There are two Nathaniels who are candidates for the speculative father of Israel, Nathaniel son of Roger and Nathaniel son of William. It seems more likely that it is the first. Thomas BAXTER (Theophilus, Theophilus, Israel, Nathaniel, Roger, Roger) was born 04 Mar 1802. He died 17 Jun 1836 in Marion County, Mississippi. This the first certain generation of Baxters. Thomas's middle name or initial variously said to be Leonidas, L or W. I am not certain what is the case Thomas Baxter lost his life when his horse stepped in a hole and fell while he was driving cattle near Franklinton, Louisiana, on the Bogue Chitto River. His wife got the new that his condition was critical. He died, however, before she could reach him from their home, a quarter-mile west of the present home of R.T. Bilbo, approximately fifty miles. He was buried at "Big Thick" near Franklinton, where he died. As a young man, Thomas got his start running cattle for Dr. Thornhill. In 1826 he bought the Thornhill "Tsub2" brand and registered it at the courthouse along with his own Baxter mark: swallow ford and underbit in the right ear, crop and underbit in the left. There is no record of this purchase. What cattle were included in the deal is not known. However, by 1911, at the death of his second son, Nathan L. Baxter, who had taken over the management of the estate in 1850 after the marriage of his older brother, the heard had increased so much that 1400 head of cattle were sold to settle one-third of the estate. One of the three beneficiaries of Nathan's will had predeceased him and he had made no adjustment in the will. There is no proof of Thomas's antecedent back through Georgia to the Carolinas. The family is said to have left Georgia in the early 1800's, initially settling in the area of Bayou Sara near St. Francisville. In the migration story, there were two old uncles. Another uncle or brother dropped off with his rather large family somewhere in Alabama. Joseph E. Baxter recalled that his great-grandfather was named William and that he had uncles or brothers named Dempsey and Israel. (There must be some confusion here as the name Dempsey comes from the Griffin family. Theophilus is the brother of Israel.) He also said that his father, James, because he already had a son named William, tried to name Calvin and Sarah Baxter's youngest Dempsey Israel. Sarah, however, did not like the name Israel but did not was to offend James. So she change the name to Harris but did not tell him. Thomas Baxter reached the Felicianas in Louisiana, or Spanish West Florida, sometime prior to 1816. Thje 1816 report of the US Land Office includes a claim for 300 arpents of land by Thomas Baxter. The land showed occupancy dating back to 1806. The claim was based upon an order of survey by Carlos de Grande Pre, who was the Spanish governor of Baton Rouge in 1806. The request for the survey was made by a William A. Airs or Ayres. The Federal Land Office turned down the claim on the bases that the contract lacked consideration and therefore was not binding. There is nothing to show how Thomas Baxter came to be in possession of the claim or when he got it. In 1824 the claim was reopened by W. Stewart for Thomas Baxter. From the records it appears the claim was finally approved. However, no recording of the parcel has been found in the early records of West Feliciana Parish at St. Francisville, Louisiana. My best guess is that he is a younger son of Theophilus who died between about 1812 and 1819. He came to Mississippi with his wife, presumably Mary, and eight children. William is possibly another child of Theophilus. Thomas married Nancy STANFORD, daughter of John R STANFORD and Delilah RUARK, on 22 Jan 1820. Nancy was born 20 Aug 1799. She died 24 Jan 1872.
