Will of William Rigby

 

Georgia, Troup County.

Know all men by these presents that I, William Rigby, Senior, of the State and County aforesaid, being sensible of my declining years, and that according to the course of nature, I cannot live much longer in this world, I do therefore make and declare the following to be my last will and testamint. Viz. I give and bequeath all my estate both real and personal to my wife Mary Rigby during her natural life or widowhood, and in case of her marrying again, then for the whole to be sold at public sale and to be equally divided among my children hereinafter mentioned, and my said wife she receiving an equal part with one of my said children. And in case she does not marry, it is my will that at her death the whole be sold as a foresaid and equally divided among my children, viz. Elizabeth Roe, Lottey Roe, Nancy Post, Vicey Jackson, William Rigby, Allen Rigby, Noah Rigby, Eli Rigby, Alford Rigby, Mary Rigby, Hannah Bays, and Huldah Paterson. It is further my will that my unmarried children receive something as they marry to help them towards housekeeping of whatever can be spared at the time. And in order that an equal division be made, it is my will that all my children that have received those who may receive anything as aforesaid render a true account of the same on a division of my said estate, with the exception of the pale read cow + calf, which I give and bequeath to my youngest daughter Mary Rigby, which she is not to account for. And it is further my will that David Roe and Thomas Jackson be my executors to bring this my will into effect. Given under my hand and seal this 2nd June, 1834.

November Term 1835

 In open court the last will and testament of William Rigby, senior, deceased, was exhibited for probate, and on motion it is proven by the oaths of Jephtha Wilkerson and Cyrus R. Jenkins, two of the subscribing witnesses to said will. You, Jeptha Wilkerson and Cyrus R. Jenkins, you and each of you do solemnly swear upon the holy evangelist of Almighty God that you saw William Rigby, senior, sign, seal, publish, and declare this instrument of writing to be and contain the last will and testament of the said deceased, and that he was of sound mind and disposing memory, and that he did it with [compublien] and of his own free will, and you saw Ann W. Wilkerson sign with yourselves as subscribin witnesses to the same, and at the request of the testator and in the presence of each oter, so help you God.

 Sworn to in open court and subscribed before me, 2nd November, 1835.
