Last Will and Testament
of James Smith

I, James Smith, of the County of Tyler and State of Virginia, being of sound mind and memory, so hereby make my Last Will and Testament in manner and form following, that is to say,
1st, I desire that my executors sell a sufficient part of my personal property to pay all my just debts and funeral expenses.
2nd, I give and bequeath to my wife, Sarah, the use of the farm on which I now live, so long as she remains my widow, also all the farming utensils on the farm and the wagon, also two horses and the colt, also four cows and 2 heifers, also all the hogs on the farm and all the grain for the use of the family, both in the ground and in the barn yard and also the hay in the barn and meadow, also 24 head of sheep and all the geese and fowls on the farm, also all the goods and furniture in the house and all the pot mettle belonging to the place.
3rd I give to my son, Isaac R. Smith, seventy five dollars.
4th I give to my son, Lewis Smith, seventy five dollars.
5th I give to my son, William Smith, seventy five dollars.
6th I give to my son, Levi Smith, seventy five dollars.
7th I give to my son, Kenner Smith, seventy five dollars.
8th I give to my daughter, Eliza J. Smith, thirty seven and half dollars.
9th I give to my daughter, Mary Ann Smith, thirty seven and half dollars.
The above named seven heirs to receive their several portions after the sale of the farm, when the money is collected for the same. All the rest of my estate, both real and personal, of what nature or kind soever it may be, I desire may be equally divided among all my several children which I give to them, their heirs, executors, administrators and assigns forever.
And lastly I do hereby appoint my sons James Smith and Ralph Smith executors of this my Last Will and Testament, hereby revoking all other or former wills or testaments by me hertofore made.
In witness whereof, I have hereunto set my hand and affixed my seal this 14th day of November in the year of our Lord 1839.

To the Honorable J. Rees, Judge of the Probate Court in and for said County.

Your Petitioner the undersigned Charles Smith says that Basil Smith late a resident of Perry Township, said County died on, or about the day of April A. D. 1871, leaving an instrument of writing, a copy of which is hereto attached marked "Exhibit A" and made a part hereof purporting to be his last Will and Testament, That said instrument of writing was on or about the day of A. D. 1871, duly probated, as said last Will and Testament in said Probate Court, and a record of said probate was then in said Court duly made, Said original Will was at the time of said Probate duly deposited in said Court, and said record and said original Will was destroyed by the fire which consumed the Court House in said County on the 5th day of April A. D. 1875.

That the undersigned is one of the children of Basil K. Smith a son of the decedent, at the time of the death of said Basil Smith, as aforesaid the following named persons were his heirs, Basel K. Smith Son, Licking County, Ohio., Elizabeth Webb Daughter Licking County, Ohio.

Know all men by these presents that I, Basil Smith of the Township of Perry, in the County of Licking, and State of Ohio, considering the uncertainty of life, and being of sound mind and memory, domake declare and publish this my last Will and Testament.

First I give and bequeath unto my son Basil K. Smith and wife, if she shall become his Widow while she remains the same, and then to all of the said Basil K. Smiths lawful heirs whether many of few, all my lands, situated in Perry Township Licking County Ohio except fifty acres, deeded my by F. H. Southard and wife on the 13th day of February A. D. 1841 (see deed for description) which I do give and bequeath to my grand son Chester Smith a blind boy, to have and to hold the same during their natural life times.

Second I give and bequeathto all the rest of my children namely Elizabeth Webb, Polly Clagg, Jane Staggers, Thomas Smith, Nancy Staggers, Jacob Smith, John Smith, and Catharine Buch, each one dollar to be paid to them by my Executor, I further authorize my executor, at any time to exchange the land I give to my grand son with son Basil for an equal amount providing it accommodated the parties better.

Third I nominate and appoint R. H. Yates to be the Executor of my last Will and Testament.

A. I heard that father had the Will, and I thought I would look for it, one day and I found it in his coat pocket. I gave it to my Ma, then and she took it to the Cross roads where Mr. Cooksey was butchering and gave it to him and had him take a copy off of it.

Charles H. Kibler being first duly sworn, says that he was Counsel on the side of sustaining the Will of Basil Smith, Deceased, in an action brought by Thomas Smith et al, to contest it in the Court of Common Pleas and District Court of this county, the trail in the District Court being in 1874, and resulted in sustaining the Will.
That as such Counsel, affiant was at the time familiar with the contents of that Will, and now says, that according to his recollection of the contents of the Will, the paper hereto attached, and purporting to be a copy thereof, is a correct and true copy of the last Will and Testament of Basil Smith Deceased.

WILL OF BASIL SMITH
Know all men by these presents that I, Basil Smith of the Township of Perry, in the County of Licking, and State of Ohio, considering the uncertainty of life, and being of sound mind and memory do make and declare and publish this my last Will and Testament.

First: I give and bequeath unto my son Basil K. Smith and wife if she shall become his widow while she remains the same; and then to all of the said Basil K. Smith lawful heirs whether many or few, all my lands situated in Perry Township Licking County Ohio. Except fifty acres, deeded me by F. H. Southard and wife on the 13" day of February 1841 (see deed for description) which I do give and bequeath to my grand son Chester Smith a blind boy, to have and to hold the same during their natural life times.

Second: I give and bequeath to all of the rest of my children namely Elizabeth Webb, Polly Clagg, Jane Staggers, Thomas Smith Nancy Staggers, Jacob Smith, John Smith, and Catharine Buck, each one dollar to be paid to them by my executor. I further authorize my executor at any time to exchange the land I give to my grand son with my son Basil for an equal amount providing it accommodates the parties better.

Third: I do nominate and appoint R. H. Yates to be the Executor of my last Will and Testament.

This day came the petitioners by their Counsels Jones and Lawhead, and thereupon this cause came on to be heard, on the petition and the testimony, which testimony was reduced to writing by the Court, and filed in said Court, and was argued by Counsel, and the Court being fully advised in the premises, finds, that due notice of the filing, object and prayer of this petition was given by the petitioners to said parties named in said petition residents of said Licking County, who are interested in opposing the Probate of said Will of Basil Smith deceased, that said parties have not appeared nor made any objection, thereto, and the Court further finds, that said Basil Smith, was a resident said County at the time of his decease, that he died April A. D. 1871 leaving a Will duly executed and unrevoked at the time of his decease, which Will was in May or June A. D. 1871 duly admitted to Probate and recorded in this Court, that said record was destroyed in the burning of the Court House, said County in April A. D. 1875, and that said original Will has been since said Record been destroyed and subsequent to the death of said Basil Smith deceased, and that the evidence offered herein proves that the contents of said Will are as set forth in the copy to the said petition here attached.
The Court therefore finds that said Will was in the words and figures following towit:
