Last Will and Testament of Timothy Hunt

Timothy Hunt’s original will is handwritten and difficult to read. It has been transcribed here verbatim, including spelling and punctuation, and enclosed in question marks words I was unable to clearly decipher.


I, Timothy Hunt, of the Township of Jackson, County of Cambria, and State of Pennsylvania, Farmer, being of sound mind memory and understanding, do make and publish this my last will and testament, hereby revoking and making void all former wills by me at any time heretofor made.

It is my will that my beloved wife Margarit shall have ? int ? of my estate such share or portion, as she may be entitled to receive and hold under the laws of Pennsylvania.

ITEM After the payment of my debts, if any, and subject to the interest of my wife in my estate, I dispose the remainder as follows: I give, devise, and bequeath to my son Cornelius, the farm in Jackson Township, Cambria County on which I first settled, containing one hundred and fifteen acres more or less, adjoining land of George Varner’s heirs and John J. Horners heirs to have and to hold the said tract of land with the appurtenances, to my said Son Cornelius, his heirs and assigns forever. I also give devise and bequeath to my said Son Cornelius, the plows, ? harnesses ?, and other farming utensils, belonging to said farm.

ITEM I give devise and bequeath to Terrie Margaret Smith and Onissa Sarah Smith children of My daughter Abigail deceased, that tract of land in Jackson Township, Cambria County, known as the Saw Mill tract, adjoining lands of David Paul, Arthur Devlin, David Leidy, and Samuel Paul, said tract containing about one hundred and ninety six acres, to have and to hold the said tract of land to the said Terrie Margaret, and Onissa Sarah, their heirs and assigns forever.

ITEM I give devise and bequeath to my daughter Mary, wife of William Gillen, during her natural life, the tract of land situate in Jackson Township, Cambria County, and occupied by said William and Mary Gillin containing one hundred and nine acres and one hundred perches, adjoining lands of David Leidy, Arthur Devlin and others; and after the death of my said daughter Mary it is my will that the said tract of land shall go to the heirs of my said daughter Mary, in such shares as is provided by the laws of this Commonwealth.

As to any other estate real, personal, or mixed of which I may die seizin or possessed, and not herein before disposed of it is my will that the same shall be divided into three equal portions one of which shall go to my said Son Cornelius, another of which shall go to the within named children of my deceased daughter Abigail, and the other shall go to my daughter Mary, within mentioned, and to their heirs.

And I do hereby appoint my said Son Cornelius and Cyrus Elder Executors of this my last will and testament. ?In witness ? whereof I Timothy Hunt, the testator have to this my will, written on one sheet of paper set my hand and seal this 5th day of May A.D. 1873

I, Timothy Hunt, the within named testator do make and publish this codicil to be added to my last will and testament bearing date as above as the 5th day of May 1873 in manner following ? thus ?:

Whereas in and by my said will I devised to Terry Margaret Smith and Onissa Sarah Smith children of my deceased daughter Abigail, a tract of land in Jackson Township, containing one hundred and ninety six acres, and whereas I have sold said tract of land to Cornelius Hunt and George Gillen for the sum of Twenty Six Hundred Dollars in payments ? by judgement ?, and therefore my gift of said land to said children is hereby revoked and cancelled, and I give devise and bequeath to said Terry Margaret and Onissa Sarah the purchase money due to my estate upon said ? judgement ? to be equally divided between them, and if one shall die before coming of age leaving no child then the survivor shall have the whole and if both shall die before coming of age leaving no child, then said money shall be equally divided between the other sisiduary ? unclear ? mentioned in my will. Provided that so much of said money as may be needed may be expended for the maintenance of said children during their             ? unclear ? according to law. ? In witness ? whereof I have hereunto set my hand and seal this 9th day of January, 1874.
