John Bankert's Sale of Part of his Inheritance to Stephen Sholl, 1808

At the request of Stephen Sholl the following Deed was recorded the 6th Feby 1809 to wit

This Inenture made this twenty second date of October Eighteen hundred and eight Between John Banker of Frederick County and State of Maryland of the one part and Stephen Sholl of the same place of the other part Witnesseth that fore and in consideration of one hundred and fifty pounds current money to him in hand paid before the sealing and delivery of these presents the receipt whereof he the said John Banker doth hereby acknowledge and himself therewith fully satisfied contented and paid hath granted bargained and sold and by these presents doth grant bargain sell alien enfeoff release and confirm to the said Stephen Sholl his heirs and assigns forever all the following described parcel of land being one of two distinct tracts of Land consisting of the plantation on which the said John Banker now lives containing ninety odd acres and that now sold of which of which  he with his brothers jointly become possessed by his father’s death and of which he has by certain intermediate conveyances become sole proprietor.—Beginning for the part now sold at a stone planted at the end of 13 ps on the 10th line of a tract of land called Christophers Lot and running thence north eighty five and three quarters degrees west fifty two and three quarter perches to a stone at the end of 25 ps on the 6th line of said Land and with it reversed north twenty one and three quarter degrees west twenty five perches to a stone still with said land reversed north forty six and three quarters degrees west forty eight perches to a stone then north fifty eight and three quarters degrees west twenty perches to a stone north thirteen and a quarter degrees east three & a half perches to a stone south seventy five and three quarter degrees east one hundred twenty seven and three quarter perches to a stone south thirteen and a quarter degrees west thirty one perches to a stone at the end of the 9th line of Christopehrs Lot and with said land south thirteen and a quarter degrees west thirteen perches to the first beginning Containing twenty six and a quarter acres Together with all and singular the improvements and advantages thereunto belonging or in any wise appertaining To have and to hold the same with the appurtenances unto himself the said Stephen Sholl his heirs and assigns forever and to their only proper use benefit and behoof warranted and defended from and against him the said John Banker and his heirs and against all and every person or persons claiming or to claim any right title or interest in and to the same or any part thereof shall and will forever defend by these presents.  In witness whereof the said John Banker hath hereunto set his hand and affixed his seal on the day and year first above written.

Which was thus Indorsed to wit

State of Maryland Frederick County to wit On the day of the date of the within instrument of writing appeared John Banker the grantor before two Justices of the peace for the County aforesaid and acknowledged the same to be his act and deed and the land and premises thereby intended to be conveyed to be the right and estate of Stephen Sholl his heirs and assigns forever.  And at the same time also appeared Lovis the wife of said John Banekr and relinquished her right of dower in the said land and premises and being by us privately examined apart and out of the hearing of her said husband acknowledged she did the same freely and voluntary without being induced thereto by force threat or ill usage by her husband or a fear of incurring his displeasure.  Taken and certified.

At the request of David Leister the following Deed was recorded the 6th Feby 1809 to wit:

This Indenture made this twenty second day of October Eighteen hundred and eight Between John Banker of John of Fredk County and State of Maryland of the the part and David Leister of the same place of the other  Witnesseth that for and in consideration of fifteen pounds current money to him in hand paid before the sealing and delivery of these presents the receipt whereof he the said John Banker doth hereby acknowledge and himself therewith fully satisfied contented and paid  Hath granted bargained and sold and by these presents doth grant bargain sell alien enfeoff release and confirm unto the said David Leister his heirs and assigns forever all the following described parcel of land to wit:  Beginning at a stone being the beginning of said Leisters Land and running thence with the first line thereof north forty four and three quarter degrees east thirty two and a half perches to a stone near a Hickory Sapling then with the out lines of said Bankers land reversed south forty two degrees west seven and three quarter perches to a stone then by a dividing line between the land now sold and Banekrs other land north thirty one degrees west thirty three and half perches to the stone at the first beginning then from the said stone the same course continued north thirty one degrees west sixty nine perches to a stone in the out line of Bankers land and with it reversed north seventy four and an half degrees east three ps to a stone at the beg of the given line of said Leisters land then with the same south twenty eight three quarter degrees east sixty eight ps to the first beginning Containing one and half Acres.  Together with all and singular the improvements and advantages thereunto belonging or in any wise appertaining.  To have and to hold the same with the appurtenances unto him the said David Leister his heirs and assigns forever and to their only proper use benefit and behoof.  Warranted and defended from and against himt he said Jno. Banker and his heirs and against all and every person or persons claiming or to claim any right title or interest in and to the same or any part thereof shall and will forever defend by these presents.  In witness whreof the said John Banker hath hereunto set his hand and affixed his seal on the day and year first above written.
