At the request of Abraham Bankard the
following deed was recorded 2d January 1796, to wit
This Indenture made the twenty sixth
day of December anno Domino one thousand seven hundred and ninety five
Between Peter Erb and John Erb of the County of Frederick and State of
Maryland of the one part, and Abraham Bankard of the County of
Frederick and State of Maryland of the other part Witnesseth that
the said Peter Erb and John Erb for and in consideration of the sum of
sixty five pounds, to them in hand paid at and before the ensealing and
delivery of these presents the receipt whereof the said Peter Erb and
John Erb doth hereby acknowledge and themselves therewith to be fully
satisfied consented and paid Hath given granted bargained sold aliened
released enfeoffed and confirmed, and by these presents doth give grant
bargain sell alien release enfeoff and confirm unto the said Abraham
Bankard his Heirs Executors Administrators and Assigns all that part of
a tract of Land called The resurvey on High Germany, Beginning at a
stone erected at the end of the sixteenth perch on the first line of a
tract called Hill Spring allowing two and one fourth degrees for
variation and running by [?] on, two [Courses?] North thirty and a half
West thirteen perches to a Stone North fourteen and a half West one
hundred and fifteen perches to a Stone at the end of forty eight
perches on the eleventh line of the whole tract called The resurvey on
High Germany as surveyed and bounded by agreement between the parties
interested with two and a quarter degrees allowance for variation then
with said lid land the four following [courses?] South eighty three and
a quarter degrees East thirty eight perches to a Stone South seven and
three quarters degrees West fifty perches South five and one quarter
degrees East thirty nine perches South eighty eight and three quarters
degrees East six perches to the second line of the aforesaid Tract
called Hill Spring then with said line reversed South twenty seven and
three quarters degrees West eight and a half perches to the end of the
first line of said Land then to the Beginning containing thirteen acres
Together with all rights profits Benefits and Advantages to the same
belonging or in any wise appertaining. To have and to hold the
said land and premises unto the said Abraham Bankard his Heirs
Executors Administrators and Assigns forever. And the said Peter
Erb and John Erb for themselves their Heirs Executors and
Administrators doth covenant grant promise and agree to and with the
said Abraham Bankard his Heirs Executors Administrators and Assigns
that the said Peter Erb and John Erb their Heirs Executors and
Administrators the said land and premises, unto the said Abraham
Bankard his Heirs Executors and Administrators as well against the said
Peter Erb and John Erb as against all persons claiming by from or under
the said Peter Erb and John Erb shall and will warrant and forever
defend by these presents. In Witness whereof the said Peter Erb
and John Erb hath hereto put their Hands and Seals the day and year
first above written.

Which was thus endorsed to wit
Frederick Coutny to wit On the
25th day of December 1795 came Peter Erb and John Erb the Grantors
named in the above Instrument of writing before the Subscribers two of
the Justices of the peace for the said County and acknowledged the same
to be their act and deed and the Lands and premises therein mentioned
to be the right and Estateof the said Abraham Bankerd his Heirs and
Assigns forever according to the true Intent and meaning of the said
deed and the Act of Assembly in such Cases made. At the same time came
Elizabeth wife of the said Peter and Catherine wife of the said John
and being by us privately examined did relinquish their separate rights
of Dower of in and to said Land unto Abraham Bankard, and declared they
did the same freely and willingly.
