JOHANN JACOB BANKERT, JR’S WILL

In the Name of God, Amen. I Jacob Bankert of Frederick County in the state of Maryland, being sick and weak in body, but of sound and disposing mind, memory and understanding, considering the Certainty of death and the uncertainty of the time thereof & being desirous to settle my worldly affairs, and thereby be the better prepared to leave this world when it shall please god to call me home, do therefore make and publish this my last will and Testament in manner and form following, that is to say – First and principally I Commit my soul into the hands of almighty God and my body to the earth to be decently buried at the discretion of my Executors herein after named, and after my Debts and funeral charges are paid, I desire and bequeath as follows. I give and bequeath unto my daughter Catharine Bankert, all my personal property of every description whatsoever that I now own and possess to her the said Catherine her heirs and assigns forever. I give devise and bequeath unto the sons & daughters of my son John Bankert (deceased) namely Isaac Banker, Elizabeth Bankert, James Bankert, Rebekah Bankert, David Bankert, Elias Bankert, owen Bankert, Henry Bankert & Maria Bankert all that part of my Real estate, which I purchased from Samuel Owings containing about twenty acres of land, & also about twenty acres of land part of the plantation whereon I now reside, it being all that part of my Real Estate, which my son John Bankert had in his possession in his life time & now in possession of my son John’s widow divided by amiddle fence from my planation, to them the said Isaac, Elizabeth, james, Rebekah, David, Elias, owen, Henry, & Maria, share & share alike.
 
I give devise & bequeath unto my son Peter Bankert, all the ret and residue of my Real Estate, that I now own and possess, not hereinbefore devised, on conditions that the said Peter Bankert shall pay the sum of Sixteen Hundred Dollars current money to such persons and at such times, as I shall herein after direct. It is my will and desire ths the foregoing Sixteen Hundred Dollars shall be divided into Eight Equal annual payments of Two Hundred Dollars Each to be paid as follows. It is my will that the first payment of two Hundred Dollars shall be paid to my son Mathias Bankert, or to his heirs one year after my decease, my will further is that the second, third and fourth annual payments of two Hundred Dollars each shall be equally divided between my son Jacob Bankert and my Daughter Ester Hinds & my Daughter Catharine Bankert annually, share and share alike, as they become due and my will further is that the fifth, sixth, seventh & eighth annual payments of two hundred Dollars Each, shall be paid annually and equally divided between my sons Jacob Bankert & Mathias Bankert and my daughters Ester Hinds, Catharine Bankert, share and share alike, as they become due, no Interest to be charged when there is no payment due, the forgoing payments are to be a lien on my real estate. It is my will that about one Hundred and five dollars be deducted out of my son Jacob Bankert’s Legacys to be applied towards the payment of a judgment which Andrew Shriver appears to have recovered against me, on my son Jacob Bankert’s account. It is my will and desire, that if my son Peter Bankert should refuse to take my Real Estate, on the Conditions herein before stated, I then, and in that case direct the same to be sold by my executors hereinafter named, as soon as possible after my decease to the best advantage and the proceeds of such sale, to be equally divided between my children, namely Jacob Bankert, Mathias Bankert, Peter Bankert, Ester Hinds & Catharine Bankert share and share alike. And Lastly I do hereby constitute and appoint my son Peter Bankert and my son in law Patrick Hinds to be sole Executors of this my last will and Testament. Authorising my said Executors to Convey by deed of conveyance all property that they sell under the directions of this my last will and testament, Revoking and annulling all former wills by me heretofore made, ratifying & confirming this & no other to be my last will & Testament. In testimony whereof I have hereunto set my hand, and affixed my seal this 2d day of May 1824.

Frederick County, to wit, on the 16th day of February 1825 then came Peter Bankert and made oath on the Holy Evangely of Almighty God that the foregoing Instrument of willing is the true whole will and testament of Jacob Bankert, late of Frederick County deceased that hath come to his hands and possession and that he doth not Know of any other.

Frederick County to wit. On the 16th day of February 1825, there came Jacob Mathias and Robert Crawford two of the subscribing witnesses to the foregoing last will and Testament of Jacob Bankert, late of Frederick county, deceased, and made oath on the Holy Evangely of Almighty God that they did see the Testator therein named sign and seal this will, that they heard him publish, pronounce, and declare the same to be his last will and Testament, that at the time of his so doing he was to the best of their apprehensions of a sound and disposing mind, memory and understanding that they together with David Leister and John Bonder the other subscribing witnesses to this will respectively subscribed their names as witnesses to this will in the presence and at the request of the Testator and all in the presence of each other.

To the Register of wills of Frederick County: The appointment made by Jacob Bankert late of Frederick County, deceased, as an Executor in his will, I do hereby refuse, and decline being an Executor, as witness to my hand this 14th day of August 1824.
