THIS INDENTURE made this twenty first Day of May In the Year of our Lord, One thousand Seven hundred and forty Seven BETWEEN Benjamin Borden of the County of Augusta Gent in the Colony of Virginia, eldest sone and heir at Law and also one of the Executors of the last will and Testament of Benjamin Borden, late of Orange County Gent deceased of the one part and David Dryden, Taylor, of the aforesaid County in the Colony aforesaid of the other part. WHEREAS the said Benjamin Borden the Testator in his lifetime was seized in his demesne as of fee of and in Several Tracts and parcels of Land Situate lying and being in the Colony of Virginia aforesaid as also of some lands and Tenements in New Jersey and being so thereof seized made his Last will and Testament in writing bearing date the third day of April one thousand seven hundred and forty two and therein and thereby among other things did declare it to be his will that all Lands and Estate that all Lands and Estate that he had in New Jersey should be sold and all his Land at Bul--?-- and his land on Smith Creek and North Shenadoe and all his enties everywhere and all his Lands on the Waters of James River and all the rest of his Lands should be sold excepting five thousand acres of Land that is all good and except the Land he then lived on and did confirm and appoint his wife Zeruiah Executrix and his son the said Benjamin Borden and his son in law William Fernley Executors of his said will and to execute Deeds for the Lands he had sold and had by his said will ordered tobe sold as by his said will duly proved and remaining of record in the said County Court of Frederick relation being th----?-- --?- may more fully and at Large ---?--- and whereas the said William Fermley hath failed to prove the will or act as an Executor and the said Zeruiah hath refused to act as Executrix and whereas the said Testator in his Lifetime had agreed to sell and convey the fee simple estate of and one hundred and thirty acres two roos & fourteen poles of land bying and being in that part of Orange County comonly called Augusta, in the colony aforesaid unto the said David Dryden for and in Consideraiton of the sum of three pounds sixteen shillings Current Money of Virginia to him in hand paid by the said David Dryden and Land is part of a large tract of ninety two thousand one hundred acres granted the said Testator by patent bearing date November the Sixth in the year of our Lord one thousand seven hundred and thirty nine as relation being thor---?-- had may more fully and at large appear and is bounded as followeth viz: BEGINNING at a black walnutt in a Line of John Pattisons land near the side of a small branch and runneth thence South 62 degr.s West 120 poles crossing said Branch to a Stake in a naked piece of land corner to William Bashiers land thence with his line S 40 East 78 poles to a poplar & S GE 140 poles to a large white oak corner to John Pattisons land thence with his line N 40 E 105 poles to a white oak thence North 20 E 78 poles to a black oak th N 28 W 115 poles to the BEGINNING NOW THIS INDENTURE WITNESSETH that the said Benjamin Borden for and in consideration and of the sum of three pounds sixteen shillings currt Money of Virginia to him in hand paid by the said David Dryden the receipt whereof is hereby acknowledged Hath given granted, bargained Sold, Aliened Released and Confirmed and By these presents doth give grant barain Sell Alien release and Confirm unto him the said David Dryden his heirs and assigns forever all the Estate Right title Claim and Demand of him the said Benjamin Borden, his heirs and assignes of in or to the said 130 acres 2 rood & 14 poles of Land and the premeses with the appurtenances and the Reversion and Reversions Remainder and Remainers and every part and parcell thereof; together with all houses Gardens Orchards Woods Underwoods Swamps Marshes Low grownds Meadows footings within the said bounds and the Rivers Waters Watercourses therein contained and all other pro--?-- the Comodities and Hereditaments shall forever to the said 130 acres 2 rood & 14 poles of Land belonging or in any wise apportaining TO HAVE AND TO HOLD the said 130 acres 2 rood & 14 poles of Land and all other the before granted bargained and Sold premeses and every part thereof with their and every of their Appurtenances to only proper Use and Behoof of him the said David Dryden his heirs and Assigns forever in as Large and ----?-- manner as is intended by the said Will And the Said Benjamin Borden for benefit his heirs and assigns doth Covenant promiss and argree to and with the said David Dryden his heirs and Assigns that the said David Dryden his heirs and Assigns shall forever hereafter have hold Use Occupy possess and enjoy the said 130 Acres 2 rood & 14 poles of Land and promises with the appurtenances free and clear and frely and Clearly acquitted and discharged of and from all and all Mannor of person or persons whatsoever The Quitrents for the promises to become --?-- excepted and foreprized And Lastly it is further Covenanted and agreed by and between the parties -----?--- p----?-- that the said Benjamin Borden and his heirs the said 130 Acres 2 rood & 14 poles of Land and premises with the Appurtenances unto the said David Dryden his heirs and assigns Shall and will warrant and forever defend by these presents IN WITNESS whereof the said Benjamin Borden hath hereunto set his hand and Seal the day and year first above written

IN THE NAME OF GOD AMEN, the fifth day of February in the year of our Lord one thousand seven hundred and sixty one I, Nathaniel McClure of the County of Augusta being sick and weak of Body but of perfect Mind and Memory thanks be to God therefore and calling to mind my mortality knowing that it is appointed of all men once to die do make and ordain this my last wil and testament-first of all I recommend my soul to God that gave it to me and my Body to the dust to be decently buried at the discretion of my Executors not doubting but at the Resurrection I shall receive the same again by the Mighty Power of God and for such worldly Estate as it has pleased God to bless me with, I give dispose and bequeath of the same in manner and form following: First I order my just debts and funeral charges be paid by my Executors. Imprimis I give and bequeath unto Mary my beloved wife one third part of all my moveable Estate and her living on my Plantation during her life with my children. Item I give and bequeath unto my oldest son Halbert Ten pounds currency for to cure his sore leg over and above his proportion of my Estate. Item I give and bequeath unto my sons James and Nathaniel McClure the Plantation I now live on to be equally divided betwixed them as they can agree and do further order that my said two sons maintain their Mother and their Young Brothers and Sisters on the said place during their Mother's life and till the children be fit to be put to trades and if is shall happen that my said two sons and their Mother cannot agree to live on said place, I order that said place be sold and be equally divided amongst them (Viz) that the price of said place with the rest of my Estate to be equally divided amongst the said James and Nathaniel McClure and my other children which shall be hereafter mentioned. Item I give and bequeath unto my two sons over and above the Plantation, four horses and mares, their choice of any belonging to my Estate as my Executors shall think fit-to-work the said Plantation together with all the ploughs and tacklings, axes, mauls, wedges, mattocks and other utensils of husbandry belonging to the said place. Item I give and bequeath unto my wife her riding mare and sadle over and above her third part of my Estate. Item I bequeath the remainder of my Estate to be equally divided by my Executors amoungst the rest of my children-Viz: Halbert, Mary, Alexander, Hanah, Thomas, Margaret, Dorothy and Moses McClure and each of them to have an equal share as above excepting what is excepted above and further do order that my young ones be put to trade as soon as the Executors that they are fit and ___ Lastly I order, constitute and Appoint Alexander McClure and Moses McClure with Arch.d. Alexander Executors of this my last will and Testament hereby revoking disanulling and making void all other wills and Testaments, Legacies Executors by me made heretofore confirming and ratifying this as my last will and Testament Published and pronounced in the presence of before sealing and subscribing the said will I order Eight pounds to be kept of the whole Estate before any division be made to pay for the Education of my four youngest children. In the name of God Amen, I, David Dryden of the County of Augusta and the Colony of Virginia being sick and weak of body but of Perfect Mind & memory thanks be given to Almighty God Calling to mind the Mortallity of my body, knowing that it is appointed for all men once to die do make my last will and testament in the manner and form following, that is to say, Principally and first of all I recommend my soul to God who gave and my body to the dust from whence it came to be buried in a Christian-like decent manner & at the discretion of my Executor, nothing doubting but at the General Resurection I shall receive the same again by the Mighty Power of God and as touching such worldly estate wherewith all it hath pleased God to bless one with, I give & bequeath as follows, Impris:
I give and bequeath to my beloved Wife Dorothy her maintenance of the land I now live during her life, one milch cow & ewe & a lamb & my large bible to be left to Nathaniel at her decease and both Bostons Works, and her chest.
Item I give and bequeathed to my son Thomas Dryden one dollar and likewise my blue coat and jacket.
Item I give and bequeathed to my son James one dollar.
Item I give and bequeath to my son David one dollar.
Item, I give and bequeath to my daughter Eliner eight pounds of the Estate.
Item, I give and bequeath to my daughter Jane one dollar & two pewter dishes & three plates & one large Pot.
Item, I give an bequeath to my daughter Elizabeth one dollar.
Item I give and bequeath to my two sons Nathaniel and William the land whereon I now live to be equally divided bewixt them according to quantity and quality at the discretion of my Executors, also each of them a horse and saddle and likewise I give and bequeath to my son William one young bay filley, likewise I give and bequeath to each plow and taklings.
I give and bequeath to my son Nathaniel one black mare, likewise the two old plow horses to be divided between them also I allow all my Just dedts and demands to be paid out of the remainder of my moveable Estate, likewise if any thing is remaining I give and bequeath it to Dorothy my wife and sons Nathaniel and William
LASTLY I appoint Samuel Lyle and my son James sole executors of this my last will and testament and I do hereby Revoke and Disannual all other or former wills or testament by me made, Ratifying & confirming this and no other to be my last will and Testament. In witness whereof I have hereunto set my hand and seal this 2nd day of June 1772

This last Will and Testament of David Dryden deceased was proved by the Oaths of John Thompson & William Thompson two of the witnesses thereto and ordered to be Recorded on the motion of Samuel Lyle and James Dryden the Executors therein named who made oath according to Certificate is Granted therefor obtaining a Probate thereof in due form they having with Security entered into and acknowledged their Bond According to law. KNOW all men by these Presents that we Samuel Lyle, Samuel Dryden, Daniel Lyle and Samuel McCorkrey are held and firmly bound unto James Doak and Samuel McDowell, George Moffett, Archibald Alexander Justices in the Commission of the Peace for Augusta County for and in behalf of the Justices of the said County and their successors in the sum of five Hundred Pounds to be Paid to the s.d Justices & their Successors which Payment will & truly to be made we bind ourselves and each of us and every of our heirs Executors & Administrators Jointly & Severally firmly by these Presents Sealed with our seals & dates this Eighteenth day of August 1772.
THE CONDITION of this Obligation is such that if the above bound Samuel Lyle and James Dryden Executors of the last Will and Testament of David Dryden deced. do make or Cause to be made a true and Perfect Inventory of all and singular the goods Chattles and Credit of the s.d. deced. which have or shall come to the hands or Possession or knowledge of the s.d. or into the hands or Possession of any other Person or Persons for them and the same so made do exhibit or cause to be exhibited into the County Court of Augusta at such times as they shall thereunto be required by the s.d. Court and the same Goods, Chattles and Credits and all of them the Goods Chattles & Credit of this deced. which at any time after shall come to the hands or Possession of the said Samuel and James on into the hands or Possession of any other Person or Persons for him do well and truly Administere according to law and further do make a true and Just account of his Actings and doings therein when hereto required by the s.d Court and also do well and truly Pay & deliver all legacies Contained and Specified in the s.d. testament as far as the said Goods Chattles and Credits with there upon --?--. According to the Value thereof as the law shall Charge then this Obligation to be Void otherwise to remain in full force and Virtue.
