Will of John BAXTER, Cauldwell, Derbyshire

Probate granted 28 December 1772, Lichfield

In the Name of God Amen  I   John BAXTER of Cauldwell in the County of Derby  Taylor   being weak in body but of sound and disposing mind memory and understanding   Do make and ordain this my last Will and Testament in manner and form following   That is to say

First I will and order that all my just Debts and Funeral Expenses shall be fully paid and discharged and from and after payment thereof and subject thereto I Give Devise and Bequeath all the rest of my Estates both real and personal of what nature and kind soever and wheresoever unto my dear and loving wife Ann BAXTER her Heirs Executors & Administrators for ever

And lastly I do hereby Constitute Nominate and Appoint my said wife ANNE Sole Executrix of this my Will hereby revoking all former Wills by me at any time heretofore made And do declare this to be my last Will and Testament In Witness whereof I the said John BAXTER have to this my last Will and Testament set my Hand and Seal the Seventh day of March in the Year of Our Lord One Thousand Seven Hundred & Seventy

Signed Sealed Published & Declared by the said Testator as and for his Last Will and Testament in the Presence of Us who at his Request and in his presence & in the presence of each other have inscribed our names as Witnesses thereto

Richard SMALBROKE Doctor of Law Vicar general of the Right Reverend Father in God BROWNLOW by divine permission Lord Bishop of Lichfield and Coventry To the Reverend James CHAMBERS       LLOYD and    PIPES   Clerks jointly and severally Greeting whereas it hath been alleged before Thonas WHITE Clerk Surrogate that John BAXTER late of Cauldwell in the County of Derby and Diocese of Lichfield and Coventry Taylor deceased duly made his Will in writing and therein named Anne BAXTER his widow his Sole Executrix thereof - We therefore authorise you jointly or severally to swear the said Execut~ according to the form of the Oath underwritten And We require you who execute this Our Commission to certify us under your hand the day and year the Execution thereof    Given under the Seal of Our Office at Lichfield -- the twenty eighth day of December in the year of our Lord 1772

The form of the Oath

Your Oath is that the writing now shewed unto you contains the last Will and Testament of John BAXTER late of Cauldwell in the County of Derby Taylor deceased so far as you know or believe that you are the Executrix named therein and will truly perform the same by paying his Debts and Legacies as far as his Goods Chattels and Credits will extend and the law charge you and that you will make a true Inventory of his Personal Estate and exhibit the same into the Registry of the Bishop's Consistory Court at Lichfield and render a true accompt thereof when you are thereunto lawfully required

So help you God &tc

This Commission was duly executed and the above named Anne BAXTER widow was duly sworn agreeable to the above written oath this twenty eighth day of December in the year of our Lord 1772 By and before me

At Lichfield 28 December 1772, Before the Revd Thos WHITE Clerk A:M: Surrogate:

On which date BUCKERIDGE Exhibited his Proxy for Anne BAXTER and made himself party for her, and alleged that John BAXTER late of Cauldwell in the County of Derby and Diocese of Lichfield and Coventry, Taylor whilst he lived, duly made his last Will and Testament in writing, and therein named the said Anne BAXTER his Sole Executrix. Wherfore the said BUCKERIDGE prayed the said Will to be proved in common fform of Law, and a Commission to be directed to the Rev Mr James CHAMBERS -- the Rev Mr LLOYD and the Rev Mr PIPE, Clerks jointly or severally for the Administration of the .... Oath to the said Executrix and on whim of the Commission duly executed the Probate to pass the Seal of Office, All which the Surrogate decreed - So I attest
