#020 Doyle, Thomas, Greenville County, yeoman. Horse Stealing

Warrant, 13 Oct 1793. Issued by Reuben Barrett, JP; Comments: Joseph McCool, Blacksmith made complaint before Reubin Barrett, JP and said that about July 1791 ìhe took up a sorrell horse with a blasÈ in his forehead had had the [?] as a stray and a certain man that called himself by the name of John Doyle came to his house and claimed that said horse to be his property,î and he the ìDeponent give him upî the said horse on his promising to prove his write [sic] to said horse in a short time which he failed to do and he further sayeth that he surely does believe by Doyles own words that he is by the name of Thomas Doyle and had no just rite [sic] to said horse.

McCool], blacksmith, £200; Security: Thomas Barton, planter, £100; Condition: Joseph McCool appear in Washington District General Session Court on 10 November next to give Bill of Indictment against Thomas Doyle for taking 1 sorrell horse.

Commitment, 14 Oct 1793. Issued by Reuben Barrett, JP: Charge: Horse Stealing; Comments: Reuben Barrett, JP, to Lennard Clabourn, Constable and to Sheriff or jailer of Washington District, arrest Thomas Doyel [sic] for charge of Stealing Hourse from Joseph McCool and selling it as his own property. He confessed to charges. [Note on document: Thomas Doyel Commitment Recorded 15 Oct 1793.]

Indictment, 11 Nov 1793. True Bill. Charge: Thomas Doyle, on 20 July 1791 stole ìone sorrel horse,î valued at £6 from Vincent Anderson; Jury: Joshua Saxon, foreman, Charles Benson, Joseph McCool, Henry Sims, Hugh McCoy (McCay?), Shields Booker, William Towns, Samuel Earle, Nathaniel Pierm [?], Ambrose Blackburn, John Hallum, John Caldwell, Bayles Earle, Nicholas Farnell, James Anderson; Witness: Joseph McCool, Reuben Barrett, Major Gowen, John Saxon (struck out); Verdict: Not guilty, James Madison, foreman.

[Summary of #236 and #238: There seems to have been an altercation at the home of Reuben Barrett involving Captain Joseph McCool and Hugh and Jared Nelson. Each party filed a claim of Assault and Battery against the other. A number of witnesses were summoned, including John Barrett. No Bill of Indictment was returned against Joseph McCool or Jared Nelson and Hugh Nelson was found Not Gulity. Also mentioned are Thomas Barton, Henry Prince, and Arthur Barrett.]

Warrant, 23 Oct 1797. Issued by Reuben Barrett, JP; Served by Archable Dill; Order: To any Constable to bring before me Captain Joseph McCool on complaint of Hugh Nelson; Comments: Summons William Yarbrough and Swofford as witnesses for State.

Recognizance, 24 Oct 1797. Issued by Reuben Barrett, JP, to Captain Joseph McCool, $100; Security: William Robbs, $100; Condition: Appear before Greenville County Court on 05 February next to answer Indictment by Hugh Nelson for assault and battery on September last.

Recognizance, 31 Jan 1798. Issued by Reuben Barrett, JP, to William Yarbrough (Yarbron?); Security: Solomon Dill, $50; Condition: William Yarbron appear on 05 February next to give evidence against Joseph McCool for assault and battery against Hugh Nelson at Reuben Barrettís on 01 September last.

Recognizance, 31 Jan 1798. Issued by Reuben Barrett, JP, to Jacob (X) Swofford, $100; Security: Arthur Barrett, $50; Condition Swofford appear on 05 February next to give evidence against Joseph McCool for assault and battery on Hugh Nelson at house of Reuben Barrett on 01 September last.

Indictment, 05 Feb 1798. No Bill. Charge: Joseph McCool, on 01 Sep 1797 at Reubin Barrettís upon body of Hugh Nelson did beat and wound; Witness: Hugh Nelson, Jacob Swofford, William Yarborough; J. Carter, Clk.; Jury: John Blassingame, foreman, Benjamin Pollard, John Dillingham, Adam C. Recognizance 09 Sep 1797. Issued by Reuben Barrett, JP to Jared Nelson, $200; Securities: Robert Nelson, $100. William Nelson, $100; Condition: Jared Nelson will appear 05 February next to answer Bill of Indictment for aiding and assisting Hugh Nelson in assaulting and beating Joseph McCool at house of Reuben Barrett on 01 September.

Issued by Reuben Barrett, JP and served by Archable Dill, Constable; Order: Apprehend Hugh Nelson and Jared Nelson and summons Benjamin Benson, John Barrett, Joseph Calleway, William Jackson and Gallent Eastrige as witness for State; Comments: Captain Joseph McCool assaulted by Hugh Nelson as he was ìdoingeî his duty as a militia officer and that Jared Nelson did aid and assist.

Will of Daniel Welch

In the name of God Amen.

I, DANIEL WELCH, of the State of South Carolina and District of Greenville being perfectly sound in judgement and understanding and of a disposing mind remembering it is appointed for men to die and being desirous to set my house in order before that period do make ordain and constitute this my Last Will and Testament revoking all others in the manner and form following, (viz) my body to the Earth from whence it came and my soul to the author of all good, and as for the worldly goods that the Lord has blessed me with, I shall dispose of in the following manner,

First of all my burial expenses and just debts to be paid, the rest of my estate both real and personal to be disposed of as follows:

I give unto my beloved wife PRISCILLA WELCH the tract of land whereon I now live containing one hundred and ninety acres more or less during her natural life, also give unto her as above four Negro boys: DANIEL, PRINCE, SILAS, and LEAZ, also all of my livestock farming tools and other speciz of property which I am in possession of which is not otherwise bequeathed, for the use of her and the family that is now together and after the death of my wife as follows,

I leave unto my daughters ALSEY and PRISCILLA equally between them the tract of land whereon I now live. I leave unto my son JOSEPH N. WELCH a certain tract of land on the waters of Rabans Creek called the Huckleberry Pond containing one hundred and eighty three acres more or less, also my set of blacksmith tools. I leave unto my son JESSE WELCH a certain tract of land whereon I formerly lived on the waters of Rabans Creek containing two hundred and fifty acres, more or less. I leave unto my daughter ANNA STEPP, 1 Negro girl, LOUIZA. I leave unto my daughter ALSEY WELCH, 1 Negro boy, Daniel after the death of my wife, PRISCILLA, I leave unto my daughter JANE PEARSON after the death of my wife 1 Negro boy, PRINCE. I leave unto my daughter PRISCILLA after the death of my wife, 1 Negro boy, SILAS. I leave unto my daughter KISIAH DURHAM after the death of my wife, 1 Negro boy LIAZ. I leave unto POLLY NIX exclusive of what I have already given her three dollars to be paid out of my estate. I leave unto JOHN WELCH exclusive of what I have already given him three dollars to be paid out of my estate.

I further desire all the personal property which is not already herein bequeathed which is left for the use of the family after the death of my wife PRISCILLA to be appraised and drawn for my lawful heirs and received by them at the appraisement. I also nominate and appoint my son JOSEPH N. WELCH and my daughter ALSEY WELCH my executor and executrix of this my Last Will and Testament.

In witness hereof I have hereunto set my hand and seal this first day of January Eighteen Hundred and Thirty Nine. In presents of us, WATSON ROBBS, AMERICA FOWLER, ARTHUR BARRETT. Signed DANIEL WELCH.
