At the request of Martin Study the
following Deed was recorded 19th March 1789 to wit,
This Indenture made the twenty second
day of November in the year of our Lord one thousand seven hundred and
eighty eight Between Jacob Bankert of Pipe Creek in Frederick County
and State of Maryland Miller of the one part and Martin Study of Silver
Run in said County and State Miller of the other part Witnesseth that
the said Jacob Bankert for and in consideration of the sum of forty
three pounds current Money of Maryland to him in hand paid by the said
Martin Study the receipt whereof he doth hereby acknowledge and
thereof and therefrom doth acquit and forever discharge the said Martin
Study his Heirs and Assigns by these presents Hath bargained sold
aliened enfeoffed and confirmed, and by these presents doth bargain
sell alien enfeoff and confirm unto him the said Martin Study his Heirs
and Assigns forever All that the following described Tract or parcel of
Land being part of two Tracts of Land one called “The Resurvey on Johns
Lott” and the other The addition to the Resurvey on Johns Lott” situate
lying and being in Pipe Creek Hundred and County of Frederick aforesaid
Beginning for the lines of the whole, hereby bargained and sold at the
end of the fourth line of a Tract of Land called the Resurvey on High
Germany and running thence South five degrees East sixty four perches
North seventy eight degrees East sixty nine perches thence with
Laurence Erbaugh’s Land North forty five degrees West fourteen perches
then North two degrees West thirty four perches to the end of the
seventh line of the Resurvey on Johns Lott then North forty degrees
West fifty seven perches Then with a straight line to the Beginning
containing twenty seven Acres and a half of land more or less Together
with all and singular the Buildings Improvements and Appurtenances
thereunto in any wise belonging or appertaining To have and to hold the
said Tract of land and premises with the appurtenances hereby bargained
and sold unto him the said Martin Study his Heirs and Assigns forever
to the only proper Use Benefit and Behoof of him the said Martin Study
his Heirs and Assigns forever and to and for no other Use Intent or
purpose whatsoever. And the said Jacob Bankert doth covenant and
agree to and with the said Martin Study that he the said Martin Study
his Heirs and Assigns forever shall and may have hold and enjoy the
said Tract or parcel of Land containing twenty seven Acres and an half
and premises warranted and forever defended against him the said Jacob
Bankert his Heirs and Assigns and also against all and every other
person or persons claiming or to claim any thing therein or thereto by
from or under him them or any of them In Witness whereof the said
Jacob Bankert hath hereunto set his Hand and Seal the day and year
first above written.

Which was thus endorsed to wit
Received on the day of the date of the
above written Indenture of the above named Martin Study the sum of
forty three pounds current Money of Maryland being in full the
Consideration Money above mentioned &c.

Frederick County On the
22d day of November 1788 before us the Subscribers two of the Justices
of the peace in and for said County personally came the above named
Jacob Bankert and acknowledged the above Indenture to be his Act and
deed and the Land and premises therein mentioned to be the right and
Estate of the above mentioned Martin Study his Heirs and Assigns
forever according to the true Intent and meaning thereof. At the
same time came also Esther wife of said Jacob Bankert and being by us
privately and apart from her said Husband examined she freely gave up
her right of Dower of in and to the said Land and Premises, and said
she did the same freely and voluntarily without any Coercion or
Compulsion of her said Husband.
