| "Will of Jedediah Fitch [her father], Will Book , p. 280, Nantucket Probate Court I Jedediah Fitch of Sherborn in the County of Nantucket in the Province of the Massachusetts Bay in New England, yeoman, being weak of body but of sound mind and memory and knowing that it is appointed unto all men once to die do make and ordain my last will and testament in manner and form, following: Imprimis, I commit my soul into the hands of Almighty God and my body to be buried at the discretion of my executors hereafter named. Item I give and bequeath unto my four children, namely Elizabeth Calef, Peter Fitch, Mary Baily and Beriah Fitch, all my whole estate which I have both in possession and reversion both real and personal which I have owing comming and belonging unto me by any ways or means whatsoever both in the province of the Massachusetts Bay in New England and in the Colony of Connecticut in New England aforesaid or elsewhere where ever it may be found. Equally to be divided between them not prefering one before the other to have and to hold the same in severalty to them and their heirs forever And lastly I appoint my Son in Law Ebenezer Calef, Esq. and my son Beriah Fitch executors jointly of this my last will and testament for witness whereof I have hereunto set my hand and seal this eleventh day of June in the twenty seventh year of the reign of George the Second of Great Britain, etc. King Annoque Domini 1754 Signed sealed published and declared by the said Jedidiah Fitch to be his last will in the presence of us Andrew Gardner, George Gardner, John Brock Jedediah Fitch Nantucket, ss. Sherborn, March the 7th in the year of our Lord 1757 At a probate court held this day the aforenamed Andrew Gardner and George Gardner appeared in court and made oath that they saw Jedediah Fitch the testator sign and seal this will that they heard him declare this will to be his last will and at that time he was of a disposing mind according to the best of their judgment and that John Brock, the other witness, was present and signed for a witness with them Frederick Folger, Regr. Jeremiah Gardner Judge"1503 From the probate court records of Nantucket: Know all men that by these presents that we Peter Fitch, Beriah Fitch, Marriners, Ebenezer Calef and Elizabeth his wife, and Mary Baily widow, all of Sherborn in the County of Nantucket in the Province of the Massachusetts Bay in New England, being the children and heirs at law unto our Mother Abigail Fitch late of Sherborn in the County and Province aforesaid deceased have fully agreed and determined to divide the land among ourselves in the following manner which was owned by our said Mother Abigail Fitch aforesaid. First Peter Fitch the eldest son shall have hold and enjoy to him, his heirs and assigns forever two fifths of all the land and real estate that the said Abigail Fitch died possessed of except his right and property in that piece of land in Wesco to the eastward of the highway on which the dwelling house of Ebenezer Calef Esq. now standeth, all which right and property he the said Peter Fitch doth by these presents resign up unto the said Ebenezer Calef Esq. and Elizabeth his wife to them, their heirs and assigns forever and Beriah Fitch, Elizabeth Calef and Mary Baily shall have hold and enjoy to them and their heirs and assigns forever each of them one fifth part of all the land and real estate the said Abigail Fitch died possessed of to use and improve the same in their own right forever more and the above division of said estate we do by these presents ... and confirm to stand and abide forever to all intents and purposes for witness whereof we have to these presents set our hands and seals this thirteenth day of June and in the thirtieth year of the reign of George the Second of Great Britain etc. King, Annoq. Dom. 1757 Signed and sealed in the presence of Frederick Folger, Paul Pinkham by Peter Fitch, Beriah Fitch, Ebenezer Calef, Elizabeth Calef, Mary Baily Nantucket ss June 13th 1757 at a probate court. This day the within named Peter Fitch, Beriah Fitch, Ebenezer Calef, Elizabeth Calef and Mary Baily all personally appeared before me the subscriber, judge of probate for the county aforesaid and acknowledged the within written instrument to be their act and deed which upon their desire I so approve of. Calef, widl, July 20, P.R. 64.] " 872 "From the Probate Records of Nantucket MA, Vol. III, p. 259, will of Ebenezer Calef [her husband] (No date is given, but the preceding document on this page is dated the 7th of June 1776.) I, Ebenezer Calef of Sherborn in the County of Nantucket in the Province of Massachusetts Bay in New England Esq. being weak of body but through the great goodness and mercy of God sound in mind and memory and calling to mind the uncertainty of this life and knowing it is appointed unto all men once to die do make and ordain my last will and testament in manner and form following Imprimis, my soul I recommend to God that gave it and my body to be decently buried at the discretion of my hereafter named executors and as for such worldly estate as it hath pleased God to entrust me with I dispose thereof in manner and form following, viz I will that all my just debts that I shall owe to any person or persons at the time of my decease shall be well and truly paid and discharged within convenient time. Item I give and bequeath unto my beloved wife Elizabeth Calef the one half of my personal estate after my debts are paid as above to her and her heirs and assigns forever, also I give her the use and income of the whole of my real estate for and during the time and term of her life or widowhood or while she remains my widow Item I give and bequeath to and among all my children namely Robert Calef, Ebenezer Calef, Mary Hussey the wife of Obed Hussey, Elizabeth the wife of William Brock, and Margaret Cogshall the wife of Paul Cogshall all the other half of my personal estate after my debts are paid as above to be divided amongst them at the time of my decease in the manner as is hereafter set fourth; also I give and bequeath to and amongst all my children as above named the whole of my real estate at the time of their mother's decease or marriage to be divided amongst them as is hereafter set forth. And now whereas I have in my lifetime handed out or given to sundry of my children sundry goods and furniture as may be seen in my little book marked E.C. A. wherein is charged the sundry as above, now my mind and will is that those children of mine that are short of the rest agreeable to the said account in the said little book shall first be made equal with the rest before division only my son Robert Calef shall have thirteen pounds six shillings and eight pence lawfull money over and above all the rest of my children then after so done then my mind and will is that the remainder of all my estate both real and personal shall be equally divided amongst them my said children part and part alike not preferring one above the other and my will and order is that my hereafter named executors shall have or cause my said estate to be (ap)prised lawfully before division be made amongst my said children to have and to hold all the said estate both real and personal as is above set forth or given to my said wife and children to them and their several heirs and assigns for ever And lastly I constitute and appoint my son Ebenezer Calef and my son in law Obed Hussey executors jointly to this my last will and testament Probate of Ebenezer Calef's will, Province of Massachusetts Bay, By the Honorable Grafton Gardner Esq. Judge of the Probate of Wills and for Granting Letters of Administration on the Estate of persons deceased having goods chattels rights and credits in the County of Nantucket within the Province aforesaid to all unto whom these present shall come greeting Know ye that upon the day of the date hereof before me at Sherborn in the County aforesaid the will of Ebenezer Calef Esq. late of Sherborn in the County aforesaid deceased to those presents annexed was proved approved and allowed who having while he lived and at the time of his death goods chattels rights or credits in the county aforesaid and the probate of the said will and power of committing administration of all and singular the goods chattels rights and credits of the said deceased by virtue thereof appertaining unto me the administration of all and singular the goodos chattels rights and credits of the deceased ??in any manner concerning is hereby committed unto Ebenezer Calef and Obed Hussey executors both of Sherborn in the county aforesaid and joint executors in the same will named well and faithfully to execute the said will and to administer the estate of the said deceased according thereunto and to make a true and perfect inventory of all and singular of the goods chattels rights and credits of the said deceased and to exhibit the same into the registry of the court of Probate for the county aforesaid." 884 "Ann Boardman says in her book that Elizabeth Calef died the next year after Ebenezer and left her clock and silver tankard to her son Ebeneber, to her daughter Mary Hussey her 'silver spout cup,' dividing all the rest into five equal parts for her five children." 884 | ||||||||||
