. Together with all and singular the privileges appurtentances to the same belonging or in any wise appertaining. And the ? ? and ? ? ? To have and to hold the premises hereby bargained and sold or meant or intended so to be with the ? ? ? ? ? ? ? proper use and ? of the said part of the second part ? ? and assigns ? And the said party of the first part for themselves their heirs executors and ? do promise, convenant and agree to and will and the said part of the second part his heirs, executors and assigns that they are the true and lawful owners of the premises hereby granted and have good right full power and lawful authority to sell and ? the same in manner and ? aforesaid And further that they the said party of the first part and their heirs, executors and administrators will warrant and forever defend the aforesaid premises with their appurtenances; and every part and parcel thereof unto the said party of the second part his heirs and assigns, against all persons claiming. or to claim by, from or unto them. or any of their ? from or under any other person or persons whomsoever.
In witness whereof the said Abel J. Cain together with Sarah his wife who hereby relinquishes her right of dower in the premises have hereunto set their hands and seal the day and year first above written

Before me Peter Patterson a Justice of the Peace within and for the said County personally appeared Abel J. Cain together with Sarah his wife the within named grantor and acknowledged the above deed of Conveyance to be their voluntary act and deed for the uses and purposes therein mentioned. And the said Sarah wife of the said Abel J. Cain being examined separate and apart from the said husband, and the contents of said deed being made known and explained to her, declares that she voluntarily out of her own free will and accord without any fear or coercion of her husband did and now doth acknowledge the sighing and sealing ?

Perry Co. Ohio, Land Deeds- LDS microfilm # 0911143-- Vol P, page 214-- May 21, 1844 To all to whom these presents shall come Greeting. Whereas at the September term of the court of Common Pleas within and for the county of Perry and State of Ohio A.D. 1844 in ? petition for the sale of real estate, wherein John W. Davis as Administrator of Daniel Kishler late decd. of said County was petitioner and Mary Kishler, Emily Jane Kishler and Mary E. Kishler (widow and heirs at law of the said Daniel Kishler) were respondents the said John W. Davis as administrator of the said Daniel Kishler was ordered to sell at public auction a certain real estate of the said intestate hereinafter described and whereas the said administrator having duly advertised said real estate did on the sixteenth (16) day of March A D 1844 sell the same at public auction that is to say that the said John W. Davis being the highest and best bidder for said real estate the same was knocked off to him and he therefore become the purchaser for the sum of four hundred and sixty seven dollars, which sale was afterwards at the April term of said court confirmed and said administrator ordered to execute and deliver a deed in fee simple to said purchaser for the premises so sold. To wit- the west half of Tn lot No 142 and the whole of Tn lot no. 140 in the town of Somerset in said county of Perry Ohio. Subject to the dower estate of said Mary Kishler, widow of the said Daniel Kishler as aforesaid all of which will ? fully appear refference being had to the records of said court. Now therefore I the said John W. Davis administrator of the said Daniel Kishler as aforesaid, in consideration of the premises and by virtue of the powers in me vested by law do by these presents grant, bargain, alien and convey to the said John W. Davis (purchaser as aforesaid and to the heirs and assigns forever the said tenements so sold as aforesaid, and which are bounded and described as follows to wit-- being the west half of Tn Lot 142 and the whole of Tn Lot No 140 as aforesaid in the town of Somerset aforesaid and in the county of Perry and state of Ohio aforesaid-- with all and singular the appurtenances subject nevertheless to the incumbrance of the dower estate of the said Mary Kishler-- widow of the said Daniel Kishler, decd. aforesaid. To have and to hold the said premises to him the said John W. Davis and to his heirs and assigns forever. In testimony, John W. Mary Kishler to James Cain:

Be it known that I Mary Kishler in consideration of four hundred dollars to her paid by James Cain do hereby? and sell and convey to the said James Cain his heirs and assigns forever the following real estate viz. one fourth of twenty five acres of land willed by Lodwick Brandt to Elizabeth Cain, I being one of the heirs of said Elizabeth, said land being in the North West quarter of Section fourteen in Township Sixteen of Range Sixteen Chillicothe Land District and in Perry County Ohio and described as follows beginning forty rods East of the South West corner of said quarter in the South line, thence North forty rods, thence East one hundred rods thence South forty rods to South line and thence West one hundred rods to the place of beginning. Together with all the privileges and appertenances to the same belonging. To have and to hold the same to the said James Cain his heirs and assigns forever hereby covenanting that they own the property so conveyed in fee simple and without incumbrance and that she will warrant and defend the same against all claims whatsoever in testimony whereof the said Mary Kishler who hereby releases all claim hereunto set her hand and seal this eighteenth day of January 1850. Know all men by these presents that James Cain of the County of Perry and State of Ohio in consideration of the sum of four hundred to him paid by Mary Kishler do hereby bargain sell and convey to the said Mary Kishler her heirs or assigns forever the following real estate viz, one half of the undivided part of twenty five acres of land being of the land willed by Ludwick Brandt to Elizabeth Cain the half being my share and the share I purchased from Mary Kishler, said being in the North west quarter of Section fourteen in Township Sixteen of Range sixteen, Chillicothe Land District, Perry County Ohio. Land described as follows. Beginning forty rods east of the south west corner of said quarter on the south line, thence north forty rods, thence east one hundred rods, thence south forty rods to south line and thence west one hundred rods to the place of beginning. To have and to hold said land with the appertenences to the same belonging to the said Mary Kishler her heirs and assigns forever hereby ?? that I own the property so conveyed in fee simple and without incumbrance and that I will warrant and defend the same against all claims whatsoever. The conditions of this deed is such that whereas the said James Cain executed and delivered to the said Mary Kishler one note for four hundred dollars to be paid in two years dated this eighteenth day of January 1850. Now if the said James Cain his heirs assigns executors or administrators shall will and truly pay the aforesaid note according to the term thereof to the said Mary Kishler her heirs or assigns then the above obligation deed shall be void otherwise to remain in full force in law and virtue. Situate in Perry County Ohio and in Section 14, Township (16) Range (16) and described as follows beginning at the south west corner of what is know as the Cain tract of land thence running north four (4) chains and 80 links to the center of the road, thence 24 1/2 ? 5 chains and 14 links. Before me, Jacob Costigan a Justice of the Peace within and for said county personally appeared James Cain and Mary Cain his wife, the grantors in the above conveyance and acknowledged the same to be their voluntary act and deed. And the said Mary Cain wife of the said James Cain being examined by me separate and apart from the said husband and the contents of the above deed being made known and explained to her declared that she did voluntarily sign and seal and does now acknowledge the same, and that she is still satisfied therewith. Situate in the county and State aforesaid. Beginning at a post standing west 20 perches eleven and three fourth links from the South East corner of said quarter section thence west fifty one perches and five links to a post thence north thirty nine perches one and three fourths links to a post. Cain of the County of Franklin and State of Ohio the receipt whereof we do hereby acknowledge have remised and released and by these presents do remise, release and forever quit claim unto the said Abel J. Cain heirs and assigns the west half of the South East quarter of Section 18 Township 13 Range 14 in the Zanesville Land District to have and to hold the said premises with all the privileges and appurtenances in any wise appertaining to the same and I the said Solomon Sturges for himself, heirs, executors and administrators with the said Abel J. Cain and his heirs and assigns that I do and will warrant and defend the premises hereby conveyeth him the said Abel J. Fury of the county of Vinton and State of Ohio in consideration of the sum of eighty five dollars to us in hand paid by John Cain and Elizabeth Cain of the County of Vinton and state of Ohio have bargained and sold and do hereby grant bargain sell and convey unto the said John Cain and Elizabeth Cain their heirs and assigns forever the following premises situate in the county of Vinton and State of Ohio and bounded and described as follows to wit: The south half of the north west quarter of the north west quarter of section number one No 1 Township number eleven (No 11) of Range number seventeen (No 17) in the district of lands subject to sale at Chillicothe Ohio containing twenty acres and one one hundredth of an acre. To have and to hold said premises with the appertences unto the said John Cain & Elizabeth Cain their heirs and assigns forever, and the said Elijah W. This indenture made this ninth day of April 1856, by and between Isaac Brandt and Eliza Brandt wife of the said Isaac Brandt of the county of Perry in the state of Ohio, of the first part and Lewis Cain of the county of Perry and state of Ohio, of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of twenty seven dollars & thirty four cents to them in hand paid or secured to be paid, the receipt whereof is hereby acknowledged; have given granted, bargained sold released and conveyed and do by these presents give grant, bargain, sell release, convey and confirm unto said party of the second part and to his heirs and assigns forever the following described tract or parcel of land situated in the county of Perry in the State of Ohio as follows to wit: Being a part of the Northwest quarter of section number fourteen townships sixteen and range sixteen and more particularly described as follows: Beginning at a corner of a lot owned by John Green twenty perches west from the south west corner of said northwest quarter ? and quarter section line and ? thence west on said quarter section line ? perches and ? links to a corner of a lot owned by said Lewis Cain. Thence North forty perches with said ? lot to a corner, thence east ? perches, four and half links to a corner with the aforesaid John Greens lot ? south with his lot forty perches the place of beginning. Containing three fourth of an acre of land more or less. The State of Ohio County of Perry Be it remembered that on this 9th day of April 1856 before the undersigned surveyor within and for said county personally came Isaac Brandt and Eliza Brandt the grantors in the foregoing deed of conveyance and severally acknowledged the signing and sealing thereof to be their voluntary act and deed and the said Eliza, wife of the said Isaac, being by me examined separate and apart from her said husband and the contents of said instrument being by me made know to her according to law she did upon such separate examination declare that she did voluntarily sign seal and acknowledge the same and that she is still satisfied therewith. This indenture made this ninth day of April, 1856 by and between James Cain and Mary Cain wife of said James Cain of the county of Perry in the state of Ohio of the first part and John P. Huston of the County of Perry and State of Ohio of the second part. Witnesseth that the said party of the first part for and in consideration of the sum of two hundred dollars to them in hand paid or secured to be paid the receipt whereof is hereby acknowledged have given granted bargained sold released and conveyed and by these presents given grant bargain sell release convey and confirm, unto the said party of the second part and to his heirs and assigns forever the following described tract or parcel of land situate in the county of Perry in the State of Ohio as follows to wit Being apart of the north west quarter of Section Number Fourteen Township number sixteen and Range number sixteen and further described as follows to wit. Beginning at a corner on South boundary of said quarter Sec. forty eight purches east from the south west corner of said north west quarter at a stone ? the middle of the State road and running thence from said corner north twenty two and three fourth degrees west twenty perches and fourteen links with said state road to a corner thence north so far as to make a line running east forty perches from the south boundry of said quarter to a corner thence on said line east two purches and thirteen and a half links to a corner thence south forty purches to quarter section line to a corner and thence west 14 per to the begining containing five acres and twenty perches of land.

No. 2647 for one quarter section of Land in favor of the State of Illinois duly assigned by the proper authority of the said State to the Illinois Industrial University and by its officers to Abel J. Cain with evidence that the same has been located upon the North half of the North East quarter of Section Twenty four in Township Nine of Range Three East and the North half of the North West quarter of Section Nineteen in Township Nine South of Four East in the District of Lands ?? subject to sale in Junction City now Concordia Kansas, containing one hundred and fifty five acres and ten hundredths of an acre according to the Official Plat of the Survey of the said Land returned to the General Land Office by the Surveyor General. Now know ye that there is therefore granted by the United States unto the said Abel J. Cain as assigned aforesaid and to his heirs the tract of land above described to have and to hold the said tract of Land with the appurtenances thereof unto the said Abel J Cain as assignee as aforesaid and to his heirs and assigns forever. This indenture made the seventh day of march, A.D. 1880 by and between John T. Foreman as County Auditor of the county of Vinton, in the State aforesaid of the second part witnesseth, that whereas the Treasure of the said county of Vinton on the fifteenth of January, A.D. 1878 did sell according to the provisions of the stature in such cases made and provided to David McQuade the whole of the following described lot or parcel of land situated in the said county of Vinton for the taxes interest and penalty charged thereon for the year 1876 and also the simple tax for the year 1877 and listed for taxation on the Duplicate of said county in the name of Joseph Cain to=wit: The undivided half of the south half of the northwest quarter of the northwest quarter of Section number one (1) of Township number eleven (11) and of Range number seventeen (17) containing ten (10) acres more or less and the same having been duly advertised agreeably to law and the taxes interest and penalty due theron remaining unpaid on the fifteenth of January, A.D. 1878, the time appointed by law and also in and by said advertisement for the sale of delinquent lands set forth, the said ten acres were by Joseph P. Whittatch, Treasurer of said county on Fifteenth of said month of January aforesaid between the hours of ten o'clock in the forenoon and six o'clock in the afternoon of said day offered for sale at which time and place came David McQuade, who bid to pay said taxes interest and penalty, for ten acres being the whole of the said premises above mentioned and there being no bidder who would pay the taxes aforesaid for a less quantity the said ? 1/2 S 1/2 N.W.N.W. ten acres were struck off and sold to the said David McQuade for the sum of $2.00 being the amount of said taxes, interest and penalty which said sum was forthwith paid by said purchaser to said County Treasurer. And more than two? years having elapsed from the time of said sale and the land so sold as aforesaid not having been redeemed and the certificate of said sale, having been produced to me, Now therefore on the request of the said David McQuade. I the said John T. Foreman Auditor of said county of Vinton, in consideration of the premises aforesaid and by virtue of the authority in me vested by the laws of said State of Ohio do hereby grant and convey to said David McQuade the premises so sold as aforesaid. To have and to hold the said premises hereby conveyed with the appurtenances thereof to the only proper use and benefit of the said David McQuade his heirs and assigns forever.
