WILL OF DREWRY WALL

In the name of God, Amen. I, Drewry Wall, of the State and County aforesaid, being of sound mind and memory and understanding to make this my last will and testament in the form following, that is to say:

I do hereby devise and bequeath to my beloved wife, Marthy Wall, all my property both real and personal of every sort and quality for the space of her natural life and she, the said Marthy, is bound by the ties of nature and by this my Last Will and Testament to take care of my daughter, Elisabeth Wall, and that my said wife, Martha, hath the rite to use all or any part of said Estate for the comfort and benefit of herself and daughter or both and at any time when she may have any stock or property of any kind that she may think not profitable to keep she may dispose of the same as it may best suit her and the same shall be right and proper, and after the death of my wife, Marthy, the balance of the property that she has not consumed shall be distributed as follows:

First, my daughter, Elisabeth Wall, is to have twenty dollars and the remaining portion to be equally divided between the aforesaid Elisabeth and all the rest of my children share and share alike after the aforesaid twenty dollars to the said Elisabeth, and I do hereby appoint my son, Dread, and my son-in-law, David Green, to execute this my Last Will and Testament, whereof I have hereunto set my hand and seal to this my Last will and Testament, this eighteenth day of January, 1848.

Before me, Lewis N. Jones, Ordinary of the said County personally came Joshua Weaver into open Court, witness to the last Will and Testament of Drewry Wall, late of said County, deceased, and on oath specially being examined says that he signed said Will as a witness in the present of the testator at his special instance and request, who declared the same as his last Will and Testament and that he saw him seal, publish and deliver the said as such and that he saw Gaseway Page and Edward coffee sign the same as witnesses at the request of the testator and at the time of doing the same, the said Drewry Wall was of sound disposing mind and memory and that he executed the same freely and without compulsion so far as he knows and believes.

Sworn before me in open Court and subscribed this 7th day of June, 1858.

I, David Green, Executor by appointment of the Last Will and Testament of Drewry Wall, deceased, do solemnly swear that the foregoing sheet contains the last true will of Drewry Wall so far as I know and believe and that I will well and truly execute the same by paying first the debts and then the legatees contained in said Will so fare as his goods and chattels will thereunto extend and the law charge me and that I will make a true and perfect inventory of all such goods and chattels, so help me God.

The last Will and Testament of Drewry Wall, deceased, being proven this day in open Court before me upon the oath of Joshua Weaver. Ordered that the same be put upon the record of this court at the present term.

SUBMITTER'S NOTE: The exact date of death and place of burial for Drewry and Martha (Meeks) Wall are not known. Estate Voucher No. 17 which follows is payment to John M. Patison for work on a coffin on 20 March 1858, most certainly for Drewry Wall, and for a coffin for Martha Wall on 20 Aug. 1862. Because it is unlikely that coffins would have been made in advance and stored in that day and time, this is an indication of the date each of them died.

The first paragraph of the above will reads as follows: "I do hereby devise and bequeath to my beloved wife, Marthy Wall, all my property both real and personal of every sort and quality for the space of her natural life". No further action was taken on the Drewry Wall estate until after her death in August 1861.

Knox, (who) deposeth and saith that Samuel Deamond was to have a credit on a sertin note that Wall held against as principal; and William Wall, Security, of Three dollars and Ninety cents, which said Knox was to entry on said note and failed to comply some time about November 60 and said note is supposed to be in the hands of the Administrator.
