Hi, I don't really have anything else on Rutha Cabiness Moore, except the

Moore line, both My grt grandfather William M. Moore, and Charles C. Moore

line. I think you have all the Barrett line.

I do know that JosephBarrett and Rutha moved to Nashoba county Miss. So I am

assuming they sold Rutha's home in Alabama before moveing here. I know

Rutha's father found Rutha after she and Micajah ran off and got married. He

tried to talk her into going back to Ba. with him, but she wouldn't. So he

bought some land and built her a home in Ala. and lived with her and her

children until his death.

You prrobably alrready knew this though. As for a will, I have never heard

of one.

Sorry I can't be of any other help to you, but I really don't know.

All I know is from the little book compiled by Elise Massey Shepherd ca 1991

for I have done very little research and none on Rutha CABINESS MOORE. She

says Ruth was b. 1796, d/o Wm.CABINESS of Nottoway Co., VA. Mother's name

unknown. Wm. had one or more wives and several children before he md. ca

1798-99 to Sophia SHERMAN PINCHAM, widow of Samuel. Sophia was the d/o

Elizabeth RANDOLPH, d/o Henry RANDOLPH of VA and Tabitha POYTRESS.

Wm. CABINESS was a descendant of Henri CABINESS of the Country of Luxenburg.

Documentation in MS Dept.of Archives and History.

She writes "The family of Sophia and Wm. CABINESS then consisteed of Eliza,

Rutha and William's other children. Records indicate Sophia CABINESS died in

1804." Eliza actually was Eliza Kennon Randolph PINCHAM, b. 1797 d. 1864.

Quoting "Wm CABINESS moved only part of his family to the Tuscaloosa Dist. of

AL. One dau was left in VA. Dau. Rutha, had married a MOORE and moved to TN.

Three MOORE children were born in TN. She moved to the Tuscaloosa Dist where

her father had settled. Wm. died in Tuscaloosa Dist. His will was wits. 8 May

1825 by Joseph BARRETT and Probated 25 Sep 1826. Rutha received a piece of

land from her father's estate, W 1/2 SW 1/4 SC 10 T21 R11W.

By the time of the 1830 AL Census Joseph and Rutha had increased their family

by two children; a dau who has not been identified and David Hamilton, b. 13

Nar 1829. They had 3 additional sons before 1840: John Napoleon, 26 Jul 1831

in AL; Reuben Gatlin, 3 Jul 1833 AL and Benjiman Tullman Artist, 3 Jul 1836 AL

(census record), but they were in Noxubee Co., MS by 1836.

I don't know if any or all of this is correct myself. I quote her work. Maybe

it will coincide with your own research and/or maybe it will give you other

areas to look for.

Janet, I don't think Mrs. Shepherd knew about the Indian that Rutha ran away with

when she wrote her little book in 1991. After I found family notes on this and started

researching it, I believe I then told Mrs. Shepherd since I was always running into

her at the Archives and gave her copies of all the letters from Hays Barrett Hays.

The family records called the chief by the sound: "Mingo Nitacature" which to me

sounds like Nittakechi and they said Mingo which means chief. I don't know when

her father went to Tuscaloosa but I had heard it was after Rutha was there where

he found her living. (I sort of wonder were they coming through Kentucky when she

ran away with the son; and I wonder was he going to the school for Indians in Ky.

also I think his father was against the missionary schools and religion at one time.

The granddaughter, Dr. Anna Lewis, PhD, University of Oklahoma wrote the book,

"Pushmataha." out of print but I got the library to order me a copy to read.

Although, the name is listed as Cabiness in a lot of places, it mostly spelled

"Cabaniss" In Henri Cabaniss' Will, it is written: "In the name of God, Amen, I

Henry Cabanis of Westover Parish in Prince George County being sick.....etc

names his children, Henry Cabanis, Matthew Cabanis, George Cabanis, and wife

Mary Cabanis....(undated will was presented Court and was recorded and a

certificate was granted Francis Epes, Jr., executor, Aug 9, 1720. (Prince George DB

1713-1728, part 2, pp 414f.)

Miss. Society DAR Vol XII, Family Record 1992: "Cabaniss Family: Three brothers

named Cabanis being Huguenots were banished from France on that account.

One went to England - name changed Cavender

One went to Iceland - name changed to Kavanaugh

Third went to America and settled in Mechlenburg Co., VA"

Janet, here are some things for William Cabaniss, Major:

According to Nottoway Co. personal property tax lists, William Cabaniss was above

the age of 16 in 1789 and not in Nottoway after 1804. In July 1789 he is noted as

lieutenant of Nottoway (Palmer and McRae, Calender of Virginia State Papers, V,p1)

In 1792 he signed a petition respecting parish boundary lines (Nottoway Legislative

Petitions, fol. B499502788) and on 5 Apr 1793 (Nottoway OB 1, 1793-1797, pp 2f.)

he was appointed 4th Captain, 2nd Battalion Nottoway Militia (Watson, Notes on

Southside Virginia, p.75). On 7 Nov 1793 he was appointed deputy sheriff under

Sheriff William Greenhill (Nottoway OB 1, 1793-1797, p39) and early spring,

4 Apr 1794, he was recommended as escheator for the commonwealth in Nottoway

(ibib,p66).

The marriage of William and Sophia Sherwin was solemnized after 1 Feb 1798,

before 7 Nov 1801, probably on or after 7 Feb 1800, for on that date he following

is recorded in Nottoway DB 2, p.126::

"Know all men by these presents that I William Cabaniss of Nottoway County,

for and in consideration of the natural love and affection which I bear to my four

children to wit: Rebeckah, William, Ruth and Frances Epes Cabaniss of sd. county..

...have given and granted..unto the said Rebeckah, William, Ruth and Frances Epes

Cabaniss, their Executors, Admrs, or assigns the five following Negroes to wit:

Nancy and Lucy, her child Milley, Stephen and Peggy together with their increase

to have and to hold to the said Rebeckah, William, Ruth and Frances Epes Cabaniss (to be equally divided amongst them so soon as either of them shall

arrive at the age of 21 years or marry) to them & their heirs forever...In Witness

whereof I have hereunto set my hand & affixed my Seal this fifth day of Feby 1800."

This document, signed by William Cabaniss and witnessed by Jordan Jackson,

Matthew Cabaniss, and Cassimer Cabaniss, indicates that William had already

married at least once before and that he had four unmarried children under 21 years

of age, but the name of the earlier wife (or wives) is not at present known.

Substantial tradition affirms that the mother of Frances Epes Cabaniss died when

Frances Epes was born, that the child was taken and reared by her half-uncle,

Isham Epes of Dinwiddie Co. - a fact which intimates that her mother was not the

mother of Rebeckah, William, and Ruth), and that her father, William migrated west

or south with a cousin, William Wells (Query A613,"Climbing the Family Tree."

Newport Daily Press, 14 June 1959, Sec D, p30; and the family Bible of Peter

Vaughan in possession of Hugh S. Watson Jr., Newport News, Va.). It is established that Frances Epes did remain in Va. but Rebeckah and Ruth accom-

panied William on his migration. William Jr. presumably died young.

Between 7 Feb 1800 and 28 Aug 1803, a son, Randolph, was born and Sophia

died. On the latter date William executed the following indenture, recorded

1 Sept 1803 (Nottoway DB 2, p443):

Tlhis indenture between William Cabaniss of the County of Nottoway of

the one part and Peter Randolph Cabaniss his son of the same county of

the other part Witnesseth that the said William Cabaniss for and in

consideration of the natural affection which he hath and doth bear unto his

said son Peter Randolph Cabaniss...doth give, grant and forever quit claim

unto a certain Negro girl by name Tamer until the said Peter Randolph

Cabaniss his heirs and assigns forever together with all her future increase..

This deed was signed by William Cabaniss and witnessed by Thomas V.

Brooking, M.A.M. Brooking, and Matthew Cabaniss.

Not long after the death of his wife Sophia and deed of gift to his son, Peter

Randolph, William began his journey to greener pastures. On 2 Mar 1805 he

sold the land on which he lived in Nottoway (about 300 acres) to Thomas Booth

also of Nottoway (Nottoway DB 2, p588), land not be confushed with 200 acres

owned by his cousin, William. The boundary lines were different.

There is a record of marriag of William Cabaniss and Polly Harper, Green Co., Ky

on 2 Apr 1807.

There is listed in Sumner Co., Tenn 1820 census, p 145 a William Cabaniss with

a household of eight whites and one black. Then, on 21 Nov 1821, William was

a resident of Tuscaloosa Co., AL when he purchased land from the public domain, patents for which were subsequently issued on 12 Apr 1824 (certified by Dept of the

Interior, Bureau of Land Management, Eastern States Land Office, Washington, DC

in a letter.)

William Cabaniss' Will, dated 8 May 1825, recorded in Tuscaloosa Co. WB 1,

pp 19f, printed in The Alabama Genealogical Registrar (now Register), No 1

(Mar 1959), p 41:

William Cabanes of the County of Tuskaloosa and State of Ala...unto

Dianne Cabanes my dearly beloved wife one negro boy by the name Bob

to do with as she pleased, also give during her natural life and at her

decease to be dived...between my three last children by names of

Napoland B. Cabanes, Dianna D. Cabanes, and William Cabanes the

track of land whereon I now live...the N.W. 1/4 of Sec 10 R 11 W T 21 with

the following negroes...Reuben, Molly and Silva, with all my household

and Kitchen furniture, horse, cows and Hoggs...to my dau Frances Epes

Vaughn one negro woman by name Milly I left with her in the State of

Virginia with all her increase...to my son Peter R. Cabanes a negro woman

Tamar and her children...ordain my wife Dianne Cabanes the sold Executor

of my last will...to my dau. Rutha More a piece of Land...the W 1/4 of the S.W.

quarter of Sec 10 T21 R11 W...this 8th day of May 1825.

It is signed by "William Cabiness (seal," witnessed by Joseph Barrett,

Constant P. Arthur, "Joseph x Doughty, sen. His Mark," and Sugar (Ezekiel)

Mayfield.

There was a deed by William Cabaniss to Ruth Moore, 21 July 1825, witnessed

by Ezekiel Mayfield and Joseph Barrett, recorded 25 Sept 1825, Tuscaloosa Co.,

DB "E" p 120; see "Jones & Gandrud, Alabama Records," Vol 7, p8)

Reuben, Lucy, & Lewis married in Leake Co., MS

Rutha's father was Micajah Moore, a Choctaw, son of Chief Nittakechi.

Her mother, Rutha Cabaniss, had eloped with him, apparently to Tennessee,

where Rutha and her brothers William M. and Charles C. Moore were born.

After Micajah died, around 1822, his wife Rutha took the children to Tuscaloosa

Co., AL where her father gave her some land. (Charles M. Moore's application

to 5 Civilized Tribes, 17 Apr 1902, Meridian, MS and book, Pioneers of Tuscaloosa

Co., AL Prior to 1830 by T.G.S. 1981: p 158 & --William Cabaniss.

First child, Elizabeth Barrett, married her second husband, James Fryery

and lived near Edinburg in Leake Co in 1870. Their marriage was recorded in

Madison County, MS on 22 Dec 1868(FTM cd#5, MS Marriages, Madison Co.MS)

Elizabeth married first, about 1855, Tom Miller, and had some children by him.

Thomas, Laura, and William Miller are listed on the 1870 Census in the

James Fryery home (Leake Co., p89,HH#634/634. In Mars Hill Baptist Church

Cemetery, north of Edinburg, MS, Elizabeth's tombstone inscriptions were copied

by Ann T. Lila on 17 Nov 1991. She was born 6 Oct 1833, died 8 Aug 1926;

and these words: "Dear Mother, though we miss you much, We know you rest

with God." A marker was not seen for her husband, James, but five younger

Fryerys were buried near Elizabeth.

3. Lucy Barrett, b 1842 (8 age 1850), A Lucy Barrett married Charles Cunningham

26 March 1869(Bk E:80,Leake Co.,MS) The 1870 Leake Co. Census shows them

them living next to the Louis and Margaret Barrett family. Lucy's brother, Elijah,

age 10, b MS, and a girl, Mary Jane, 6, unidentified, b. in MS, lived with her.

4. Thomas J. Barrett, Jr., bc 1843 (age 7,1850). He was a Private in Co. B

5th MS Infantry Regt, CSA. Died 13 June 1862, Okolona, Chickasaw Co., MS

and was buried in a Confederate Cemetery near Durant, MS (Per B. Rupert)

On file with the Chancery Clerk, Philadelphia, Neshoba Co. MS is a deposition

stating Thomas J. Barrett, deceased, a private in Capt J. M. Bowden's Co.

entered the service of the CSA at Enterprise, Clark Co., MS on or about

13 June 1862, was killed, leaving no wife or children. His mother, Rutha Moore

Barrett made the deposition for the purpose of obtaining from the government

of the Confederate States whatever may have been due the said Thomas J.

Barrett...for his services as a private as aforesaid. Signed

6.Reuben Barrett, ba1845,MS (age5, 1850). A Reuben Barrett married on

25 May 1865, Leake Co.,MS to F.L. Holmes (M/Bk D:278)

7.William Lewis Barrett, ba1847,MS (age23,1870), married lst on 21Sept1864

in Leake Co.,MS, Margaret Miller (M/Bk D:235). Tyre G. Moore was witness.

They had two children, Nancy Adaline, b 1866 and William B., b Feb 1870 or

Dec 1869. This family lived next to the Cunninghams in 1870 Leake Co census

Margaret died and

Lewis married second, Martha A. (?) They had four children, all born in

Sulphur Springs, Howard Co., Ark. James W.,b1875; Sarah A.,b1877;

Mary C.,b1879; and Emma, b.1884. Nancy and William returned from Arkansas

to Leake Co., MS where they lived with their aunt, Betty Fryery. Nancy married

Lewis Phillips and they had nine children plus ten by his first wife, Phoebe

Alderman. Nancy ended up in Okla to rear her children after Lewis died

(Letter from Donna Dixon to A.T. Lila, 8 March 1994, and message 27 Feb 1994

from Jerry Dixon on Prodigy, 2509 Sunridge Rd, Carrollton, TX 75006)

Janet, Don't know if you would be interested in this agricultural schedule on

Thomas Barrett or not. I meant to send it with the other things but left it out.

Thomas Barrett's 1850 Neshoba County, MS Agricultural Schedule, page 19, L4:

He had 25 acres Improved land and 40 acres Unimproved. Cash value of farm:

$60.00; value of farm implements & machinery: $20.00; Livestock on June 1, 1850:

1 horse, 2 milch cows, 4 other cattle and 30 Swine. Value of livestock: $180.00.

Produce during the year ending 1 June 1850: Indian corn: 150 bushels; Irish Potatoes: 10 bushels; sweet potatoes: 100 bu.; butter: 50 lbs. Value of homemade

manufactures: $15. and value of animals slaughtered: $40.00.

Janet, I appreciate you putting my family in. By the way, Ann Lila answered

my email and is sending me the church document when Rutha C. Moore and

Joseph Barrett's slave, Zerupta (sp) became members of New Hope Church in 1839.

I send you a copy when she does. She also took all the records of the New Hope

Church and typed and indexed them and presented a copy to the Neshoba Co.

Library.
