Elizabeth Bullard Brooks

I, Elizabeth Brooks of Callaway County and State of Missouri do make this my last will and testament that is to say:

First, I give to my son Theophilus Brooks my negro man George to him and his heirs forever.

Then, I give to my other sons Elkanah Brooks, Churchill Brooks, George R. Brooks, James R. Brooks, Lafayette and Lorenzo Brooks One Hundred Dollars each and the residue of my property not otherwise disposed of I wish to be divided equally between all my children.

Produced in County Court of Callaway County August 12th, 1858, duly sworn, etc.

In vacation of the County Court August 12, 1858, I Thomas B. Harris, Clerk of the County Court do certify that this paper or instrument of writing purporting to be the last will and Testament of Elizabeth Brooks, Dec'd was this day produced to me in my office for probate where upon at the same time came Richard Bullard, Felix G. Nichols, the subscribing witnesses to the same, who after being duly sworn by on their oaths depose and say, that they heard the said Elizabeth Brooks, acknowledge, publish and declare the same to be her last will and testament, and at the time of doing so the said Elizabeth Brooks was of sound mind and a disposing memory.................................

Christopher Bullard- brother of Henry Bullard

C B Bullard died in Newton County Missouri late in 1844. His death was reported to William and Sarah Lewis of Claiborne County by Sarah's brother Joseph Boyers, who said he saw C B Bullard a short time before his death. [A transcript of this letter is in the Michael Boyers file at the DAR library in Washington DC.]

Will of C B Bullard (Brother to Henry )
In the name of God amen.

I Christopher B Bullard being in my proper mind and memory knowing that it is appointed for all men to dy and caulling to mind the frailty of my boddy at present and knowing if I recover from the disease which I now labor under it is but the blessing of Heven I tharefore think it proper to dispose of my estate in the following manor viz: First of all I recommend my Sole to God, who gave it.

2nd. My Boddy to the grave there to be deasantley beried.

Thirdly my small estate which god has blest me with my land I wish sold at publick sale to the best bidder on one two three & four years credit.

My blacks viz:

Ben, that Sister Elizabeth McMahan have him by accounting for him out of her part of my estate, three hundred dollars.

David, Honey & Elizabeth, my wish is that John Bullard my brother have them at twelve hundred dollars and after reducting at his part of my estate the balance to be paid to the rest of the Legatees which will hereafter be named.

The rest of my property to be sold at publick sale to the hiest bidder and after paying my debts with the same the balance to [be] equally divided between my brothers and sisters with the exception of Boyer Bullard. My will is that he have the sum of one dollar my reason I have for not giving him more I will not name.

Sister Lewis the wife of Georg Lewis to have a just part with the exception of the cost of a sute that Georg Lewis brought aganst me rongfully in the circuit court in Tazewell.

My wife Rebecha Bullard it is my will and desir she have the some of one dollar. My reason for that is that she left me because I was sick and for other reasons which I will not mention but not with all that she has done in suing me in a chancery court at Tazewell which she knows is wrongfully done and run me to a conciderable cost, but I shall give her the offer returning back home and if she returns home then in that case my will is that she have two hundred dollars paid to her [by] my executors in two years from my deth and my four shears [shares] in the negros left with Mother, ---Anthony, Nance and Caroline.

At my mother's death when they are sold if any of my brothers or sisters or there husbands ______ [this empty space is in the transcript, from the sense of the following it may have said 'keep' or 'buy'] Anthony then in that case it is my will that they refund back the money that they have received from my estate to the rest of the legatees but my will is that he be sent to another county and if any of the legatees refuse sending him my wish is that they refund back the amount received of my estate to the rest of the heirs, the amount of my estate to be equally divided between Joseph Bullard, Henry Bullard, Isaac Bullard, John Bullard, Elizabeth McMahan, the children of Ann Beeler deceast, Martha Hicklin the wife of Barnett Hicklin, Mahulda Moore the wife of Alfred Moore and Sally Lewis the wife of George Lewis & William Bullard all of them my brothers and sisters and my will is that my son William begotten by me by Julia Wilson the daughter of Ledia Rice formerly Wilson that he have equal part of my estate and that part to remain in the hands of John Bullard til he come of lawful age without interest by the said John Bullard taking him and raising him as one of his children and my will is that John have the some of one hundred dollars out of my estate for schooling him and if his mother refuse to give him to John Bullard then this my will that he have nothing of my estate.

All the heirs named in this will my wish is that they sean over [these two words are underlined in the transcript] Anthony and take him in some other county for it is my belef that he has shortened my days and is working on my Mother in the same way.
And Parmelea McMahan I give one bay filly and my bed and furniture. John Bullard my brother is appointed to attend as executer to this will.

I am the widow of Henry Bullard Sr., of McDonald Co., MO. Heirs named (one dollar left to most of the first ten):

11. Evaline Bullard, my daughter-in-law, wife of my son James W. Bullard of the County of McDonald, Missouri, and to of their natural heirs at the death of my said daughter-in-law Evaline Bullard, all that messuage or tenement situated, lying and being in the County of McDonald, and State of Missouri, that is to say; The North half of the lot numbered two, of the Southwest quarter of Section seven, in Township twenty-three of Range thirty, containing forty six acres and 14/100. The South half of lot numbered two, of the Southwest fractional quarter of section seven in Township Twenty three of Range thirty, containing forty six acres and twenty hundredths of an acre, together with all my freehold estate whatever, to hold to her the said Evaline Bullard, wife of my son, James W. Bullard of the County and State aforesaid, and their lawful heirs forever and lastly as to all the rest, residue, and remainder of my personal estate, goods and chattles of what kind and nature whatsoever, I give and bequeath to my daughter in law Evaline Bullard, wife of my son James W. Bullard of the County and State aforesaid, and I hereby appoint my son, James W. Bullard, of the County and State aforesaid my sole executor of this my last will and testament, hereby revoking all former wills by me made, In witness Whereof, I have hereunto set my hand and seal this 4th day of October in the year of our Lord, one thousand eight hundred seventy two (1872).
