Abraham Bankert's Sale of Portion of "Resurvey on John's Lott" to Peter Stonesifer, 1798

At the Request of Peter Stonesifer the following Deed was Recorded may 21st 1798, to wit

This Indenture made this fifth day of May seventeen hundred and ninety eight: Between Abraham Banker and Magdalena his wife both of Frederick County and State of Maryland of the one part and Peter Stonesifer of the same place of the other part.  Witnesseth that the said Abraham Banker for and in Consideration of twenty seven pounds specie to him in hand paid by the said Peter Stonesifer Before the sealing and delivery of these presents the receipt whereof is hereby acknowledged by the said Abraham Banker and thereof Doth acquit and discharge the said Peter Stonesifer his heirs executors and administrators and every of them by these presents Have granted bargained and sold aliened enfeoffed released and confirmed and by these presents Do grant bargain & sell alien enfeoff release and confirm unto the said Peter Stonesifer his heirs and assigns, all the following Tract or parcel of Land, viz:  Beginning at the end of the third line of a tract of Land called Gilberts Delight and running with it reversed with an allowance of two and an half degrees for variation north forty four and an half degrees, East seventy nine perches to the eighth line of The Resurvey on Johns Lott and with it reversed with an allowance of two and an half degrees for variation South sixty two and an half degrees, West sixty four perches to the Beginning of said line then by a straight line to the first Beginning Containing four and a quarter acres more or less, being part of the Resurvey on Johns Lot and situate in Frederick County aforesaid.  Together with all and singular the woods, waters, rights, privileges, [?] and appurtenances to the said tract of Land belonging or in any wise appertaining and the [?] [?] and profits thereof, also all the right, title use possession interest and estate property claim and demand whatsoever of them the said Abraham Banker and Magdelena his Wife in Law or equity of in and to the said Tract of Land or any part thereof.  To have and To hold the said Tract of Land Containing four and a quarter acres more or less as the same is above described with the appurtenances unto the said Peter Stonesifer his heirs and assigns to the only proper use and behoof of him the said Peter Stonesifer his heirs and assigns forever.  And the said Abraham Banker and Magdelena his wife for themselves and their heirs do Covenant promise and agree to and with the said Peter Stonesifer his heirs and assigns by these presents that he the said Abraham Banker and his heirs the said Tract of Land with the appurtenances unto the said Peter Stonesifer his heirs and assigns, against him the said Abraham Banker and his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof, by from or under him them or any of them shall and will covenant and forever defend by these presents.  In Witness whereof the said parties have hereunto set their hands and applied their seals the day & year above written.

Which was thus endorsed, to wit, Frederick County, On the day of the date of the above Instrument of writing Came Abraham Bankert party thereto before us two of the Justices of the peace for said County and acknowledged the same agreeably to Law.  At the same time came Magdelena his wife and acknowledged the same agreeably to Law and being by us privately examined out of the hearing of her said Husband declared that she willingly did the same and was not induced thereto by fear or threats of her said Husband ill usage from him or a fear of his displeasure.
