The states of North Carolina and South Carolina provided many of the settlers for the pine barrens of Georgia. The great influx in the main was between the end of the American Revolution and the beginning of the eighteenth century. Among those who came to the upper portions of the counties of Liberty and Bryan and the lower part of Bulloch were the Baxters. The Loss of records through acts of war and negligence has rendered it impossible to fully document the nine generations after the earliest known member of the family, old Israel Baxter (c1690-1769) appeared in Craven County, N.C., by 1743. He evidently lived in the western part of the county and was cut into Johnston County when that county was formed in 1746, for his son Theophilus appears as a private on the muster roll of Capt. Simon Herring's company of Col. Lewis Henry DeRosset's regiment of foot soldiers of Johnston County, dated October 5, 1755. This was at the time of King George's War and the regiment was raised to curtail activities along the North Carolina coast. In March of 1743, Israel appeared before the court at New Bern to answer a charge brought against him by one Robert Fitz-Randolph. He lost his case when the jury awarded the Plaintiff L44 and costs. At the next term of court held in June, he faced a more serious charge brought in behalf of King George II against him and again he lost. He moved to the adjoining county of Pitt and there made a deed of gift to his children Stephen, Sarah, David, Theophilus, and Rebecca in 1763, and the next year he gave most of the remainder of his personal property to them His eldest son Israel was not named in either of the deeds, he having already quit the nest some six or more years earlier and settled on the Peedee river in present Marlboro County, S. C. Rebecca, the youngest, was not named in the second deed. After Dobbs County was formed from Johnston, Theophilus acquired over 600 acres on Falling Creek, about ten miles west of present Kinston, Lenoir County. By 1770 he had followed his elder brother Israel to the Peedee. Theophilus, after his arrival in the Cheraws, joined in 1778 the St. David' s Society, which had been organized to establish public schools and seminaries along the Peedee river. To subdue the rebellious colonists who were yearning for freedom from the domination of the mother country. Britain, during the first three years of the war, concentrated its military operations against the northern colonies but without success. Then she decided to shift her efforts to the southward. To meet this threat South Carolina found it necessary to draft its able bodied men for service in its militia. Theophilus was drafted in Georgetown District in 1778, but his 16-year old son Israel, then not subject to draft, volunteered to go as his father's substitute and marched to Haddrell's Point near Charleston and was discharged after a month's service. He afterward volunteered and marched under Gen. William Moultrie to Purrysburgh and on May 3, 1779, was in a fight with the British at Coosawhatchie bridge; later was under Gen. Francis Swamp Fox Marion. After the fall of Charleston in May 1780, the British sent officers through the countryside and compelled the conquered males to swear allegiance to King George III. John Harrison, a native of Virginia who lived on Lynches Creek in Camden District, joined the British in Savannah in 1779, and in june 1780; Lord Cornwallis gave him a commission as major commandant of S. C. Rangers. He enrolled several hundred men, many under duress, among them Theophilus and his brother David who had followed him to the Peedee. Before April 1781, David was " a prisoner with the rebels", possibly a defection --something that Cornwallis told Lord Rawdon he feared. Theophilus was not so fortunate for he died in British hands on January 13, 1781, leaving his small family to face destitution. His older brother Israel, too old for miLitary service, supplied the S. C. militia with a substantial quantity of beef. He appears to have had sons Israel, Theophilus, and William, who moved to Winton County (present Barnwell), Beaufort District. Son Israel had a brush with the law and was convicted by the Courjc of General Sessions at Beav}fort in 1772 on a charge of receiving stolen goods, and sentenced to stand upon the pillory and be lashed, and to be fined i100 proclamation moneyJ but Governor William Bull remitted his fa ne on September 28, 1774 . Israel and Theophilus each performed 20 days duty in the S. C. militis in 1782. Old Israel joined them in Beaufort District in 1783. William di ed in 1787, survived by his wife Catharine, a son lEeophitus, and a daughter, the wife of Zachariah Griffin. Israel and Theophilus appear to have moved to Wllkes County, Georgia where they were living in 1785. Young Stephen, son of Theophilus of the Cheraws on the Peedee, went down into present Colleton County and in the fork of the Saltcatchers was savagely beaten by William Davis on July 24, 1771; hired Thomas Phepoe, a Chareston attorney and loyalist during the war to sue for lb500 damages, but Davis ' skilled lawyer John Colcock (though he later lost the life of another cilent Isaac Hayne) obtained a general demurrer on grounds "there are so many causes it would be tedious to recite them. Davis was a man of considerable influence and during the Revolution got himself a commission as lieutenant colonel of the upper Granville County regiment of S. C. militia. Stephen, who was probably born about 1752 near present Kinston, N. C., apparently returned to the place of his nativity and married a Hunnieut lady of the long established family of that name that resided first in Johnston, then in Dobbs after it was formed in 1758, and finally in Lenoir when it was created in 1791. He appears to have lived in Dobbs until after the birth of his first two children--Elizabeth, about 1785, and Stephen, about 1787 then returned to Colleton County where a daughter Mary Ann was born on January 22, 1790, and a son John H. in 1795. The Baxter brothers soon moved to Georgia- - Israel, Theophilus, John, Proctor called Prock and Davidl s widow to Liberty County. Stephen may have accompanied them, but his name first appears in the records of the adjoining county of Bryan in 1806 when he qualified as a resident or' the state for at least three years, and a married man with wife and minor child, and registered for the 1807 Georgia land lottery. He was residing in Captain Bird' militia district, and drew a lot in the new county of Baldwin that was granted to him on January 5, 1808. He was able to write his name for when he witnessed a deed in Bryan in 1806 he signed,"Stephen Baxter". He must have died not long afterward for no other records mentioning him have been found, though most of the early Bryan County court records were destroyed. For the 1805 lottery, Israel registered as a resident of Bryan and received two draws, both blank. Theophilus registered as a resident of Liberty and received two draws, one of which was positive. It was located in Wilkinson County and he sold it to his brother Israel whose son Israel, Jr. - sold it in 1812 to James Barnard of Liberty County. David's orphan was regiscered for the 1805 Lottery but drew nothing. John was drawn for jury Service in Liberty County in 1796; TheophiLus in 1800 and later. John and Israel were petit iurors at the April 1812 term of Bulloch County superior eourt. Theophilus acquired 200 acres on the Great Canoochee river in the upper end of Liberty in 1798; Isrsel was cied for failure to return his taxable property in Lower Canoochee District of Liberty .Prock was in Winston County in 1788, but was drawn as a juror for the January 1810 term of court in Liberty. Israel, son o.f Theophilus, married Lucy (surname not known) apparently in present Marlboro County, S. C , and to them was born there in 1785 a son who was named Israel, Jr . Israel and Lucy were later separated and both married again--she to Adam McNealy in Winton County and by him she had a son. Willinm McNealy. After Adam died she married Thomas Griffin, jr., by whom she apparentLy had no children, but becnme the step-mother of James, Dempsey, and John Grifrin. Lucy Grirfin in 1813 made deed of gift in Bulloch of three negroes to her son Israel Baxter, Jr. of Tattnall. When Thomas Griffin, Jr. died in Tattnall in 1812. Lucy was appointed administratrix to his estate and gave a power of attorny to her son William McNealy to go to Warren County, Ga . and deliver to Lewis end Asa Griffin their shares of their deceased brother's estate. Theophilus and his wife Mary were charter members of Beard ' s Creek Baptist Church when it organized in 1804. A dlfficuIty arose between them and Lucy Griffin in 1808 and all were suspended. Lucy confessed and was restored. In 1810, Theophilus and Mary requested the church to grant them "such letter as the church could freely assign' and forthwith went to Wayne (now Greene) County, Mississippi. When settlers in Wayne County signed a petition to the U. S. Congress in 1811, he signed his name 'Theophiles Baxter, " whereas the other Baxters of this name used their "x" mark when signing documents. Israel, Sr. and Jr., Stephen, and John were living in 1813 in Capt . Jesse Durrence ' s district of Tattnall (now Evans) County, but only John returned any land, and it a tract in Telfair County that had been drawn by one of the Baxters in a lottery. Israel, Jr. and his cousin Stephen were drafted inJanuary 1814 for service in the Tattnall County regiment of militia, under Col John P. Blackmon and Maj. Martin Hardin. In 1814, Israel Sr. returned 700 acres; Israel, Jr., 400 acres, and Stephen 230 acres that had been granted to George Carter and which he received upon his marriage to the latter's daughter Rebecca . Obviously the land granted in Baldwin County in 1808 to Stephen Baxter was to his father for if it had been granted to him, he would have been required to return it in Tattnall in 1813 and he did not. Israel, Sr. was commissioned a justice of the peace for Tattnall in 1815by Governor Peter Early, but his tenure was short for he joined his brother Theophilus in Misslssippi in 1816. John was married in 1807 to the widow Sarah Moore, daughter of John Everitt of Bulloch County. Elizabeth married on Febuary 4, 1807, George Carter, Jr., and Mary Ann married on August 10, 1810, William Smith, Jr. John H., son of Stephen, married on January 10, 1824, Nancy, daughter of Samuel Delk of Tattnall, and both families immediately moved to Gadsden County, Florida, where they resided for ten years, returning to Georgia ln 1834, and settling on Taylors Creek in Liberty County. In 1824, Israel, Jr., his brother-in-law William McNealy, and James O. Baxter moved to Jacksotl County, Florida. McNealy hadmarried the widow of Redden Denmark, the former Lavinia 'Winnie' Wise of Bulloch, and after the birth of several children, he separated from her. David Levy Yulee, U. S. Senator from FLorida, declared in 1852 , "Col. McNealy is one of the most respectable men in the State." Stephen, whose middle name was hunnicut, always signed his name with "his X mark. " He sold his 435 acres in Tattnal in 1835 and he too mived to Liberty County. He and Rebecca were the parents of six children: Harriet, first wife of Soloman Parker: Stephen hunnicut, Jr,. who married caroline Poppell; Wiley bates, who married Eliza Copeland; and Henry H., who married Ncy Dukes. Stephen made deed of gift in 1863 of all his lands and stock to his three sons Wiley of Tattnall, John of Wayne, and Stephen of Liberty. he died in october 1866 and was buried at jones Creek baptist Church in Liberty. My data does not match yours in a lot of ways. I have a Jane Baxter Born in 1821. Jane was the daughter of Stephen Honeycutt Baxter. She married a TODD. I do not have all the details on Jane'n marriage, etc. but it is possible her husband died and sh went to live with Stephen Baxter, Jr. who would have been her brother. Chatham Co. Ga.. Notes for JAMES OLIVER BAXTER: Just a note - In my research in Jackson Co, FL I have found that
part of the 1870 CENSUS seems to be MISSING. Many of my ancestors who lived in the 11th precinct do not appear, yet I
know from other records that they were still in the community. Perhaps others missing also. Your James E. BAXTER, son of
James O. BAXTER and Sarah Ann FUTCH, married Mary S. TIDWELL 27 Jul 1854 and Caroline TIDWELL 21 Mar 1871
both in Jackson Co., FL. This would indicate to me that they didn't go anywhere. I am not sure what happened to that part of
the census but it may have never been taken. In 1869 there was what was called "The Second Rebellion" in Jackson Co
which might have prevented a yankee census taker from "walking the streets" of that section - They had there own justice
system. Also somewhere close to that time - don't remember exactly - they had a fever outbreak in that northern part of the
county which may have prevented the census being taken. Of course - it could be lost or microfilmed with another county or
any number of things but the point is that they probably didn't go anywhere. Are they still there in 1880? The parents of
James E. BAXTER - James O. BAXTER & Sarah FUTCH were married 9 Dec 1823 in Chatham Co., GA. Their marriage
license states they were "of Bullock Co.", GA. They moved to Jackson Co., FL by 18 Jun 1827 when he received land in
Sect 21 Twp 6N Range 10W. There are several pages concerning the estate James O. BAXTER in Jackson Co., FL Probate
