IN THE NAME OF GOD AMEN I Charles Berry Senr. of the County of Augusta in the State of Virginia, farmer, Being Very Sick and weak in Body but of Perfect Mind and Memory Thanks be Given to Almighty God for the same and Calling to mind the Mortality of my Body and Knowing that it is appointed for all men once to Die do make and Ordain this my last Will and Testament in manner and form following, First I Recommend my Soul into the hand of God that Gave it and my Body to the Earth to be buried in a Christian Like and decent Manner at the Discreation of my Executors and as Touching Such Worldly Estate as it hath Pleased God to bless me in this life I give and Dispose of the Same Manner and for following Impremis I Give and Bequeath to my beloved wife Mary Berry the one half of my moveable Estate after my Just Debts and funeral Charges is paid By my Executors and my Plantation that I now Live on for her Support During widowhood or Natural Life and my two oldest Negroes Viz Tom and Mack for her support and my son Robert Berry The Property Land and Negroes is to Equally for the Support of my Beloved Wife and my son Robert Berry dureang my Beloved Wifes Life and at her Death the whole of s.d property Property to Become the Property of my Son Robert Berry and his heirs and assigns for Ever- Only if the Two Negroes have any Increase they are to be at my Wifes Disposal. Item I give and Bequeath to my son John Berry my Plantation or Tract of Land above and Joining the tract I now Live on to be his and his heirs and assignes for Ever the s.d Two Tracts to be Equally Divided across to be in Each an Equal part and my Negro Boy Named Andy to be his for Ever. Item I give and Bequeath to my Son Charles Berry my Plantation or Tract of Land Lying in Washington County on houlstone [see 1796 deed below] and my Negro Boys Named Tom to be his and his heirs and assigns for Ever, Item I give and Bequeath to my Daughter Challe Berry my Negro Girl Named Lucy and my Mare Named Mige a Saddle at five Pounds price Two Cows and a heifer her bed and furniture to be hers and assigns for Ever, and She is to have her living off the Plantation I now live on with her Mother and Brother Robert till she is Married, my Negro Girl Named Fan (?) I leav at the Disposeal of my Executors to be Continued with my Daughter Elizabeth Henry as Long as they think fit and then to be Disposed of as they think proper. Item I give and Bequeath to my daughter Jean Brawford my Negro Girl Named Jude to be hers and her heirs if she has Lawfull Issue If she dies without Issue then to be Returned to my Executors for the use of my Family, I likewise Bequeath to my Son James Berry and to my Daughters Elizebeth, Mary and Jean to Each of them five shillings Sterling in Room of their Birthright the remainer of my of my Moveable Esate I Allow to be Equally Divided Between my Two Sons John and Charles Berry, and I do Constitute and appoit my Beloved Wife Mary Berry Exectrix and my Beloved sons James and John Berry Executors of this my Last will and Testament, and do Disannule all other Wills By me heretofore made Ratifying and Confirming this to be my Last Will and Testament in Witness whereof I have hereunto Set my hand and seal this Eighth Day of April one thousand Seven hundred and Eighty Nine

This indenture made in the year of our Lord one thousand eight hundred and thirty two on the 31st day of October between William Runkle and Elizabeth his wife of William Runkle of the one part and Robert Berry of the other other part --?-- of the County of Monroe and State of Missouri. Witnesseth That the said William Runkle and Elizabeth Runkle have this day bargained and sold and these presents do grant bargain and sell unto Robert Berry the following tract or parcel of land described as follows: to wit: Being the East half of the North East quarter of Section Thirty three in Range Eleven Township fifty four containing Eighty acres and --?- the East half of the ---?-- East quarter of Section twenty-eight Township fifty four Range Eleven West containing Eighty acres together with all and singular the appurtenances there unto bringing for and in consideration of six hundred dollars to us in hand paid the recept which is hereby acknowledged and ---?--. the said Berry ---?--- accquited and in the above said William Runkle and Elizabeth Runkle of our selves our heirs and administrators do agree with the aforesaid Berry to warrant and defend the title of [unreadable] mentioned premises with the aforementioned Berry his heirs and assigns forever from ----?-- claims of either of usand --?- and --------?-- whatever and we do further by these presents declare that we do and will further defend the above bargained and sold premises ----?-- above mentioned ---?- with all the ---?-- and ---?-- warrents to belonging. In Testimony we hereunto set our hands and seals this 31st day of October 1832.

Be it remembered that on this 31st day of October in the year of Lord Eighteen hundred and thirty two before me Clerk at Monroe County Court personally came William Runkle and Elizabeth Runkle both personally known to me as be the persons whose names are subscribed to the foregoing instrument of writing a having executed the same and severally acknowledged the same is be their actual and for the purposes therein mentioned. She the said Elizabeth Runkle being by me first made acquainted with the contents thereof and examined separate and apart from her husband whether she executed the said deed and when giving his her dower to the land and premises therein mentioned voluntarily freely and without compulsion or undue influence of her said husbant acknowledged and declared that she ----?-- the said deed and relinquishes her dower in the said lands and tenements therein mentioned voluntarily, freely and with compulsion or undue [rest of document not copied]

Know all men by these presents that I Robert Berry of the County of Monroe and State of Missouri being weak of body, but sound of mind, Do make this my Last will and Testament.
First, I Bequeath unto my beloved wife Rebecca Berry, her support of this place (farm) lying and being in the County and State aforesaid during her natural life. I also bequeath unto her my mulatto Girl named Sarah and her offspring, also my black man named Cipio, to wait on her at her pleasure, but to be under the control of my son James Berry. Second. I have given to my daughter Jane E. Ha___ the sum of five hundred and thirty dollars. Third, I have given to my son Charles Berry the Sum of nine hundred and Seventy Dollars. Fourth, I have given to my daughter Rebecca Kennear the sum of four hundred and forty Dollars. Fifth, I have given to my daughter Mary C. McPheeters the Sum of Six hundred and Five dollars. I have given these several amounts that in case the receipts of the persons or their Legal agents should at any time be lost or misplaced to return to my bequeath.
Sixth, I will and bequeath unto my son James M. S. Berry my black boy Dick also this farm and and Tract of Land except One hundred and twenty acres of it known by the pond tract. I also bequeath to my son James M. S. Berry my waggon horses cattle hogs sheep farming tools which is to be his except a gray mare for the use of my wife Rebecca Berry. I also except a black filly for the use of my Daughter Isabella A. Berry also my ---?-- clock I will unto James M. S. Berry.
Seventh, I will and bequeath to my daughter Isabell A. Berry three eighty of Land Situated as follows, viz, E of NW gr of Section No 5 Township No. 53 Range No 11 west also the west qr. of the NE quarter of Section No. 6 Township No. 53 North Range No. 11 west, also the west qr. of the North E gr of Section No. 5 Township No 53 North Range No. 11 west. I also bequeath to her my negro girl Dian two beds and beding and her support off of this farm lying and being in the County & State aforesaid during the time of her celibacy.
Eighth, To my daughter Sarah E. Berry I will bequeath unto her one hundred and twenty acres of land known by the name of the land tract in the County and State aforesaid -----?--- a negro Girl named Luvinia also two hundred dollars to be paid at interest for her use and benefit also two beds and beding a horse saddle and bridle which she is to have when ever she kneeds them also her Support off of this place or farm Laying and being in the County and State aforesaid during the time that she may remain unmarried the remainder of my estate I will sett forth one old negro man named Will and his wife Esther two negro children named Martha & John the two last named Martha & John my son Charles Berry is to have which I consider to be worth four hundred dollars. It is my request that my sons Charles Berry and James M. S. Berry take the Two old negroes Will and his wife Esther and keep them dividing the time between them as near possible so that each of them Charles and James M. S. Berry may enjoy an equal part of their Labor while they are able to work then they are equested to take care of the minding at the same time to not impose on themselves as brothers neither do. I wish the old negroes be imposed upon but to be taken care of by them. I have got nine hundred dollars uncollected which I wish divided amongst my daughters so as to make them equal sheares allow Isabel Berrys three eightys of Land to be worth three hundred dollars and Sarah E. Berrys hundred and twenty acres to be worth One hundred and fifty dollars. One hundred dollars of the first money that is collected or brot from Virginia I bequeath to my wife Rebecca Berry to will and to do as she thinks proper with. I will and bequeath that my son James M. S. Berry have all the grain that I now have on hand also my wheat fan. I will that after the death of my wife Rebecca Berry Maria and her offspring and Cipio my black man and the girl above named be sold among my heirs if the Slaves are satisfied to him with the family or if they should m-ss--?-- they are to be parted from the same. I will that the amount they are sold for be equally divided among my heirs. There is yet one hundred and sixty dollars uncollected which I will and bequeath unto my wife Rebecca Berry to dispose of as she thinks proper.
I will unto my son James M. S. Berry all of my household and kitchen furniture except a trap kettle which I bequeath unto my wife Rebecca Berry.

The foregoing instrument of writing purporting to be the Last will and Testament of Robert Berry decd. was produced in open Court on the 1st day of May 1837 and proven by the oaths of Alfred Orr and Samuel Pool Jr two of the subscribing witnesses thereto and ordered to be recorded which I certify has been duly done in my office Book A page 116 & 117. In Witness Whereof I E. W. McBride Clerk of Monroe County Court have affixed the Seal of Said County at office in Paris this 2th day of May 1837

To all to whom these presents shall come Greeting. Now at this this day came Charles Berry and James M. S. Berry into open Court and by their counsel exhibited in open Court the Last will and Testament of Robert Berry Deceased which was proven and admitted to probate and the Said Charles Berry and James M. S. Berry in open Court made application for Letters of Administration with the will annexed on the estate of said deceased & filed in court the renunciation of Elizabeth (sic) Berry widdow (Relick) of Said deceased to Administer the Said estate and the said Charles Berry and James M. W. Berry entered into bond in the hand Sum of Sixteen Thousand dollars with Samuel Cartright and John Foreman as their Securities conditional according to Law. Now Therefore the Court do by these presents Give and Grant unto the said Charles Berry and James M. S. Berry full power and authority to Administer all and singular the goods and chattels Land and Tenaments rights and credits and credits which were of the said Deceased at the time of his death with the will annexed and to demand collect and in a Legal manner --?-- in and receive all manner of Debts and demands due and owing to the estate of the Said deceased and to sell and faithfully dispose of the Same according to Law.
Hereby in open Court na-----?--ing constituting and exp---ting the said Charles Berry and James M. S. Berry Administrator with the will annexed of all and Singular the goods and chattels Land and Tenemants rights and credits which were of the Said deceased and it is further ordered by the Court that the clerk of this Clerk of the court do certify a true copy of the foregoing proceeding under the Said Court for authenticated evidence for the Said Charles Berry and James M. S. Berry to act as Administrators aforesaid

Know all men by these presents that We James M. S. Berry and Charles Berry as principal and Samuel Cartright & John Foreman as their Security are held and firmly bound unto the State of Missouri in the final Sum of Sixteen thousand Dollars Lawful money of the United States of America the payment whereof well and truly to be made and done we do bind ourselves our heirs and assigns jointly and Severally and firmly by these presents Given under our hands and Seals this first day of Mary in the year Eighteen hundred and thirty Seven.
The condition of the above obligation is Such that if the above bound and James M. S. Berry & Charles Berry Administrators with the will annexed of all and Singular the goods and chattels rights and credits which were of Robert Berry deceased do make or cause to be made a tried and perfect Inventory of all and Singular the goods and chattels Land and tenements rights and credits of the Said Deceased which have come to the hand possession or knowledge of them the said James M. S. Berry & Charles Berry or into the hands or possession of any person for them and the same so made do return and and exhibit in the office of the clerk of the County of the County of Monroe within such time and in such manner as is or may proscribed by Law and all and Singular the money goods and chattels Land and Tenements rights and credits of the said Deceased accruing from or arising out of his Estate which shall come to the hands possession or Knowledge of the Said James M. S. Berry & Charles Berry shall well and truly Administer according the Law and pay the debts of the deceased as far as his assets will extend and the Law direct and further make or cause to be made first and true accounts of their said Administration and make due and proper statement thereof from time to time according to Law or the or the order Sentence or decree of any court having competent jurisdiction and shall morever well and truly do and perform all other matters and things touching the Said Administration as are or shall be provided by Law or enjoined on them by order Sentance or decree of any court having competant jurisdiction then this obligation to be void and of no effect otherwise to remain in full force & effort.
