This Indenture made this twenty second day of
November Seventeen hundred and Eighty three Between Benedict Swope of
Baltimore Town and of Baltimore County gentleman of the one part and
Christofle Bankert of the same place County and State Afsd of the other
part, Witnesseth that the said Benedict Sope for and in Consideration
of the payment of the Rents and Performance of the Covenants herein
after mentioned on the part of the said Christofle Bankert and his
assigns to be paid and performed, hath devised, granted, Leased, and to
farm lette, and by these presents doth devise, grant, Lease and to fair
let unto the said Christofle Bankert, Executors, Administrators and
Assigns all that half Lot or parcel of ground situate and lying in
Howards lote addition to Baltimore Town, [[2 words] and [word] on a
Hill{?} of said Town by the number Seven hundred and sixty none
Beginning on the same on the north side of Conway Street Eight Perches
East from the Intersection of Howard and Conway Streets and running
thence East bending[?] on Conway Street two Perches then north nine
Perches and one quarter of a Perch to Brandy Alley then west bending on
Brandy Alley two perches and then to the beginning Together with
all Improvements thereon made, Lanes, Alleys, Ways, Waters,
Priviledges, Easements, Emoluments, and Advantages to the said half Lot
of ground belonging or in any wise appertaining To have and to hold the
said half Lot of grand and Premises with their and every of their
appurtenances unto the said Christofle Bankert his Executors,
Administrators, and Assigns from the day next before the day of the
date of these presents for and during and until the full and and Term
of ninety nine years from thence next Ensuing fully to be complete and
Ended yielding and paying therefore to the said Benedict Swope his
Heirs and Assigns the yearly rent or sum of Twelve Pounds Current money
in half [?] at three Pounds each and Mexican Dollars at Seven shillings
and six pence each on the first day of September in each and every year
during the Continuance of this present devise, and if it shall happen
that the said yearly rent or sum Twelve Pounds Current money shall be
in arrear and appear by the space of sixty days after the time on which
the same is above reserved to be paid the same being first Lawfully
Demanded that then It shall and may be Lawful to and for the said
Benedict Swope his heirs or assigns, into the said devised Premises or
any part thereof in the name of the while to [?] and the same to have
again repossess occupy and Enjoy as in his or their former Estate until
all such arrearages of rent with legal Interest therefore and all and
every Cost Charge and Expence Incurred by the said Benedict Swope his
heirs or assigns by reason of the non payment of said rent shall be
fully satisfied and paid or make distress[?] therefore at his or their
option, and also if the said yearly rent or sum of twelve pounds
Current money shall be in arrears or unpaid by the space of one whole
year next after the time on which the same is above reserved to be paid
the same being first Lawfully Demanded that then it shall and may be
Lawful to and for the said Benedict Swope his heirs or assigns, into
the said demised Premises or any part thereof in the name of whole to
reenter and the same to have again to possess occupy and Enjoy as in
his or their former Estate and that then and in such case this
Indenture and every Clause matter and thing therein Contained shall
from thenceforth be utterly void and of none Effect. And the said
Christfle Bankert doth for himself his heirs, Executors, and
Administrators, Covenant and agree with the said Benedict Swope his
heirs and assigns that he the said Christofle Bankert and his assigns,
shall within the Term of four years from the date hereof, Erect and
Build a good Substantial Dwelling House of a yearly value of twenty
Pounds Current Money, and in Case the said building shall not be
Erected, within the said Term then he said Christofle Bankert for
himself his Heirs, administrators and assigns doth Covenant to pay to
the said Benedict Swope his Heirs and assigns the annual Sum of Eight
Pounds Current Money, Exclusive of and in addition to the rent already
[?] which said additional Sum of Eight Pounds Current Money shall be
regularly and duly Paid every year, until the said buildings are
Erected, and then to cease and not before, and the said Christofle
Bankert for himself his Executors Administrators, and Assigns, doth
Covenant and agree to and with the said Benedict Swope his heirs and
Assigns, well and truly to pay the above reserved yearly rent or sum of
twelve Pounds Current Money at the time above [?]ited for the payment
of the same, and the said Benedict Swope for himself his Heirs and
assigns doth hereby Covenant, and agree to and with the said Christofle
Bankert and his assigns, that he the said Christofle Bankert and his
Assigns on the Payment of the Rent and Performance of the Covenants
herein before mentioned and reserved on the part of the
said, his
assigns to be paid and performed, shall and may peaceably and quietly
have hold and occupy, Possess and Enjoy the above demised Land and
Premises, with their and every of their appurtenances for and during
the aforesaid Term of ninety nine years for which the same is above
demised without the let[?] trouble or Interruption of him the said
Benedict Swope and his heirs or assigns, or any other Person or persons
Claiming anything therein by form or [?] [?] them or any of them as by
his or their [?] or [?] and also that the said Benedict Swope and his
heirs and assigns at any time or times hereafter during the Continuance
of this covenant Demise on the request and at the cost and Charge of
him the said Christofle Bankert and his assigns and on his or their
Payment [?] [?] in Payment the sum of Twelve Pounds as a [?]
thereof to the said Benedict Swope his Heirs and Assigns made and
Execute or cause to be made and Executed [?] [?] lease of the above
demised Land and Premises for other ninety nine years to Commence and
take Effect from and at the end of the Term for which the same is above
demised Subject to the same rents and under the like Covenants Clauses
and Agreements, as are herein before mentioned so that this present
demise may be renewable and renewed for Ever. In Witness whereof

before us the subscribers two of the Justices of the peace for said
County the within named Benedict Swope and Chrisoper Bankert and
severally acknowledged the within Instrument of Writing to be their
respective Act and deed according to the true Intent and meaning
thereof and the Act of Assembly made and provided in such case.

This Indenture made the sixteenth day of January Seventeen
Peter Banker}
hundred and Eighty six Between Christopher
Banker of Baltimore Town and County & State of Maryland of the one
part, and Peter Banker of the County Town and State aforesaid of the
other part. Whereas Benedict Swope, by his Indenture of lease having
date on the second day of November seventeen hundred and Eighty three
for the Considerations therein mentioned did devise grant lease and to
farm Let unto Christopher Banker his Executors, administrators and
assigns all that part of Lott or parcel of Ground Situate and lying in
Howards late addition to Baltimore Town and ___ and distinguished on a
Plat of said Town by the number Seven hundred and sixty nine, Beginning
for the same on the North side of Conway Street, eight perches East
from the Intersection of Howard and Conway Streets and running then
East binding on Conway Street two perches thence north nine perches and
one quarter of a Perch to Brandy Ally, thence west, binding on Brandy
Ally two perches, thence to the Beginning, with all the privileges and
advantages thereunto belonging or may be appertaining. To have and to
hold the said part of Lott or parcel of Ground unto him the said
Christopher Banker his Executors administrators and Assigns for and
during and ___ and term of ninety nine years hence next ensuing and
fully to be compleat and ___ subject to the Payment of the Rents and
Performance of the Covenants therein aforesaid with Civenants therein
also contained for _____ from time to time for ever as by the said
lease recorded among the records of Baltimore County Court in liber
W.G. No. S folio 244 referance thereunto being had will more fully and
at large appear----
Now this Indenture Witnesseth that the
said Christopher Banker for and in Consideration of the Sum of thirty
seven pounds Ten Shillings specie Money to him in hand paid by the said
Peter Banker at and before the ensealing and Delivery of these presents
the receipt whereof he the said Christopher Banker doth hereby
Acknowledge, hath given granted Bargained and sold, assigned,
transferred and set over, and by these presents doth give grant bargin
sell assign transfer and set over unto the said Peter Banker his
Executors administrators and assigns all the following part of the said
part of Lott or parcel of Ground which is contained within the metes,
Bounds, Courses, and Distances, to wit. Begining for the same on the
north side of Conway Street Eight Perches east from the Intersection of
Howard and Conway Streets and running thence East bounding on Conway
Street two perches, thence North Seventy five feet thence West parallel
with Conway Street two Perches thence with a straight line to the
Beginning together with the premises thereon being and all and every of
the appurtenances and advantages thereunto belonging, and al the
Estate, Right, Title, and Interest, Term of years yet to Come and
unexpired ___Claim and demand whatsoever of him the said Christopher
Banker has in or thereto, To have and to hold the said part of Lott or
parcell of Ground and the appurtenances and Advantages thereunto
belonging unto him the said Peter Banker his Executors, administrators
and assigns for and during the rest, residue, and remainder of the said
term of Ninety nine [bottom line cannot be read] in as full
large ample and beneficial manner to all Intents and purposes
whatsoever as he the said Christopher Banker might should Could or
ought to have held and enjoyed the same by any way or means whatsoever
and the said Christopher Banker for himself his Heirs, Executors,
administrators and assigns doth Covenant promise grant and agree to and
with the said Peter Banker his heirs Executors administrators and
assigns that upon the said Peter Banker his executors administrators
and assigns paying unto the said Christopher Banker the rent of one
pepper Grain yearly and every year on the first day of September during
the before in part recited Indenture shall and may at all times
hereafter peaceably and quietly have hold use occupy posses and enjoy
the aforesaid part of Lott or parcel of Ground and premises without the
least ___ Trouble or hindrance of him the said Christopher Banker or
his heirs or any other person or Persons lawfully Claiming any thing
therein or thereto by from on under him them or any of them and further
that the said Peter Banker his Executors administrators or assigns on
paying one pepper Grain as a fine therefore at any time or times
hereafter shall have ___ment of the above assigned part of Lott
or parcel of Ground and premises or manse and form as is
mentioned and Expressed in the above in part recited Indenture of lease
and under the same Rents as are herein mentioned so that this
assignment shall be ___ and ___ for ever. In Witness whereof the said
Christopher Banker hath hereunto set his hand and affixed his seal the
day and year first above written.
